Haq Insaaf Council Criticizes De●tention of MLA Mehraj Malik, Raises Concerns Over Governance in J&K

The Haq Insaaf Council, led by Advocate Zeshan Syed, has strongly criticized the de●tention of elected legislator Mehraj Malik under the Public Safety Act (PSA) of 1978. The law, originally introduced to tackle timber smuggling, has often faced criticism for its application beyond its intended scope.

According to the Council, the de●tention of a sitting legislator represents a serious setback for democratic processes in the Union Territory of Jammu and Kashmir. The detention order was issued by Deputy Commissioner Doda, Harvinder Singh (IAS), an officer against whom the MLA had earlier raised allegations of irregularities. The Council stated that this development raises concerns about possible misuse of authority and highlights the lack of safeguards for elected representatives.

It further noted that the Deputy Commissioner has formally communicated the de●tention to the Jammu and Kashmir Legislative Assembly, a move that underscores the growing tension between the executive and legislative wings of governance in the region.

The Haq Insaaf Council also expressed concern over what it described as a governance vacuum. Despite the Assembly being in place for over ten months, the administration has not yet issued the “Rules of Procedure and Conduct of Business,” a key framework that allows the legislature to function independently and effectively. Without these rules, the Council argued, the Assembly cannot exercise its full role in holding the administration accountable.

The Council has urged authorities to revoke the de●tention order, initiate an impartial inquiry into the matter, and expedite the framing of Assembly rules. It also called for safeguards to ensure that preventive detention laws are not used in ways that could undermine democratic institutions.

Appealing to the Lieutenant Governor, the Union Home Ministry, and the judiciary, the Council sought intervention to restore faith in constitutional processes and to ensure that governance in the Union Territory remains transparent, accountable, and democratic.
