#: LENIENCY UNDER LAW ON COMPETITION

On May 3, 2024, the Ministry of Commerce issued Decision No. 107 on the Requirements and Procedures on Leniency under the Law on Competition to implement the Law on Competition in respect of exemption and leniency provisions related to the unlawful horizontal agreement that prevents, restricts, or distorts the competition. After issuing this Decision, the other decisions or regulations for implementing the other unlawful agreement and activities should be issued in the nearest future by the competent institution(s).

This update focuses only on the eligibility of leniency for unlawful horizontal agreement.

#ការពិន័យចំពោះការប្រកបអាជីវកម្មអភិវឌ្ឍន៍ដីឡូតិ៍ដោយគ្មានអាជ្ញាបណ្ណ

និយ័តករអាជីវកម្មអចលនវត្ថុនិងបញ្ចាំ (“ន.អ.ប.”) បានកោះអញ្ជើញ សហគ្រាស បាត់ដំបង ហ្រ្គីន រេស៊ីដេន គម្រោង “ដីឡូរតិ៍វីឡាគ្រីនរេស៊ីដេន” (“សហគ្រាស”) ឱ្យទៅបង់ប្រាក់ផាកពិន័យជូន ន.អ.ប. ចំនួន ៥០.០០០.០០០ (ហាសិបលាន) រៀល ចំពោះការប្រកបអាជីវកម្មអភិវឌ្ឍន៍ដីឡូតិ៍ដោយគ្មានអាជ្ញាបណ្ណពី ន.អ.ប.។

តាមសេចក្ដីជូនដំណឹង ចេញដោយ ន.អ.ប. កាលពីថ្ងៃទី២១ ខែឧសភា កន្លងទៅថ្មីៗនេះ សហគ្រាសត្រូវទៅបង់ប្រាក់ពិន័យក្នុងរយៈពេល ១៥(ដប់ប្រាំ)ថ្ងៃយ៉ាងយូរ គិតចាប់ពីថ្ងៃជូនដំណឹង។ ក្នុងករណីសហគ្រាសនៅតែបន្តគេចវេះមិនបង់ប្រាក់ពិន័យ ន.អ.ប. នឹងចាត់វិធានការតឹងរ៉ឹងទៅតាមផ្លូវច្បាប់។

សេចក្តីជូនដំណឹង ស្តីពីការកោះអញ្ជើញឱ្យបង់ប្រាក់ផាកពិន័យចំពោះការប្រកបអាជីវកម្មអភិវឌ្ឍដីឡូត៍ដោយគ្មានអាជ្ញាបណ្ណ។

#បច្ចុប្បន្នភាពគតិយុត្ត៖ គោលការណ៍អនុគ្រោះក្រោមច្បាប់ស្ដីពីការប្រកួតប្រជែង

កាលពីថ្ងៃទី០៣ ខែឧសភា ឆ្នាំ២០២៤ កន្លងទៅ ក្រសួងពាណិជ្ជកម្មបានចេញសេចក្ដីសម្រេចមួយដើម្បីផ្ដល់គោលការណ៍អនុគ្រោះដល់បុគ្គលដែលចូលរួមក្នុងការព្រមព្រៀងខ្សែដេកបំពានច្បាប់ដែលប៉ះពាល់ដល់ការប្រកួតប្រជែង(បុគ្គលបំពានច្បាប់) ដែលត្រូវបានហាមឃាត់និងផ្ដន្ទាទោសដោយច្បាប់ស្ដីពីការប្រកួតប្រជែង តាមមាត្រា៧និងមាត្រា៣៨។
