Former Leader of the Opposition Lennox Linton has secured a landmark constitutional victory against the Attorney General of the Commonwealth of Dominica, after the High Court ruled that President Sylvanie Burton acted unconstitutionally by failing to consider the support of four Opposition Senators when determining who should be appointed Leader of the Opposition.

Justice Zainab Jawara-Alami found that the President’s refusal to recognize the Senators’ support over an 18-month period following the resignation of Jesma Paul-Victor on June 20, 2024, was inconsistent with the Constitution.

The court rejected the Attorney General’s argument that appointed Senators did not have a constitutional role in the selection process. Justice Jawara-Alami ruled that Senators, once appointed, become full members of the House and are entitled to exercise the constitutional rights, privileges and functions of that office, unless the Constitution specifically provides otherwise.

The court determined that the views of the four Opposition Senators were constitutionally relevant and should have been taken into account by the President when deciding on the appointment of a Leader of the Opposition.

The ruling was delivered after legal arguments from both sides, with Linton represented by a team from Trinidad-based Freedom Law Chambers, including Senior Counsel Anand Ramlogan, Jared Jagroo and Vishaal Siewsaran, instructed locally by attorney Ronald Charles. The Attorney General was represented by Senior Counsel Anthony Astaphan, Jason Lawrence, Tameka Burton and Levi Peter.

The court also dismissed challenges to Linton’s standing to bring the case, ruling that he had the right to pursue the matter in the public interest. Linton described the decision as a victory for constitutional governance, democracy and accountability, stating that “the Constitution won” and that public power must be exercised lawfully.
