NEWS | U.S. Ends TPS for Haitian Immigrants. Beneficiaries Must Prepare to Leave by February 2026

The Department of Homeland Security (DHS) announced on November 26, 2025, that it is terminating the Temporary Protected Status (TPS) designation for Haiti, effective February 3, 2026. 

Under the decision, roughly 353,000 Haitian nationals living in the United States under TPS will lose their protected status. Their work-authorization and immunity from deportation will end when TPS expires at 11:59 p.m. local time on February 3. 

In its Federal Register notice, DHS under Secretary Kristi Noem declared that Haiti no longer meets the statutory conditions required for TPS. The agency stated that returning Haitian nationals can now return safely, and that extending TPS would be “contrary to the national interest of the United States.” 

Haiti’s TPS designation dates back to a 2010 decision in the wake of a catastrophic earthquake. Since then, the status has been periodically renewed due to recurrent crises, including natural disasters, political instability, and security breakdowns.  In June 2024, the previous administration extended Haiti’s TPS through February 3, 2026. 

Earlier this year, DHS attempted to shorten the protection period, a move that was blocked by a federal court in July due to procedural problems. But the agency says this new termination supersedes all prior decisions. 

In the meantime, communities, employers, and local governments where large numbers of Haitian immigrants live are bracing for substantial disruption in the months ahead.
