Supreme Court Makes RTE Admissions Mandatory, Calls It a “National Mission”

In a significant ruling, the Supreme Court of India has reaffirmed that admissions under the Right to Education Act are mandatory for all neighbourhood schools, including private unaided institutions. The Court described the implementation of the Act as a “national mission,” stressing that it is central to ensuring equitable access to education for children from weaker and disadvantaged sections of society.

A bench comprising Justice PS Narasimha and Justice Alok Aradhe held that denying admission to eligible students violates their fundamental right to education under Article 21A of the Constitution of India. The Court emphasised that the 25% reservation mandated under the RTE framework has the potential to reshape the social fabric by promoting inclusivity and equal opportunity in education.

Dismissing an appeal filed by a Lucknow-based private school, the apex court made it clear that institutions cannot question or override the eligibility decisions made by government authorities. Once a list of selected students is forwarded by the state, schools are legally bound to grant admission without delay. The Court warned that any obstruction or refusal would defeat the very purpose of the law and render the constitutional promise of free and compulsory education meaningless.

The judgment reinforces the accountability of schools in upholding children’s rights and highlights the need for strict and effective implementation of the RTE Act across the country.
