*Minor Drowns to Death After Falling into Pit in Sulkoot Kupwara*

Srinagar, Oct 19 (GNS): A 6-year-old boy drowned to death after falling into a water-filled pit in Sulkoot in north Kashmir’s Kupwara district on Tuesday evening.

Reports reaching GNS said that Mohammad Musa, 5, son of Abdul Qayoom Payer was playing with children near an under construction building of Womens Degree College Salkote, when the incident occurred. The child was evacuated by Fire and Emergency Services Department and rushed to nearby hospital, where the doctors however declared him as brought dead on arrival.

Meanwhile a police official has confirmed to GNS about the occurrence of the incident. (GNS)

Higher qualification may not be suitable qualification for every post: DB

JAMMU: A Division Bench (DB) of Jammu & Kashmir High Court comprising Chief Justice Pankaj Mithal and Justice Rajnesh Oswal holds that higher qualification may not be suitable qualification for every post and, if candidates with higher qualifications are excluded, the action on the part of the employer in this regard cannot be faulted with and said to be unfair or arbitrary.

While upholding the order of Central Administrative Tribunal, Division Bench dismissed the petition filed by 348 persons.

In all, 348 persons have invoked the extraordinary jurisdiction of this Court to challenge the order dated August 6, 2021 passed by the Central Administrative Tribunal, Jammu Bench, Jammu (for short ‘the Tribunal’) in Original Application no. 1107 of 2021 titled Rohit Chib and others v/s Service Selection Board, J&K UT.

The aforesaid order of the Tribunal is an interlocutory order by which the Original Application of the petitioners has been entertained but they have been denied interim order as prayed for on the ground that the grant of the same would amount to granting the final relief which is not permissible in law.

DB observed that the short controversy which actually arises in the original application or as a matter of fact in the writ petition is as to whether petitioners are entitled to grant of interim protection pending the original application which is dependent upon the eligibility of the petitioners to participate in the selection for the post of Class-IV employees in the various departments of the Union Territory of Jammu and Kashmir. If the petitioners are not qualified and eligible to participate in the selection process, obviously, they are not entitled to any interim protection.

The Advertisement No.1 of 2020 dated June 26, 2020 invited applications for appointment on 8575 employees on Class-IV posts with one of the conditions that the minimum and maximum qualification for appointment to Class-IV posts under direct recruitment shall be “minimum matric and maximum 10+2” with the further condition that any candidate having qualification other than prescribed shall not be eligible for Class-IV post.
The petitioners are candidates who are graduates or possessing even higher qualification and, as such, have been denied participation in the selection process.

DB observed that it is well settled and recognized that appointments on public posts have to be made strictly in accordance with the Rules of service or the terms and conditions of the advertisement.
In Yogesh Kumar v/s Government of NCT of Delhi, it has been clearly held by the Supreme Court that recruitment to public service should be held strictly in accordance with the terms and conditions of the advertisement and the recruitment Rules, if any.

Any deviation from the Rules or the terms of the advertisement amounts to allowing ineligible persons and depriving right of consideration of many deserving eligible candidates.

Division Bench after hearing Sr. Adv Sunil Sethi with Adv Parimoksh Seth for the petitioners whereas Advocate General DC Raina appeared for the UT observed that the appointment to Class-IV posts in Jammu and Kashmir Public Service has to be in accordance with the Jammu and Kashmir Appointment to Class-IV (Special Recruitment) Rules, 2020 as promulgated vide S.O. 184 dated June 4, 2020 issued in exercise of powers under Article 309 of the Constitution of India.

These Rules specifically provide that the Board i.e Jammu and Kashmir Services Selection Board shall invite applications from the persons who are domiciled in the Union Territory of Jammu and Kashmir and who possess minimum and maximum educational qualification as prescribed in notification SRO 99 of 2008 dated April 7, 2008.
DB further observed that the SRO 99 of 2008 categorically lays down that for the purposes of recruitment of Class-IV posts, the minimum and maximum qualification shall be matric and 10+2, respectively and the advertisement also specifically provides that in accordance with the above Rules and the SRO 99 of 2008, the maximum and minimum qualification for appointment to Class-IV posts through direct recruitment shall be “minimum matric and maximum 10+2” with the further rider that any candidate having qualification other than prescribed shall not be eligible for Class-IV post.

