NEWSRivers Crisis: Falana Explains Why Pro-Wike Lawmakers Can’t Impeach FubaraPublished on 13 May 2024 at 6:42 AMBy Ayomide Emeka Joseph
Kindly share this story:
6th Of September: The Heavens Won't Fall, Tribunal Judgement Is Not Final - Falana

Prominent human rights lawyer, Femi Falana (SAN) has explained why it would be difficult for lawmakers loyal to former Rivers State governor, Nyesom Wike to impeach the state governor, Siminalayi Fubara.
Giving the legal and constitutional insight while appearing on Channels TV’s Sunday Politics, Falana explained that Pro-Wike lawmakers would need a two-thirds majority of the legislators.

Naija News reports that Falana also highlighted the constitutional requirements for legislative procedures, stressing the importance of adhering to these standards to maintain the integrity of legislative processes.

Falana said, “Again, we have to look at the Constitution. Before the House can conduct proceedings, the House must form a quorum to conduct the business of the House, and a quorum in the Constitution is defined.

“But if you want to remove the governor by way of impeachment, again you must have a two-thirds majority of the legislature. This is very clear.”

The SAN reiterated his stance that the 25 members of the Rivers State House of Assembly, who recently defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC), have effectively lost their positions.

His comments come amid the ongoing political strife within the state that has seen significant shifts in party allegiance, influencing the legislative dynamics of the assembly.

The defection occurred in the backdrop of the escalating political conflict between Governor Siminalayi Fubara and his predecessor, now the Minister of the Federal Capital Territory, Nyesom Wike.

This group of lawmakers, previously aligned with Wike, shifted their allegiance to the APC, prompting debates on the legality of their continued membership in the assembly.

Falana emphasized, “The 25 lawmakers who defected have lost their seats. They have lost their rights to remain members of the assembly.”

He referenced a precedent set by the Supreme Court in the case of Adetunde and the Labour Party, which clarified that lawmakers could only retain their seats if their original party was undergoing a division, which he affirmed is currently not the case with the PDP.

This controversy further intensified with Victor Oko-Jumbo’s election as the new speaker of the assembly, representing the Bonny constituency.

Oko-Jumbo’s election by the faction loyal to Governor Fubara has been shrouded in ambiguity regarding the legitimacy of the voting process and the actual number of lawmakers who supported his speakership.

Rivers state should learn how to play politics from Akwa Ibom state...

Despite the disagreements that existed between Senator Akpabio and his predecessor, Victor Attah and those that existed between Akpabio and his successor, Udom Emmanuel, one thing these politicians always did was put the interest of the people of Akwa Ibom state above their personal political orientation in many facets.

After Udom Emmanuel's successor, Mr. Umo Eno was sworn in, one of the first persons he paid a courtesy call on was Senator Godswill Akpabio, who is in another party different from Eno's party and who had disagreed on all fronts with Eno's godfather, Udom Emmanuel.

Eno even stood firmly by Akpabio during Akpabio's bid for the seat of the president of the Senate. He did not only do so in words, he rallied all Akwa Ibom lawmakers in his party, the PDP, to support Akpabio's bid irrespective of the fact that Akpabio is in the APC.

Not one moment did Udom react to it in public nor have I heard that he is unhappy with Eno for pallying with Akpabio.

All the while Akpabio disagreed with Attah and Udom, we did not see any of them granting media chats just to malign the others, neither do you see their supporters drawing swords daily on the social media.

In Rivers state, it is a whole different scenario. It is as though the only source of livelihood here is politics and nothing else, yet the state is one of the most blessed states, all round, in Nigeria.

For 8 years, whenever Amaechi was given a mic to speak in a public event in Rivers state, that session would automatically become a campaign ground against Wike. In reaction, the following day, Wike would rent all the media stations in Nigeria to give a counter.

Wike spent 50% of his media scenes promoting how he had conquered the Amaechi influence in Rivers state and not on how he had conquered poverty, poor healthcare etc.

Their followers are not different. They amplify even the minutest rifts and blow them out of proportions.

Same trend has been transfered to the Sim and Wike camps.

We now have more political praise-singing events in Rivers state than we have commissioning of new projects or discussions on topical issues to move the state forward.

