NEW JERSEY MENTAL HEALTH CLINICS FOUNDED BY LATE LIBERIAN DEFENDANT AGREE TO FORFEIT $6.4M, MORE

NewJersey authorities have legally seized $6.4 million and other assets from a chain of mental health clinics founded by a recently deceased Liberian presidential candidate for billing Medicaid for more than 10,000 bogus claims.

Daniel E. Cassell, formerly of Perkasie, PA was under a 17-count state indictment when he died of an apparent heart attack at 56 years old on Christmas Day 2022.

The West African-born Cassell — who was a psychologist, business consultant and politician and founding member of Liberia’s People Liberation Party — was the president and chief executive officer of Kwenyan Professional Health Services, based in West Orange, and Ewing-based Kwenyan and Associates.

The companies operated a chain of mental health, behavioral and substance abuse clinics in Essex, Hunterdon, Mercer, Union, and Warren counties, New Jersey Attorney General Matthew Platkin said.

Between January 2015 and October 2020, Cassell and some of his employees submitted more than 10,000 false claims for Medicaid reimbursement to the New Jersey Division of Medical Assistance and Health Services, the attorney general said on Monday, Feb. 12.

In just about all of those, Platkin said, either “no actual services were rendered” or “group therapy services were [provided], but higher-paying individual therapy or family psychotherapy codes were falsely billed.”

Cassell fled to Liberia amid the New Jersey probe, then was arrested on a fugitive warrant in Georgia upon landing at the Hartsfield–Jackson International Airport in Atlanta in March 2022.

A 17-count indictment returned in August of that year charged the father of six with conspiracy, health care claims fraud, Medicaid fraud and money laundering, among other offenses.

His wife, Bindu Coleman Cassell, also was accused of trying to help her husband escape justice.

Cassell — who professed his innocence throughout — was free on bail and running for president of Liberia when he died four months later.

Rather than face prosecution, Cassell’s successors entered into a consent agreement with the state of New Jersey, Platkin said.

They paid a steep price, too, agreeing to forfeit to the state:

15 passenger vans for which authorities said Cassell conspired with others to get lower insurance premiums;

$2,437,546 from financial accounts;

$3,922,532 from the sale of properties in Flemington, West Orange, and Washington Township, New Jersey;

$47,879 in rent on five parcels of real estate.

All come to a combined total of $6,407,958 — but that’s not all.

“The state will be entitled to further proceeds after the sale of other real estate maintained by Cassell and the Kwenyan entities,” Platkin said.

“This was not a small number of illegitimate claims for payment, but rather the systematic submission of false claims — thousands of them — over several years, defrauding taxpayers of millions of dollars,” the attorney general said.

Deputy Attorneys General Vladimir D’Argenio and Charisse M. Penalver prosecuted the case for the Office of the New Jersey Insurance Fraud Prosecutor – Medicaid Fraud Control Unit. Detective Michael Rosati led the investigation.

The civil asset forfeiture proceedings were handled by DAsG Leslie-Ann M. Justus and Laticia M. Wright in OIFP’s Case Screening, Litigation, and Analytical Support Section.

President Weah Issues Executive Order 123 Setting Up Transitional Team

Monrovia, Liberia - The President of the Republic, Dr. George Manneh Weah, has issued Executive Order 123 setting up a Joint Presidential Transitional Team (JPTT) to ensure a smooth transfer of power from the ruling Coalition for Democratic Change government which he heads to the newly elected administration.

The President noted that he was setting up the JPTT by virtue of the power and authority vested in him pursuant to Chapter 2, Article 5(c) of the 1986 Constitution of the Republic of Liberia (1986) authorizing him to develop a system of appropriate protocols and mechanisms for the smooth transfer of power from the incumbent President to the incoming President.

The President, who and President-Elect co-chair, the Joint Presidential Transition Team, has already appointed members of his government to the team. They include Minister of Foreign Affairs and Dean of the Cabinet, Minister of Finance and Development Planning, the Minister of Justice, the Minister of National Defense, and the Minister of State for Presidential Affairs.

Others include the Minister of Internal Affairs, Minister of Mines and Energy, Minister of Health, Governor of the Central Bank of Liberia, Economic Advisor to the President, Legal Advisor to the President, National Port Authority, National Social Security and Welfare Corporation, Liberia Maritime Authority, Liberia Revenue Authority, Director General of the General Service Agency, Liberia Electricity Corporation, and three other members to be appointed at the discretion of the Incumbent President.

According to the Executive Order issued by the President Tuesday, November 21, 2023, the President-Elect is invited to designate 20 persons to the JPTT, all of whom must be Liberian citizens, so as to facilitate the work of the JPTT in a timely manner.


The President has further appointed the Director-General of the Cabinet to serve as the Secretary to the JPTT and head of the Secretariat.

Other members of the Secretariat are the Economic Advisor to the President and the Legal Advisor to the President.

The Director-General of the Cabinet shall second other support staff from within the Executive Branch of Government as may be required to expedite the timely work of the JPTT, the Executive Order also states.

The Incumbent President and the President-Elect shall be Co-Chairpersons to the JPTT.

The Executive Order further asserts that notwithstanding paragraph (d) above, the incumbent president shall designate the Minister of Foreign Affairs and Dean of the Cabinet to act as Co-Chairperson in his absence to oversee all affairs of the Joint Presidential Transition Team 2023 and conduct all meetings in his absence.

“The President-Elect may also designate any member of his Team to similarly act as a Co-Chairperson in his absence,” the Order states further, adding: “Decisions of the JPTT shall be made by consensus and any disagreements shall be resolved by the Incumbent President and the President-Elect, acting jointly.”

“The JPTT shall commence its functions and exercise the powers and authority granted by this Executive Order no later than forty-eight (48) hours after the declaration of the President-Elect by the National Elections Commission (“NEC”). It shall cease to function after the publication of its Final Report, which shall be no later than forty-eight (48) hours before the Inauguration of the President-Elect and Vice President-Elect.”

The incumbent president shall call the first meeting of the JPTT within 48 hours after the declaration of the President-Elect by the NEC, the executive order states.