It may be noted as the appointment to such posts has to be on the basis of the suitability vis-a-vis the qualification held by the person and the nature of the job, for which purpose the decision of the employer is final provided it is not arbitrary in nature. In other words, the suitability and the qualifications for any post have to be laid down by the employer and the same are not liable to be interfered with judicially, until and unless the policy decision in that regard is found to be irrational or arbitrary. In the case of appointments to Class-IV posts, higher qualification than 10+2 may not be a suitable for many reasons; the first being that a highly qualified person may not be in a position to discharge the menial work which is required to be done by Class-IV employee; secondly, if such highly qualified candidates are allowed to compete with candidates with lower qualification as prescribed, it is but obvious that they will score above them and would get selected to the detriment of the candidates possessing the requisite eligibility; and thirdly, such candidates of higher qualification, if selected, would always be looking for a better job and, as soon as they are selected in some other better discipline, they would leave the Class-IV post rendering the entire selection as useless forcing the employer to get those posts re-advertised and re-filled.
DB said that the laying down of the criteria of the minimum and the maximum qualification for the Class-IV post as matric and 10+2 respectively is neither irrational, unreasonable nor arbitrary.

With these observations, Division Bench observed that in view of the law as discussed, this Court is of the opinion that the Tribunal is justified in refusing interim protection to the petitioners at the interim stage of the original application. With these observations, Division Bench dismissed the petitions with the request to the Tribunal to dispose of all original applications on the subject in the light of the observations and the law as discussed above.

*High alert in Kashmir, intel warns of attacks on power projects, emergency landing strip*

Security has been beefed up around the Uri-I and Uri-II hydro-power projects, which are close to the LoC.

A high alert has been sounded in Kashmir following intelligence inputs that a new militant group, Harkat 313, has been tasked to launch attacks on government infrastructure, including hydel power plants of Uri-I and Uri-II.

According to inputs, militants are also likely to target the emergency landing strip in Anantnag. Another alert has been issued saying Hizbul Mujahideen is planning to target religious leaders to create a major law and order situation in the valley.

Inputs have also been received of terror outfits Lashkar-e-Taiba (LeT) and The Resistance Front (TRF) planning to attack sarpanches and non-local people in Kashmir.

The alerts come amid a spate of attacks on non-local workers in J&K. This month, 11 people have lost their lives in shootings targeting civilians.

On Sunday, militants shot dead two workers from Bihar and injured another in Kulgam in South Kashmir. The deceased have been identified as Raja Reshi Dev and Joginder Reshi Dev. GANDERBAL, OCTOBER 17: Lieutenant Governor, Manoj Sinha today visited Ganderbal and reviewed the developmental scenario in the district. He took detailed assessment of the status of implementation of various central and UT government schemes, besides assessing the performance metrics of different departments.

Taking note of the overwhelming progress made in the implementation of various social sector schemes, he complimented the Deputy Commissioner, Ms Krittika Jyotsana & her team and directed for 100% saturation of various initiatives and measures taken by the Government so that maximum benefits percolate to the deserving and needy.

The Lt Governor directed all the concerned departments to redouble their efforts and strive for saturation of all Central and UT level social security and welfare schemes, adding that these schemes are launched with the purpose to improve socio-economic condition of the people.

Observing that the infrastructure projects are being completed at a remarkably brisk pace, the Lt Governor instructed officials for furthering pro-active and people-centric governance to bring about a qualitative improvement in the quality of life, and ease of living of people.

“Timely implementation is the key to sustainable development. No delay will be acceptable”, he added.

Two senior officials of the Jal Shakti Department, Superintending Engineer, and Technical officer were attached for unwarranted delay in implementation of various projects.

On the occasion, the Lt Governor passed explicit directions to the district administration to identify minimum five Youth from each panchayat of the district who need assistance for starting their own ventures. He directed for sustained handholding of such budding entrepreneurs by way of enhancing their technical know-how, skilling, and financial assistance.

The Lt Governor said that there is no dearth of funds and government is committed to provide all support to the Youths who want to realize their dreams.

Earlier, Deputy Commissioner, Ganderbal gave a brief overview of the developmental activities and department-wise achievements under District Capex, Languishing projects, and Back to Village program in the district through a PowerPoint presentation.

She also briefed the chair on the health sector profile, Jal Jeevan mission's achievements and future roadmap, assets of Power Sector, and winter preparation efforts.

While taking stock of the status of projects under Capex, Languishing, and B2V program, the Lt Governor emphasized on speedy ex*****on and timely completion of all remaining projects. The Lt Governor directed for 100% physical verification of works.

Enquiring about timelines for the completion of power projects of transmission and distribution augmentation, the Lt Governor directed for maintaining sufficient stock of transformers and instructed the concerned officials to reduce the AT&T losses by 15% in three months.

Reviewing the work done by Public Works Department, the Lt Governor directed its functionaries to pay focused attention on preventing the damage to the roads in winters. He asked him to make an advance plan for macadamisation of roads.

