🚫📡 New Rules to Stop Illegal Sale of Radio Devices Like Walkie Talkies on E-Commerce Platforms

On 27 May 2025, the Central Consumer Protection Authority (CCPA) released a fresh set of guidelines to stop illegal listing and selling of radio equipment (like walkie-talkies, mobile boosters, jammers etc.) on online marketplaces.

These new "Guidelines for Prevention and Regulation of Illegal Listing and Sale of Radio Equipment, 2025" aim to make sure that sellers and e-commerce platforms follow the existing telecom rules, especially those set by the Wireless Planning and Coordination (WPC) wing of the Department of Telecommunications (DoT).

Let’s break it down in simple terms:

🔍 What Do Sellers and Platforms Need to Follow?
Online platforms like Amazon, Flipkart, etc. can’t allow:

📌 Sale of radio equipment that requires DoT frequency assignment

📌 Devices like mobile signal boosters, wireless jammers

📌 Any radio device not approved by Saral Sanchar portal dealers

Only sellers who have proper Dealer Possession Authorisation (DPA) from DoT and are listed on Saral Sanchar are allowed to sell these devices.

📝 Product Listing ke Rules (Kya dikhana zaroori hai?)
When such products are listed, the seller must:

📌Show exact operating frequency range

📌Attach Equipment Type Approval (ETA) certificate from DoT

📌Upload a valid test report from a certified lab

Here’s what needs to be shown, depending on the device type:

1. Wi-Fi, Bluetooth (Unlicensed frequency):

ETA details mention karo

ETA ka downloadable copy dena hoga

Lab test report bhi attach karo

2. Licensed but license-exempt devices (like radio receivers):

Show relevant DoT/ DGFT notification with number & date

3. Dual-band devices (e.g., mobile phones, PoS machines):

Follow both above sets of rules

Sellers must personally certify:

Device hasn’t been tampered to operate beyond approved limits

Test report is original and unaltered

Agar ye sab info nahi diya gaya, ya galat diya gaya — toh listing turant take down kar di jayegi.

E-commerce platforms will use automated scanning tools (keywords & frequency-based) to detect illegal or non-compliant listings

🧑‍⚖️वकीलों की पेशेवर स्वतंत्रता पर सुप्रीम कोर्ट की सख्ती: पुलिस के समन पर रोक, मामला 🅲🅙🅸 के समक्ष प्रस्तुत

🔥दिनांक 25 जून 2025 को, भारत के माननीय उच्चतम न्यायालय (“सुप्रीम कोर्ट”) की दो सदस्यीय पीठ ने Ashwinkumar Govindbhai Prajapati बनाम गुजरात राज्य व अन्य [1] मामले में एक महत्वपूर्ण आदेश पारित किया, जिसमें पुलिस व जांच एजेंसियों द्वारा वकीलों को समन जारी कर गोपनीय कानूनी परामर्श की जानकारी मांगने की बढ़ती प्रवृत्ति पर संज्ञान लिया गया।

🧾 पृष्ठभूमि:
हाल ही में प्रवर्तन निदेशालय (ED) ने वरिष्ठ अधिवक्ताओं अरविंद दातार और प्रताप वेणुगोपाल को उनके द्वारा एक पेशेवर राय (legal opinion) देने के लिए समन जारी किया था। हालांकि बाद में यह समन वापस ले लिया गया, लेकिन इसने अधिवक्ताओं की स्वतंत्रता और पेशेवर गोपनीयता से जुड़े गंभीर प्रश्नों को जन्म दिया।

🔥एक अन्य मामले में, 24 मार्च 2025 को, गुजरात स्थित एक अधिवक्ता (“याचिकाकर्ता”) को भारतीय नागरिक सुरक्षा संहिता, 2023 (BNSS) की धारा 179 के तहत अहमदाबाद पुलिस द्वारा समन भेजा गया, जिसमें उनसे उनके मुवक्किल से संबंधित एक आपराधिक मामले में उपस्थिति मांगी गई थी। अधिवक्ता ने पुलिस के समक्ष उपस्थित होने के बजाय गुजरात उच्च न्यायालय का रुख किया और यह दलील दी कि वे केवल पेशेवर भूमिका में जुड़े थे और मामला उनसे व्यक्तिगत रूप से संबंधित नहीं था। परंतु, उनकी याचिका को गुजरात उच्च न्यायालय ने खारिज कर दिया। [3]

⚖️ उच्च न्यायालय का निर्णय:
गुजरात उच्च न्यायालय ने कहा कि पुलिस को जांच का अधिकार है और चूंकि समन गवाह के रूप में जारी किया गया था, इसलिए इसे चुनौती देने का कोई वैध आधार नहीं है। इसके पश्चात याचिकाकर्ता ने सुप्रीम कोर्ट में अपील की।

सुनवाई के दौरान सुप्रीम कोर्ट ने निम्नलिखित दो महत्वपूर्ण प्रश्न उठाए:

🎯यदि कोई व्यक्ति केवल वकील के रूप में किसी केस से जुड़ा है, तो क्या उसे जांच एजेंसियां सीधे समन भेज सकती हैं?

🎯यदि मान लिया जाए कि किसी मामले में वकील की भूमिका केवल परामर्श तक सीमित नहीं है, तो भी क्या उसे सीधे समन भेजा जाना चाहिए, या फिर ऐसे मामलों में न्यायिक पर्यवेक्षण (judicial oversight) आवश्यक है?

🏛️ सुप्रीम कोर्ट की टिप्पणियां:
सुप्रीम कोर्ट ने इस मुद्दे को गंभीरता से लेते हुए कहा कि वकीलों को समन भेजने की प्रवृत्ति उनके पेशेवर अधिकारों और न्यायिक स्वतंत्रता को कमजोर करती है। अदालत ने माना कि अधिवक्ता, न्याय व्यवस्था के केंद्र में होते हैं और उन्हें भारतीय साक्ष्य अधिनियम, 2023 (Bharatiya Sakshya Adhiniyam - BSA) की धारा 132 के अंतर्गत कुछ विशेष गोपनीय अधिकार प्राप्त हैं।

धारा 132 अधिवक्ताओं और उनके मुवक्किल के बीच की बातचीत को गोपनीय मानती है और इसे पेशेवर कर्तव्यों के अंतर्गत संरक्षित करती है। याचिकाकर्ता का यह तर्क कि वकील-मुवक्किल के बीच की बातचीत BNSS की धारा 179 के तहत पूछताछ का विषय नहीं हो सकती — को सुप्रीम कोर्ट ने स्वीकार किया।

सुप्रीम कोर्ट ने कहा कि वकीलों को इस प्रकार समन भेजना न केवल अनुचित है, बल्कि इससे वे स्वतंत्र रूप से अपने कर्तव्यों का निर्वहन करने से भी वंचित हो सकते हैं। अतः अहमदाबाद पुलिस को याचिकाकर्ता को समन भेजने से अगली सूचना तक रोक दिया गया है।

📣 विषय को CJI के समक्ष प्रस्तुत किया गया:
इस मुद्दे की व्यापकता को देखते हुए, सुप्रीम कोर्ट ने इसे माननीय मुख्य न्यायाधीश (Chief Justice of India) के समक्ष प्रस्तुत करने का निर्णय लिया। साथ ही, इस मुद्दे पर सहयोग के लिए निम्नलिखित संस्थाओं को नोटिस जारी किए:
