The UAE authorities have announced the Amnesty Program that helps violators of the Residence, Visit, and Tourist visa. They will have a two-month grace period to have their fines waived. Starting September 1st until October 31st 2024, violators will be exempt from any fine for overstaying or absconding under the Federal Law on Foreign Entry and Residency. And get hired by the companies offering jobs to skilled workers at the Amer and ICP centres.

In order to implement this initiative, the Authority will waive fines and legal consequences, allowing violators to either adjust their status or leave the country without difficulty. In a statement, the Federal Authority for Identity, Citizenship, Customs and Port Security (ICP) stated that the decision aims to provide violators with a new opportunity to regularize their status in accordance with the law, as a gesture that demonstrates the values of compassion and tolerance that underpin the UAE.

The grace period, starting September 1st, will allow violators to regularize their status or leave the country without incurring fines. In a statement, the Federal Authority for Identity, Citizenship, Customs and Port Security (ICP) said the decision aims to provide violators with a new opportunity to regularize their status in accordance with the law, as a gesture that reflects the values of compassion and tolerance upon which the UAE is built".

Fines will be imposed on those who fail to leave the country or renew their visas before expiration. The penalties have been standardised as of 2023. Residents, tourists and visit visa holders who overstay now pay Dh50 a day instead of Dh100. Expats wishing to renew their visa are given grace periods of up to six months after their residence visa is cancelled or expired.

Applicants can submit a request to exempt/reduce the fine imposed on violators of the Foreigners' Entry and Residence Law through a dedicated service. Among the documents required are a copy of the violator's passport, a letter explaining the reasons for the violations and his or her inability to pay them, as well as any other documents requested by the Fines Committee. Customers are required to visit their nearest Customer Happiness Center (Amer), obtain an automated queue ticket, submit their application and documents (if applicable) to the customer service employee, and pay the service fee (if applicable).

Sick Leave Law in UAE (Paid and Unpaid)

After the probationary period ends, employees are only allowed 90 days of sick leave a year. The 90 days of sick leave can be continuous or intermittent, and the salary is as follows:

- Full payment for the first 15 days
- Half payment for the next 30 days
- No payment for the rest 45 days

The employee may, however, request sick leave without pay during the probationary period, provided the employer approves and based on a medical report from the medical entity stating the necessity of the leave.

Additionally, in the following circumstances, an employee is not eligible for paid sick leave:

- During the probationary period
- The illness is directly caused by the worker's misconduct, such as drinking alcohol or using drugs
- In the case of an employee who violated instructions regarding safety in accordance with UAE legislation, as well as the firm's regulations, which the employee was informed of.

According to Article 31 of the UAE Labour Law, employees are required to notify their employers of their illness within three days, as well as submit a medical report, issued by a medical professional certifying their condition.

Is it possible to terminate an employee due to sickness?

When an employee is on sick leave, the employer may not dismiss him or give him a termination notice. If the employee fails to return to work after taking all of his 90 days of sick leave, the employer may terminate his employment. Employees in such situations are entitled to end-of-service benefits in accordance with the provisions of the Labour law.

Wages Protection System (WPS)

The Wages Protection System (WPS) oversees the payment of workers' salaries in the UAE through an electronic wages transfer system. Ensures that UAE workers receive their wages and salaries in a timely manner based on their employment contracts.

When should employers pay salaries?

Wages are due from the first of the month until the 15th of the month.

Employers are in default of paying wages if they fail to do so within the first 15 days following the due date unless a shorter period has been agreed upon.

how can you register for WPS?

Please be aware of the following requirements before registering for WPS:

A corporate bank account with any UAE-registered bank is required.

WPS agents are responsible for the payment of wages to your employees under a contract. WPS agents may be banks, exchange houses, or any other financial institution registered with MOHRE.

A minimum of 90% of all staff wages and salaries must be paid.

Payment fees, expenses, provider charges, and other related costs must be met by you.

The failure to pay salaries on time may result in penalties. Our next video will provide a more in-depth discussion on it.

Employees Working Hours & Overtime in Private Sector as per U.A.E Labour Law.

It is required that workers work eight hours per day or 48 hours per week. In the month of Ramadan, working hours are reduced by two hours.

Commute time is not included in the working hours of the worker.

Workers who work five consecutive hours are entitled to one or more breaks. The length of these breaks must not be less than one hour.

The working hours do not include breaks.

Employers may ask their employees to work overtime so long as it does not exceed two hours per day.

Work that requires the worker to work beyond normal working hours will be compensated with a salary equal to the remuneration for normal working hours plus 25%. If overtime is performed between 10 p.m. and 4 a.m., it may increase to 50%. Employees who work on a shift basis are not subject to this rule.

As stated in the labour contract or work regulations, if circumstances necessitate a worker working on his off-day or public holiday, he will be entitled to a substitute rest day or to a pay equal to normal working hours' remuneration plus 50% of that amount.