The Lt Governor took a comprehensive review of the implementation and progress of various Centrally sponsored and UT Government’s schemes and programmes like Mission Youth, MUDRA, MUMKIN, SAKSHAM, TEJASWANI, Youth Clubs, PMAY, MGNREGA, SBM, Pradhan Mantri Ujwala Yojana, NRLM, besides other Beneficiary Oriented Schemes like PMKISAN, Ayushman Bharat and others.

Reviewing various developmental activities going on in the district and status of welfare schemes of different departments, the Lt Governor directed the concerned officers to reach out to maximum target population with its awareness activities in all parts of Ganderbal.

Taking review of the departments of Fisheries, Sheep and Animal husbandry, the Lt Governor directed the concerned to capture the district’s market demand by reducing import and becoming self-sufficient in meat and egg production. Adopt outcome-based approach to take the sector to new heights, he said.

The Lt Governor also reviewed Irrigation and Flood control department, Youth services and sports, and progress of PMGSY and various other welfare schemes including PMAY, AAY besides others.

Later, the Lt Governor also interacted with the DDC Chairperson and members, representatives of PRIs, ULBs and received their valuable suggestions. Political leaders also presented their views and suggestions on various issues of public importance.

The Lt Governor said that the UT Government is committed to further strengthen the PRI institutions. He urged them to monitor the implementation of projects kept in the plans made by their active involvement for holistic development of their respective areas.

The Lt Governor heard all the issues and demands put forth and said that necessary steps will be taken for their redressal.

Srinagar, Oct 17 (KNO): Inspector General of Police (IGP) Kashmir Vijay Kumar Sunday strongly rebutted the order asking non-local labourers to reach police stations and army camps terming it as “totally baseless and fake order.”

“There is no such order. It’s a fake one,” the IGP Kashmir told the news agency—Kashmir News Observer (KNO). *Amid Covid threat, Admin to take innovative steps to facilitate devotees on Eid-Milad-Un-Nabi: Advisor Khan*

Srinagar, Oct 13 (KNO): In the wake of covid-19 pandemic, the administration has decided to take innovative steps assisted by technology to facilitate devotees on the eve of upcoming Eid-Milad-Un-Nabi celebrations.

The decisions were taken today in a high level meeting taken by Advisor to Lieutenant Governor, Farooq Khan with both civil and police establishments of J&K.

The meeting was attended by divisional and district administration from both civil and police departments. Outside Srinagar based officers participated in the meeting through video conferencing.

The Advisor emphasised on adherence to all the Covid protocols besides observance of Covid Appropriate Behavior. He also said that administration would take all the innovative steps assisted by technology to facilitate the devotees observe the holy event with religious fervour.

Khan also advised the officers not to repeat only yearly arrangements but take all steps necessary after taking assessments on spot. He asked them to make these shrines plastic free for this happens to be a major pollutant around these holy places. He exhorted upon the municipal bodies to install mobile toilets at each of these shrines and replace them timely after every few hours to avoid stink.

The Advisor further impressed upon the civil administration to make all the arrangements for round the clock sanitation, water and electricity. He urged them to make alternative arrangements of each utility at such places where religious congregations are traditionally held. He asked the concerned department to ensure uninterrupted power supply to shrines where the night events are held.

Khan asked the police administration to make fool proof security arrangements for the safety of people. He asked them to put additional traffic personnel into service to manage traffic professionally on the specific days. He enjoined upon the Deputy Commissioners and District SPs to visit the shrines themselves to take stock of all the arrangements before the day of this festival.

The Advisor asked the enforcement agencies to ensure that no unhygienic eatables or provisions are sold in the markets around these shrines putting the health of people at risk. He implored upon them to take legal action against all the violators of law instead of just fining them for their misdeeds.

The Divisional Commissioners informed the meeting that they already held meetings at their level to give final shape to the arrangements. They gave out that all the required arrangements have been finalized for celebration of the Milad smoothly observing both covid protocols and CAB.

They further revealed that health and sanitary teams would be available at all those shrines celebrating the event. It was said that covid vaccination, testing and thermal instruments would be available at all such places. It was also made out that masks and sanitizers would also be readily available at these shrines.

The Deputy Commissioners assured the meeting that the availability of ration, fuel and other arrangements had already been ensured at these places. Besides they informed that facilities of transportation and other civic amenities has also been finalized with the respective line departments in each district.

Pertinent to mention here that the festival would be celebrated on 19th of this month across J&K and major congregations are to be held at Dargah Hazratbal (Srinagar), Kabamarg (Anantnag), Khiram (Anantnag), Aham Sharif (Bandipora) and other major shrines across the UT—(KNO)
