Netflix has released their guidelines and categories of risk for using GenAI in production. Here's a summary:

1. Previsuals, mood boards, or non-deliverable GenAI content is OK
2. Do not use GenAI to copy other people's IP
3. Do not use GenAI to train on IP or data that belongs to Netflix
4. GenAI media included in deliverables needs legal approval before being released; background replacements may be OK without explicit legal oversight
5. Do not use GenAI to alter, replicate, or replace union actors or crews without consent; union regulations must be followed when utilizing GenAI in a performance or scene
6. Essentially ask for permission rather than ask for forgiveness from lawyers

We have already seen social media flooded with GenAI articles, images, AI powered bots harnessing clicks or posting misinformation, and sharing plenty of miscellaneous AI slop. Now GenAI content is being used in UGC, feature films, episodic TV, and verticals.

It will only be a matter of time when someone will be blindsided by lawsuits while using GenAI irresponsibly. It is in the best interests of producers, studios, production companies, agencies, and creators to have some guidance as we continue to adopt AI programs into our workflows. This is a start.
