Buying land is not just about doing a search at the registry.
We have seen cases where someone buys land with a “clean” title, only to find later that another person also has an original title for the same land. How? Because green cards can be swapped, and names can appear correct at the time of the search.
Many times, sellers push buyers with urgency “this land has many buyers.” That pressure is a trick.
As my professor used to say, “Kuna mlevi anajua kila kitu huko ground.” Meaning, the people on the ground often know more about the land than the official records.
That is why due diligence is more than a search. It is a careful investigation of the land’s past, its records, and its true position on the ground.
