VHS to Digital will handle all media with the utmost care and respect. Every reasonable precaution will be taken to protect customer materials from damage, loss, or deterioration during the transfer process.
2. Customer Acknowledgment
The Client understands and acknowledges that:
All tapes, film, or media are inherently fragile and may have aged, degraded, or become brittle over time. Some damage or breakage may occur during normal playback or processing, even under ideal conditions. Due to the mechanical nature of VHS and tape-based media, there is an inherent risk of damage or malfunction that cannot be entirely eliminated.
3. Limitation of Liability
The Client agrees that VHS to Digital shall not be held liable for:
Any loss, damage, or destruction of tapes, film, or media, whether caused by equipment malfunction, handling, shipping, or other unforeseen events. Any incidental or consequential damages, including emotional distress or loss of sentimental value. In any case, liability is strictly limited to the cost of the Services provided for the affected item(s).
4. Shipping and Delivery
Clients are responsible for ensuring that their tapes or media are securely packaged for transport. VHS to Digital is not responsible for items lost or damaged during shipping to or from our location. It is recommended that clients use a tracked and insured shipping method for added protection.
5. Returned Media
Upon completion of the Services:
Original tapes will be returned to the Client unless otherwise specified. Once the order is accepted and completed, VHS to Digital assumes no further responsibility for the materials.
6. Customer Consent
By submitting materials for service, the Client acknowledges and accepts all risks associated with the handling, transfer, and shipment of media, and agrees to the limitations of liability described in this agreement.
