On the morning of this client’s 7:40 a.m. U.S. citizenship interview. I called him to see if he was on his way to USCIS. We were preparing for what was already a difficult case. The client, sounding worried on the call, told me he had ‘something important’ to share with me. My heart sank. That’s never what a lawyer wants to hear right before a trial or representation.
While we were seated in the adjudications waiting area, he revealed new information: he had a tax debt and payments he had been making to the IRS were being rerouted to a scam company that had popped up when he was on the IRS website. He had found a letter stating he was in default of his IRS payment plan, late the night before the interview. This made it clear his case was at risk of being denied. This was in addition to three other major issues we already had to grapple with.
When I explained the gravity of the situation to him, the client understandably panicked and suggested we leave and try to reschedule the interview. I refused and told him the case was salvageable. Instead of walking away, we faced the challenge head-on. I took quick notes, came up with a strategy, and presented our case properly before the officer. I ensured everything was handled in full compliance of the law.
After the interview, we worked with our client to resolve the issue and presented the resolution to USCIS. The case got approved this week! The client is in COMPLETE DISBELIEF.
