If kenyans want free and fair elections and avoid any potential violence in 2027...they must push IEBC to do away with NATIONAL TALLYING centre for presidential results...Article 138 ( 2), says..." If two or more candidates for president are nominated, an election shall be held in EACH CONSTITUENCY".....this means each constituency should hold presidential election and announce its results as FINAL. This decision was even reinforced by maina kiai case in 2017 when it said, results from poling stations (34As) are final..therefore, returning officers at the constituency should just announce form 34B( collation of 34As) as FINAL.....the idea that IEBC chairman is the returning officer of presidential election and that we should have a tallying centre at BOMAS is totally misleading...after voting and tallying at polling stations, the person who becomes the custodian of the ballots is the constituency returning officer,...this is the person who is incharge of tallying and verification of the ballots, and then RETURNS the results to the people, hence the name returning officer...,at bomas IEBC chairman is not the custodian of the ballots (results)...what is he returning?...the work of the IEBC chairman is to declare the result....ie announce the winner...Each constiituency should announce its presidential results as final immediately after tallying. Then the commision collates the 290 constituencies, determines 50% plus 1, and the county threshold...then give it to the IEBC chairman to DECLARE the result....either a winner or a run off...if a presudential candidate has an issue with the results, they easily redflag a particular constituency and even stations where rigging happened..and easily prove it in supreme court.
This time round there will be nothing but taking this Ruto home
