Mr Maleli Nawai (accused) was Charged on three counts of s*xual offending against his 13-year-old niece CC (Victim). He was charged for Indecent Assault, the particulars being that, between 16 December 2022 to 6 February 2023, at Yadua Island, Bua, he unlawfully and indecently assaulted CC by kissing her on her lips (count 1). Another count of Indecent Assault, particulars being that, between 16 December 2022 to 6 February 2023, at Yadua Island, Bua, he unlawfully and indecently assaulted CC by rubbing her breasts and crotch area over her clothes (count 2). Mr Maleli Nawai (accused) is a 42-year-old married father of two. His eldest child was aged 6 years in 2022. He was born and raised in Yadua.
CC (victim) said that she did not tell anyone about this incident because she was scared. Her father is a very short-tempered man, and she was afraid that he might hit her.

She was home alone one night, reading a book, when the accused came and asked for the wood that is used to beat pandamus leaves. Her parents were out catching crabs. She went to the kitchen to look for the wood. The accused followed her and touched her breasts over her clothes from behind. She turned around and shone the Sun King light on him. He used his hand to rub her p***c area over her clothes. As soon as he touched her, she pushed his hand away. She gave him the wood and, as he left, he told her not to tell anyone. She did not tell anyone about what the accused did because she was scared.

On another day, she returned from bathing wrapped in a towel. As she was about to enter her room, she saw the accused staring at her from the front door. She was home alone as her parents had gone out to sea. She told him to go, but he followed her into her room and pushed her on the bed. He took off his pants and, as she tried to stand, he lay on top of her. He inserted his p***s into her va**na for one or two minutes. He then got dressed and left. She did not say anything to him because she was scared. She did not tell anyone about this incident because the accused had told her not to tell anyone, and she was scared of her father.

These three incidents happened during the eight-week holiday. She remembers this because she left the village to attend boarding school at Labasa College after these incidents. She had attended primary school on Yadua, but there was no high school on the island. The first time that she returned to the village was in August 2024. She did not return to the village earlier during school holidays because she was afraid that the accused might do something else to her. Her parents had asked her to return, but she did not want to. She did not tell her parents why she did not wish to return home. She spent school holidays at her cousin brother’s house in Nacula. She did not tell him about the abuse because she was scared to tell anyone.

The incidents came to light when the police came to the island to conduct an investigation in January 2025. When the police came to the village in January 2025, there were rumours in the village about what the accused was doing to some girls, and that is when her name was mentioned to the police.

CC said that nobody knew about what the accused had done to her before the police spoke to her in January 2025. She was scared and upset when the police questioned her. She was scared that her father would smack her if he came to find out what the accused had done to her.

CC’s stepmother (CM) testified in court that she has raised CC from the age of 2 years. She considers her to be her daughter.

When her father brought CC back to the village in August 2024, CM noticed that CC did not talk much. When she asked her what was wrong with her, CC did not respond. On 20 March 2026 the accused was sentenced to an imprisonment term of 15 years with a non-parole period of 10 years by the Labasa High Court.

Mr. Ravi Prasad is charged with R**E. On the 11th day of June 2023, at Nadi in the Western Division, he penetrated the va**na of LVT (Complainant) with his p***s, without her consent.

In June 2023, LVT was residing in Korovuto in a rented house. She had been working at Bula Water Park, Denarau, as a pool attendant.

On 10 June 2023, while LVT was at work, she received a call on her mobile number from a man who identified himself as Ravi. He said he had picked her up one afternoon and dropped her at Korovuto after she got off from work. She was sure it wasn't her, and her friend had used her phone to call him. So, she informed Ravi, ‘It wasn't me. I think you misunderstood. I haven't met an Indian man named Ravi; I used to go by bus, not by car.’ But Ravi kept on insisting and said, “No, No, it's you.”

LVT then came back from work and joined her friends to drink kava at Jojo’s around 7 p.m. Whilst at Jojo, she received another call from Ravi asking if she could come to Nadi Main Street, opposite ANZ. He insisted that “If you see me, then maybe you can recall the day I dropped you”. She told her friends that she had to go and see a friend and went opposite ANZ, where she saw this person inside a car wearing a black hoodie.

She was told to get in the car because someone would see them. She didn’t want to sit in front, she just sat at the back. Upon seeing him, she was assured that she had never met him before.

He also confirmed that she was not the person he had dropped off at Korovuto. He then offered her two shots of rum. Ravi was also drinking with her in the car. After drinking and talking with Ravi for five minutes, she said she wanted to go back to her friends to drink kava. She thanked Ravi and went back to drink kava at Jojo’s with her friends.

