President Donald Trump signed a presidential memorandum titled “Expanding Migrant Operations Center at Naval Station Guantánamo Bay to Full Capacity.”

✅ Guantánamo Bay, a U.S. military base in southeastern Cuba, houses a detention camp primarily holding terrorism suspects captured after the 9/11 attacks, many of whom have been held for years without trial. Under this order, up to 30,000 “high-priority” undocumented immigrants with criminal records will also be detained there.

✅ The first group of detainees, around 10 individuals with criminal records, was transferred to Guantánamo Bay on February 4, 2025, with more expected to follow.

✅ However, a federal court yesterday 02/09/25 blocked the transfer of three Venezuelan immigrants from New Mexico to Guantánamo Bay, citing legal concerns over due process and access to legal counsel.

On January 22, 2025, the Trump administration halted funding for legal aid programs that help immigrants in immigration court and federal detention centers.

These federal programs provide legal support to migrants who are detained or in the process of being detained, helping them understand what to expect during court proceedings, navigate necessary paperwork, and find counsel where possible. This sudden decision left many without crucial support.

In response, nonprofit organizations filed a lawsuit challenging the move. Just two days later, the U.S. Department of Justice (DOJ) reversed the order, temporarily reinstating the programs. This allows them to continue assisting immigrants while the case proceeds.

On the morning of this client’s 7:40 a.m. U.S. citizenship interview. I called him to see if he was on his way to USCIS. We were preparing for what was already a difficult case. The client, sounding worried on the call, told me he had ‘something important’ to share with me. My heart sank. That’s never what a lawyer wants to hear right before a trial or representation.

While we were seated in the adjudications waiting area, he revealed new information: he had a tax debt and payments he had been making to the IRS were being rerouted to a scam company that had popped up when he was on the IRS website. He had found a letter stating he was in default of his IRS payment plan, late the night before the interview. This made it clear his case was at risk of being denied. This was in addition to three other major issues we already had to grapple with.

When I explained the gravity of the situation to him, the client understandably panicked and suggested we leave and try to reschedule the interview. I refused and told him the case was salvageable. Instead of walking away, we faced the challenge head-on. I took quick notes, came up with a strategy, and presented our case properly before the officer. I ensured everything was handled in full compliance of the law.

After the interview, we worked with our client to resolve the issue and presented the resolution to USCIS. The case got approved this week! The client is in COMPLETE DISBELIEF.
This is exactly why having an effective and quick-thinking attorney by your side is crucial. In high-pressure situations like this, you need someone who can think on their feet, adapt quickly, and find solutions within the law – even at the last minute.

This was a tough case, but it’s moments like these that make all the effort worthwhile. Another success story, and another client who can now move forward with their American dream!

The Executive Office for Immigration Review (EOIR) is an office within the Department of Justice that oversees immigration courts and conducts immigration proceedings.

EOIR has updated its Operating Policies and Procedures Memorandum (OPPM) to confirm that DHS is allowed to make arrests in or near courthouses.

Previously, there were concerns that DHS enforcement near courthouses could discourage immigrants from attending their hearings. However, the updated policy suggests that if non-citizens have valid claims to immigration status, they should not fear going to court.

On January 29, 2025, President Trump signed his first law, the Laken Riley Act. This law says that undocumented immigrants accused of certain crimes to be detained by federal authorities and not released while their case is pending.

The crimes covered under this law include:
❌ Theft
❌ Burglary
❌ Assaulting a law enforcement officer
❌ Larceny
❌ Shoplifting
❌ Any crime that causes death or serious bodily injury

This means that if an undocumented person is accused or charged with one of these crimes, they will be held in custody and cannot be released while their case is still ongoing. It does not matter if they are guilty or not—just being accused is enough for them to be detained.

⚠️ Important Reminder:
• You do not have to be convicted for this law to apply—just being charged is enough.
• If you are undocumented, avoiding any legal trouble is extremely important to prevent detention.
• If you have concerns, talk to an immigration attorney for guidance.

If law enforcement, including ICE, comes to your home and knocks on your door:

a. You have the right NOT to open the door.
b. Ask for a judicial warrant: Request that they slide it under the door. Verify it includes the correct address, a valid date, and a judge’s signature.
c. Administrative Warrants: ICE warrants (e.g., Form 1-205) are not signed by a judge and do not authorize home entry without your consent.
d. Remain Silent: Even with a warrant, you are not obligated to answer questions.

Big Breaking News!

The Laken Riley Act, signed into law by President Trump today, January 29, 2025, mandates the detention of undocumented immigrants accused of crimes such as burglary and theft.

The law is named after Laken Riley, a Georgia nursing student who was tragically killed by an undocumented immigrant who entered the US illegally and was charged with shoplifting in New York in the past.

The Act also empowers state attorneys general to sue the Department of Homeland Security if immigration laws are not adequately enforced.

According to NBC News, ICE has been directed to ramp up enforcement efforts, with agents from multiple federal agencies deploying to three cities per week for large-scale operations. Acting ICE Director Caleb Vitello set a daily arrest target of 1,200 to 1,500, which some view as a goal while others see it as a strict quota.

As a result, more migrants without criminal records are being detained, with nearly half of Sunday’s 1,200 arrests classified as “collateral arrests,” according to a senior Trump administration official.
