വാഹനാപകടങ്ങൾ കേസ് എങ്ങനെ?
1. വണ്ടിയുടെ ഇൻഷുറൻസ്‌ OK ആണെങ്കിൽ ഒരു സെറ്റിൽമെന്റിനും ശ്രമിക്കേണ്ടതില്ല, പരിക്കേറ്റ ആളെ ആശുപത്രിയിൽ എത്തിക്കുക, പോലീസ് സ്റ്റേഷനിൽ (ഫോൺ വിളിച്ചോ മറ്റോ) അറിയിക്കുക.
2. നാട്ടുകാരും, പരിക്കേറ്റ ആൾക്ക്‌ പരിചയക്കാരുണ്ടെങ്കിൽ അവരും നിങ്ങളെ സമ്മർദ്ധത്തിലാക്കാൻ നോക്കും. ഒരു കാരണവശാലും പണം നൽകിയുള്ള ഒത്തുതീർപ്പിനു വഴങ്ങേണ്ടതില്ല.
3. പരാതിയില്ല എന്ന് എഴുതി വാങ്ങിയാലും പരാതിക്കാരനു കേസിനു പോകാൻ പറ്റും. ഫ്രാക്ചർ ഉണ്ടായാൽ അയാളെ ഏതെങ്കിലും വക്കീൽ ക്യാൻവാസ്‌ ചെയ്യും. ഫ്രാക്ചർ ഉണ്ടാകുമ്പോൾ ഗ്രീവിയസ്‌ ഹർട്ട്‌ ആയി പരിഗണിക്കും, നഷ്ടപരിഹാരത്തുക കിട്ടുകയും ചെയ്യും.
4. ഡ്രെസ്സിംഗ്‌ മാത്രം വേണ്ട മുറിവും, ചെറിയ സ്റ്റിച്ച്‌ ഇടാനും ഒക്കെ ഉള്ള പരിക്കേ ഉള്ളെങ്കിൽ മാനുഷിക പരിഗണന വെച്ചും, നിങ്ങളുടെ സാമ്പത്തിക ശേഷി അനുസരിച്ചും വേണമെങ്കിൽ ചെറിയ തുക ആശുപത്രി ബിൽ അടയ്ക്കാം. (1000, 2000, 3000 ഒക്കെ ആണെങ്കിൽ).

7. ഒരു വ്യെക്തിയേ ഇടിച്ചതിനു പകരം ഒരു ഇലക്ട്രിക്‌ പോസ്റ്റ്‌/ ട്രാൻസ്ഫോർമ്മറിൽ ഇടിച്ചെന്ന് കരുതുക. കെ.എസ്.ഇ.ബി യും പോലീസും കൂടി നിങ്ങളെ സമ്മർദ്ധത്തിലാക്കും നഷ്ടപരിഹാരം പണമായി അടയ്ക്കാൻ പറഞ്ഞ്‌. അടച്ചില്ലെങ്കിൽ കേസ് വരും, റവന്യൂ റിക്കവറി വരും എന്നെല്ലാം പറഞ്ഞ്‌ ഭയപ്പെടുത്തും. അടയ്ക്കേണ്ടതില്ല, കേസ് കൊടുത്തോളാൻ പറയുക, പൈസ കയ്യിൽ ഇല്ലെന്നും അറിയിക്കുക.

How are vehicle accident cases handled?
1. If the vehicle’s insurance is valid, you don’t need to attempt any settlement. Take the injured person to the hospital and inform the police station (either by phone or otherwise).
2. Locals, and if the injured person has acquaintances around, they may try to pressure you. Under no circumstances should you agree to a monetary settlement.
3. Even if you get a written statement saying “no complaint,” the injured party can still proceed with a case. If there is a fracture, a lawyer will definitely canvas the case. A fracture is considered grievous hurt, and compensation will be awarded.
4. If the injuries are only minor — requiring just dressing, or maybe a few stitches — then out of humanitarian consideration, and according to your financial capacity, you may contribute a small amount to cover the hospital bill (₹1,000, ₹2,000, ₹3, etc.).
5. If the injured person files a case, they won’t have to pay lawyer’s fees upfront. In the current practice, the lawyer’s fee is a percentage of the claim settlement amount. Therefore, the lawyer will try to secure the maximum possible insurance claim. Beforehand, you must make a clear agreement with the lawyer on what that percentage will be.
6. The case against you will be for rash & negligent driving. In court, by paying the fine and admitting guilt, the driver’s case will be closed. The remaining matter will be handled by the insurance company. For that, the company will arrange its own lawyer.
7. Suppose instead of hitting a person, you hit an electric post/transformer. Then KSEB (Kerala State Electricity Board) along with the police will pressure you to pay compensation in cash. They may threaten that if you don’t pay, there will be a case, and even revenue recovery. Do not pay. Tell them to go ahead with the case, and inform them you don’t have the money in hand.
