The political context surrounding the reform of the Federal Constitutional Court (FCC) ties closely to Germany’s domestic politics 🇩🇪. Since last year, Germany has been debating ways to enhance the “resilience of the rule of law” ⚖️. This discussion includes potential changes to the rules governing the FCC, particularly the procedure of electing its justices 🏛️.

Three main factors are fueling this debate:

The upcoming Bundestag elections in 2025 🗳️,
The possible rise in voter support for the AfD and the BSW 📊,
The absence of detailed provisions in Germany’s Basic Law regarding the FCC 📜.

There is also concern that the AfD or another party might challenge or disrupt the “established state practice” ⚠️.

This year marks the 85th th anniversary of signing the Soviet-German non-aggression pact in Moscow on August 23rd, 1939. Still today, after 10 years after Russia’s war against Ukraine and more than two years into the full-scale invasion, the following view, both outside and inside of Russia, prevails. Firstly, that the MRP and the secret protocols (the MRP contained one protocol but consequent treaties also contained some) on division of Central and Eastern Europe were condemned by the decision of the Congress of People’s Deputies of the USSR (the highest legislative body at that time, here-after Congress) ‘On the political and legal assessment of the Soviet-German non-aggression pact of 1939’ on December 24th, 1989. Secondly, that the official position of Russia on those documents has been ‘gradually returning’ to the Soviet version of events prior December 1989 that justified the MRP while denying existence of the secret protocols.

Hardly a day goes by without the media raising alarms about the troubled state of the German economy, using terms such as "sick”, “hungover”, and “fatigued". In August 2023, The Economist posed the question of whether Germany had once again become the "sick man" of Europe. These concerns are echoed by businesses, research institutes, and international organizations. The International Monetary Fund (IMF) predicts that Germany will be the only advanced economy to experience a drop in GDP in 2024. This raises the question of whether the current weakness in the German economy is merely a temporary issue or if it stems from deeper structural problems that necessitate a fundamental shift in its current developmental model. The former option is supported by the fact that Germany was already labeled the “sick man” of the eurozone in 1999, yet it went on to become the economic powerhouse of the region for decades. Up until 2018, Germany was seen as a major beneficiary of globalization. The latter option, however, is suggested by the growing disparity between the German and U.S. economies, a trend that has been unfavorable to Germany for more than a decade.

In the article published in the latest "Przegląd Zachodni," we discuss Germany's policy towards Russia after the end of the Cold War. We particularly focus on events in Ukraine, such as the Orange Revolution, the annexation of Crimea, the conflict in the country's east, and Russia's invasion in February 2022. This marked a turning point in German foreign policy, signifying a radical departure from Germany's traditional image as a stabilizing force in the international arena. The article analyzes these changes in the context of "Zeitenwende" (the turning of times).

Paradoxically, it was the German-Soviet arrangement of September 28, 1939 that caused the defeated Germany in 1945 to lose, under the terms of the Potsdam Conference, the territories east of the Oder and Lusatian Neisse rivers. Joachim von Ribbentrop's two visits to Moscow, one in August and the other in September 1939, were part of a sinister tradition of targeted cooperation against Poland of the Republic's two powerful neighbors. The first of these resulted in a pact of of non-aggression, the secret protocol of which made the pact essentially a pact of aggression - as it gave the green light for a German attack on Poland. Act two came during another visit by the head of N**i diplomacy to Moscow, when a German-Soviet treaty on friendship and borders was concluded. This treaty was essentially another fourth partition of Poland. The subsequent course of events, moreover, meant that the Republic never again returned to its former eastern provinces.

No other member state of the anti-N**i alliance did more to protect persecuted Jews than Poland, its government, its diplomatic corps and its consular services, which reported to the Polish government in exile. Through the dedicated efforts of the Warsaw-based Polish Institute of International Affairs, a copious volume comprising over a thousand pages and 554 documents on such activities was published (edited by Piotr Długołęcki), which will be the object of this review. Hundreds of other documents have been reprinted in full or partially cited in footnotes.

Dank der engagierten Bemühungen des in Warschau ansässigen „Polnischen Instituts für Internationale Angelegenheiten“ wurde ein umfangreicher Band mit über tausend Seiten und 554 Dokumenten über solche Aktivitäten veröffentlicht (herausgegeben von Piotr Długołęcki), der im Zentrum dieser Besprechung stehen soll.
