*Jailed MP Er Rashid Granted Custody Parole to Attend Parl With Riders; AIP to Challenge ‘Skewed’ Decision Before Delhi High Court*
Srinagar: A Special National Investigation Agency (NIA) court in New Delhi has granted custody parole to jailed Member of Parliament Engineer Rashid, enabling him to attend the ongoing Monsoon Session of Parliament, albeit with certain riders. The Court on Tuesday announced that the Member Parliament can attend the Parliament from July 27 upto August 04 only, while the session itself concludes on August 21.
The other condition the Member Parliament has been asked to abide by is to pay on his own behalf for the travel expenses to and fro the jail and Parliament House.
Confirming the development to Alfaaz – The Words, Chief Spokesperson Awami Ittihad Party, Inam un Nabi gave a mixed reaction on the decision, even as disclosing that the legal team has decided to move to Delhi High Court to challenge the conditions on the custody parole given to the elected Member Parliament.
“It is a good thing that he (Er Rashid) has been allowed to attend the Parliament, but why is it that the he is being let to attend only from July 27 upto August 04 and not in in full, and that too asked to afford the travel expenses on his own,” Inam said, adding, “this is too harsh and unfortunate.”
“The AIP’s legal team has decided to move to Delhi High Court to challenge the skewed decision of the Special NIA Court,” Inam said.
Explaining further, the party spokesperson said, “It was the same judge who allowed the MP on interim bail, and also granted an extension while he was out for election campaigning during assembly elections in Jammu and Kashmir, now what is it that has compelled the judge to issue a truncated period, while asking him to pay the travel expenses.”
Notably, the order announcing the parole comes after the court had last week reserved its decision for July 21, on a plea filed by Rashid’s legal team. Rashid, who is currently lodged in Delhi’s Tihar Jail, is under judicial custody in a case registered under the Unlawful Activities (Prevention) Act (UAPA) linked to alleged militants funding.
Despite being incarcerated since 2019, Engineer Rashid won the Baramulla Lok Sabha seat in the 2024 general elections as an independent candidate, defeating high-profile opponents including incumbent J&K CM Omar Abdullah and JKPC Chairman Sajad Gani Lone.