After 10 p.m., Ravi called her again. He invited her to finish his whiskey. She agreed as she just wanted to drink. She met Ravi at the FNPF plaza in Nadi, where she was asked to get into his car to drink. They were drinking while he was driving. She said drinking in the car was risky. So, she invited him to where she was renting in Korovuto. It was safer as the landlord was nearby and also near his place in Malolo. She had only one shot of rum before reaching the flat in Korovuto.

Upon arriving at her flat around 11 p.m., she changed and started drinking. After finishing the bottle of rum, they drank the Chinese whiskey she had in her flat. Most of the time, he didn’t drink. By mixing things (rum and whiskey), he was only offering her to drink. She didn’t feel like drinking anymore, even before the whiskey was finished. Once she was done, she wanted to lie down and sleep. She had drunk kava, rum and whiskey. She was drunk. She told him that she needed to have some rest because she had to go to work at 8 a.m. She crawled down to her bedding and lay down. She said to him: “If you get sober, you can rest for a while, and then you go. Just pull the door once you're on your way to Malolo”.

She fell asleep and woke up around 2- 3 a.m. when she felt a pain in her va**na. She saw Ravi on top of her without any clothes. She too was not wearing any clothes. She tried to push him several times, but he was holding her tightly. He was on her va**na, penetrating her, pulling her up and down for a few seconds. She was shivering and crying. She tried to push him, but he was so strong. After some time, he stood up. She also stood up and went near the kitchen, where the light was on. He followed her, saying, “Tukivinaka, come, we do it some more”. The bed sheet was covered with blood. She touched her va**na, and he also touched her va**na and realised it was blood. When he was penetrating her va**na, she lost her virginity. She said, “I just lost something that I won't get back”.

She hated him and regretted bringing him home. She didn't know that he was going to do that to her. They drank together as friends. She told him to leave. When he left, she closed the door and came back to sleep. That door has a nail with it. She just pushed and nailed it. She cried on top of her bed. In the past, she had brought friends home in groups, but no one did that to her.

She didn't wake up that morning by herself. She was shocked to see Ravi again lying down beside her when she woke up. He said, “why are you still sleeping? I called you several times, but you didn't pick up”. She saw 8 missed calls on her phone. He said, “I came since you told me that you're going to start today at 8 o'clock”.

It was nearly 8 a.m. She had to come from Korovuto to Denarau for work. She woke up and had a shower. He said, “I’m going to drop you”. She said, “no, no, I'll go by myself”. He said, “No, you don't do that. I'll drop you off because you're almost late for work”. He picked her up from there and dropped her at Denarau. On the way, he was asking for forgiveness. He said, “I have a family of two kids. This is between you and me”.

She was not feeling well at work and wanted to go home during her lunch break. She asked her supervisor if she could go home early. The supervisor noticed the love bites on her and joked, “Why? Just because of the thing on your neck, that's the reason you want to go?” She said, “I just don't feel good”. She went home during lunch break. From there, she packed her things and left for Sabeto, where her brother lives.

She didn’t want to stay in Korovuto anymore because Ravi knew where she was staying. She didn't go back to work from the day she left. Ravi knew where she was working. She stayed with her brother for one month. She didn’t want to see Ravi again. When she tried to resist him, he was still bugging her, wanting her to have s*x with him. He kept on calling her. It was disgusting for her to hear him. She gave so many excuses, like the rent was not paid. He offered a house for them to meet and money to pay the rent. He even offered to take her overseas with him.

She refused to accept any of those and reported Ravi to the police in July 2023. She took time because she feared the consequences, and she concluded that this issue was not a priority for her. She thought that if she reported the matter, everyone, including her family, which has 10 siblings, younger than her, would come to know about the incident. They would hate her if they heard this.

Her priority was to complete her education. She got registered with FNU for four units of LLB. During COVID, she was locked down in Suva, and her account was on hold. She had a hard time in Suva, so she came to Nadi looking for work to pay for her hold and go back to school, which was her priority. This issue was not a priority for her.

She did not call the police on the day it happened because she was emotionally hurt. She needed time to think and went to Sabeto for good. Her brother asked the reason why she was not going back to work. She lied and complained about the transport issues. She started working at Votualevu New World supermarket in July (2023). Ravi found out that she was working at New World when she accidentally boarded a minivan that Ravi was driving. He kept coming to her workplace thereafter.

After she reported the matter, the police brought Ravi to the police station in Nadi. He approached her and offered $ 500 to reconcile the matter, to which she did not agree. He kept coming to New World where she worked even after the complaint was lodged. She could not prevent him from coming to the supermarket. On 27 October 2025, she resigned from work because she did not want to see him again.

