I extend heartfelt congratulations to former president John Dramani Mahama on his victory in the recently concluded presidential and parliamentary elections in Ghana. His triumph is a testament to his perseverance and valor, and the Ghanaian people's yearning for a change in the direction of their country.

I also wish to congratulate his contender, Vice President Dr. Mahamudu Bawumia, for his statesmanship by conceding defeat even before the votes were fully counted and announced by the Elections Commission. His action once again raises the world's admiration for the robustness of Ghanaian democracy.

All Ghanaians are deserving of our praise for having achieved yet another remarkable feat.

This is the latest in a series of democratic elections on the African continent, which shows a move towards respect for the rule of law and will of the people in spite of setbacks in other areas.

I also extend thanks to outgoing President Nana Akufo-Addo for having presided over a generally peaceful and transparent process. He will be leaving an enviable democratic legacy as he prepares to take a bow.

It is my hope that other nations in the region can take a page or two from the enduring Ghanaian culture of democratic governance.

The Supreme Court of Liberia has nullified the election of Representative Richard Koon as Speaker of the House of Representatives and declared the actions of the majority bloc unconstitutional.

The ruling, delivered by Chief Justice Sie-A-Nyene G. Yuoh, centered on a petition filed by Speaker Jonathan Fonati Koffa and the minority bloc, which accused the majority bloc, led by Deputy Speaker Thomas Fallah, of convening a separate session to elect Koon in violation of the Constitution.

The Court found that the actions of the majority bloc were unconstitutional, ruling that they violated Articles 33 and 49 of the Liberian Constitution. Article 33 requires a quorum of a simple majority for legislative sessions, and Article 49 mandates that the Speaker presides over all sessions, with the Deputy Speaker taking over when the Speaker is absent.

The Court emphasized that any legislative action not in compliance with these constitutional provisions is β€œultra vires” (beyond the legal power or authority) and thus void.

Members of the Honorable House of Representatives of the 55th Legislature in session have acknowledged and welcomed the Supreme Court’s ruling on the petition filed by former Speaker J. Fonati Koffa and others.

We commend the Court for reaffirming the principles of separation of powers, which remain essential to Liberia’s democratic governance.

The Supreme Court asserted its constitutional jurisdiction over the matter, reiterating its authority to interpret and uphold the Constitution. Importantly, the Court clarified that the minority lacks any constitutional mechanism to compel the attendance of absent members to form a quorum.

The Supreme Court did not find any actions by the Members in session to be unconstitutional, illegal, null, or void, as sought in former Speaker Koffa’s petition. This signifies that the petitioners’ arguments were rejected, and the actions of the Members in session were affirmed as lawful and consistent with constitutional principles.

The Court also emphasized that all members of the House must conduct themselves in accordance with the law, underlining the importance of constitutional adherence as the Members in session have repeatedly done.

The body is left wondering, how former Speaker Rep. J. Fonati Koffa will transition as he announced in his recent Facebook statement when he has been duly removed as speaker of the House of Representatives of the 55th Legislature.

We reaffirm our commitment to upholding the rule of law, restoring honor to the House of Representatives, and ensuring the dignity of this Legislative Body.

We also take this opportunity to inform the Liberian people that the budget hearing starts Monday with the revenue component and regular sessions of the House will resume on Tuesday to address critical legislative matters in service of the nation

The Members in session remain steadfast in their dedication to transparency, integrity, and strict adherence to the Constitution, prioritizing the interests of the Liberian people at all times.