LVT again explained the reason for the delayed complaint in the following terms: “He had been calling me. I remember blocking his number, but again he called me, and it was still the same person, Mr. Ravi. So, I went on and reported him because whatever he said - “I just wanted to see you”. I can pay the rent at Korovuto, and we can stay there”. I said, I'm not working, but he said I can do anything. I'm about to go to Australia, and I can take you with me. So, he just disgusts me. I don't want to hear anything from him. That's the reason I reported”.

The court noted that the Accused penetrated the va**na of the Complainant without her consent. He mixed rum with whiskey and offered the drinks to the Complainant to ensure that she got intoxicated and boozed. When she fell asleep with the booze, he knew she could not consent to s*xual in*******se. The Accused took advantage and penetrated the complainant with his p***s knowing that she was not consenting.

The Accused was found guilty of R**e as charged and he was convicted accordingly and sentenced to an imprisonment term of 09 years with a non-parole period of 07 years by Lautoka High Court on 18 February 2026.

On 17 November 2023 Mr. Joni Finau (Accused), is being charged with one count of R**e with the particulars being that, on 25th October 2023 at Vunisea in the Eastern Division, Mr. Joni Finau penetrated the va**na of TR (Victim) without her consent.

Mr. Joni Finau was employed as an Ultrasound Technician based at the Vunisea Subdivision Hospital. On 25th October 2023, TR went to the Vunisea Subdivision Hospital for an x-ray scan to which was attended by Mr. Joni Finau.

The Accused s*xually assaulted the Complainant by penetrating her va**na with his fingers without her consent when she went to him for a scan required by her doctor at Vunisea Hospital, Kadavu, on the 25th of October 2023.

The Complainant was a victim of an alleged abduction and s*xual assault and was therefore referred to the hospital for a scan to ascertain whether she was pregnant. The Complainant went to the hospital on the 25th of October 2023 to have her scan done and met the Accused in the scan room with the prescription given to her by Doctor Sheemal.

As testified by the Complainant, the Accused, while performing the scan, had penetrated her va**na with his fingers without her consent. The Accused told her that it was part of the examination when she resisted.

He then told her that they should have s*xual in*******se so as to clean the dirt he found inside her. He attempted to force her into a small room within the scanning room.

As he was trying to force her, someone knocked on the door. The Accused then went and opened the door. It was Doctor Fane. The Complainant left the room using that opportunity.

The Complainant then met with Doctor Krishan and presented the scan report. The Accused handed her the scan report. After meeting Dr Krishan, she returned home and informed Kesaia of the incident she had encountered in the scan room.

The matter was then reported to the Police. Doctor Fane then medically examined her and prepared the medical examination report.

Mr. Joni Finau was charged, found guilty and sentenced at the Suva High Court on 30 January 2026 to 08 years and 11 months' imprisonment, with a non-parole period of 05 years and 11 months.

On 20 June 2023 Mr. Kaioti Rogonavanua (accused) was charged with a count of assault causing actual bodily harm, the particulars being that, on 2 June 2023, at Savusavu town, he assaulted C (Victim) by punching her, thereby causing her actual bodily harm (count one), and a count of r**e, the particulars being that, on 2 June 2023, at Savusavu town, he penetrated C’s va**na with his p***s without her consent.

C, aged 20 years was in Savusavu town at around 3am on 2 June 2023 waiting for the bus to connect with the Taveuni ferry.

She went to relieve herself at a dark place near the taxi stand. As she stood up, she saw the accused standing in front of her, who asked where she was from and where she was going.

He accused her of lying and punched her in the face. She was knocked out and, as she regained consciousness, the accused was pulling down her pants. He touched her private parts and put his p***s inside her va**na for about four to five minutes. He threatened to kill her if she shouted for help. When she told him to stop, he said that he wanted them to be a couple.

As she did not wish to remain in the dark passage, she told the accused to go with her to her grandmother at the taxi stand. With the light from his phone, he showed her a plastic with ma*****na and ma*****na in aluminum foil.

When they reached a place lit by the street light, she saw his face and clothes. He was wearing blue ¾ pants and a t-shirt with different colors. They were close to each other when she observed him by street light. At the taxi stand, she informed an old lady what he had done to her. Upon seeing that she was hurt, the old lady called security, and the accused ran away. The security guard called the police who came and took C to the station to make a statement. She gave a description of her assailant as being a bit taller than her with similar skin colour.

Later, at the bus stand, the police brought a man in a police vehicle. When she identified him, he was arguing with the police officer. She told the police to check his pockets, and they found a plastic of ma*****na. He was wearing the same clothes she had earlier described. She boarded the Taveuni bus and, when she reached Natewa, the police came and took her back to Savusavu. She was taken to the hospital and thoroughly examined. R**e kit swabs were taken. Several months later, a buccal swab was taken at Totogo police station.

Mr Kaioti Rogonavanua was sentenced to 12 years’ imprisonment with a non-parole period of 7 years 9 months at the Labasa High Court on 8 January 2026.

Mr Viliame Mudunasau (1st accused) is charged with a count of r**e, the particulars being that, between 12 to 13 April 2025, at Savusavu town, he penetrated C’s va**na with his p***s without her consent (“count 1”).
Mr Roko Namalumu (2nd accused) was also charged with r**e, the particulars being that, on the same occasion, he penetrated C’s va**na with his p***s without her consent (“count 2”).

Both accused were serving police officers stationed at Savusavu Police Station. After dark on 12 April 2025, they were on mobile patrol in a marked police vehicle.

C (Victim), who was 18 at trial, and 17 years of age at the time of the alleged offending, travelled from Australia with her mother (“CM”) to visit her family in Savusavu during the Easter school vacation in 2025.

In the early evening of 12 April 2025, C went into town with her uncle, her cousin, and her half-sister. They had a few drinks at a nightclub. Sometime later, they were approached by the accused and asked for identification. C got scared and ran away. She became exhausted and rested at a compound beside the road.

The accused found her there, and she got into the back seat of their police vehicle. Rather than take her home, as she requested, they took her to a secluded area and had s*x with her on the back seat of their vehicle without her consent, one after the other. The 1st accused went first, followed by the 2nd accused.

After the r**es, the accused drove C home. CM (Victims Mother) thanked the officers for bringing her home safely as her family had started to worry about her.

The following morning, C told her cousin what the accused had done to her, and they went to inform their aunty. A report was made to the police. C was medically examined.

C (Victim) testified that after a couple of hours dancing and drinking in the "House of Yes" nightclub, she went to a nearby park with her cousin Lina. She becomes emotional after drinking alcohol and was crying. After a while, a police car came to the park. One of the officers asked her how old she was and took a photograph of her. She got really scared and ran away in the direction of home. She got very tired and felt weak, so she stopped in front of a yard to catch her breath.

As she was resting, a Fijian boy approached her and asked whether she was okay. She told him that she was thirsty, and he gave her water from the garden hose. He helped her to stand, and she asked him to walk her home. She did not have any bad intuitional feeling about that boy, and felt she could trust him. He agreed to walk her home but, after a short distance, a police car stopped in front of them. An officer got out of the front passenger seat and told the boy that they had her, and would take her home. She recognised the police officers from earlier at the park. The officer opened the back passenger door and she got into the police car. She got in willingly as the officers were in uniform. She trusted them to take her home. They asked where she lived and she told them.

She had no idea where she was driven. The car stopped and she could not see any lights or any buildings. The officer got out from the passenger seat and opened the back passenger door. He pushed her down across the back seat, pulled her pants to the side, and put his p***s in her va**na. She could not believe it and thought it was a bad dream. When she realised it was actually happening, she kept praying that this was not how she would die. The officer did not say anything as he did that to her. Before, during, and after he penetrated her, she repeated in the Savusavu dialect that she wanted to go home: “Au ba teil ahi vale”.

After about five minutes, the driver came and put his p***s in her va**na. He penetrated her for about five minutes.

She did not scream when the officers did that to her because she was scared. She thought they would kill her and throw her in a ditch after what they did.

C said that she never gave consent for the officers to have s*xual in*******se with her. There was no conversation about consent.

After she was r**ed, she begged to be taken home. She told them she wanted to see her mum. When they reached home, her mum was standing at the front of the house and was angry. She ran to her mum, crying. She wanted to give her mum a hug, but her mum pushed her away and told her to go to the bedroom.

The next morning, she told Lina what had happened. Lina said that she should tell her Na Levu – her mum’s elder sister. She replied that no one would believe her as it sounded so unreal. Lina responded that her aunty would know what to do.

That afternoon, she told her aunty that both police officers had r**ed her. Her aunty was so angry and did not believe her at first. She made her swear on her grandmother’s life.

They walked to the police station together, and her aunty insisted on seeing the senior officer, but he was at a Palm Sunday service. They went to the hospital, where a r**e kit was done.

In court, C agreed that she drank tribe and Fiji Bitter that evening. She ran away from the police after they took her photograph because she did not want to get into trouble for being underage. She was feeling unstable as she was intoxicated. C could not recall whether the police told her that her uncle was looking for her when she got into the police car. She did not accept that she lay on the back seat and put both feet on the left side window. The 1st accused did not go to the back seat to tell her to sit properly and put on her seat belt.

Conclusion

Both accused are found guilty as charged and convicted accordingly.