I am worried about these trends because their end points leave the ordinary Rivers residents and citizens more impoverished and the state less developed while the politicians remain richer.

It is a terrible situation!

My Wife’s Salary Was a Mystery Until I discovered How Much She’s Truly Worth. In 2021 she told me her salary was $9500 and then two years later, when she got promoted, I asked about her salary and she said, “Oh these people, don’t mind them. They added only $1500 to my old salary" Because of her meager salary, I’ve taken up so many responsibilities in the house without complaint. I pay for utilities and pay for food. I pay the fees of our two kids, clothe them, and take care of their medical bills. When my wife sends me a grocery list, she adds sanitary pads. She buys dresses and clothes, comes to show them to me, and asks me to pay for them. She started talking about a car when our second child came in. Things weren’t good on my side so I asked her to give me some time. She said, “I’ve saved something. I can add it to what you have so you pay me when your money comes.”
I agreed and took that money from her, topped it up to get her a car. For three months my ears never had rest. She would wake up at dawn and ask me to pay what I owed her. I got tired and paid the money when I didn’t have much in my account.
One evening, I turned my laptop on and saw a lot of emails. I checked and it was my wife’s email that had been opened. I asked her, “Did you use my laptop?” She answered, “Yeah I was checking something.” I told her, “Then you didn’t log out.” She answered, “I forgot. Please log out for me.”
I was about to log out when something caught my attention. I saw a mail with the subject, “January Payslip.” I opened and started going through. When I saw her gross salary, I was shocked. $74,734
And this girl has been crying poverty?
I went through the details. That night I couldn’t sleep. I was angry. I felt let down. I felt cheated. I felt played. We’ve been married for six good years and my wife earned that much without my knowledge? How much she earned didn’t bother me a lot than what she was using that money for. I decided not to talk immediately but rather do a little bit of investigation.
All my life I’ve held the view that it wasn’t right for anyone to go through their partner’s phone. It’s an invasion of privacy and it breeds mistrust in the relationship but that night, going through her phone was the only way to find out what I was looking for.
I started with her best friend. Nothing much was found. Her family had a Whatsapp group. I read the messages there. I got few hints. I went through the chat with her father and that was when I realized my wife had bought a piece of land and had started building. Her father was in charge of the project. He had sent photos of the various stages of the building. At some point, her father said, “Thank you for helping out your brother. He would have been home had it not been you.”
She has only one brother, her senior brother. I went to look for the chat between them. Her senior brother lost his job and was home doing nothing so my wife bought him a car to use for Uber. Every week, her brother rendered an account and they split the money. From all indications, my wife was doing well for herself while she plays poor so she could rely on my salary. Why would she do that? I thought I was being a supportive husband so my wife could be proud of the man she married. When we bought land, it was her name and my name that appeared on the land title. That car I bought for her with a loan from her bears her name. I didn’t mind. I believed what’s hers was also mine.
The next morning she realized I wasn’t looking well. I was boiling on the inside but looking for a good opportunity to start the conversation. When I calmed down a little, I asked her, “So why would you do that to me?”
She asked, “What have I done?”
I answered, “You bought land, you never told me. You started building on it, you never told me. When are you going to tell me?”
She was shocked.
She asked, “Who told you all that?”
I said, “Your father did.” She stood quiet for a while.
She asked, “Why would my father tell you all that? What were you people talking about”
I said, “I don’t know. You can ask him.”
We left it there. Some minutes later she came to me with her phone: “My father wants to talk to you.” The phone was already on a loudspeaker. His father was clearly angry.
He asked, almost shouting, “You said I told you my daughter has a building, Where did I say that and when?”
I asked, “Is it not true that my wife has a building project going on that you’re supervising?”
He asked me, “I told you that?”
I asked, “Is it true or not?” After the back and forth I told them, “I read your messages last night. I saw the pictures. I read the various budget you had sent to my wife. I read the confirmation of the money receipts that you sent her. You’re a man. Would you be happy if your wife does this to you?”
He started fumbling. He started apologizing saying he thought I was aware....
My wife stood there motionless, didn’t know what to say. When her father hung up, I told her everything I knew, from her salary to the car she bought for her brother. I said, “Yet, even your sanitary pad, I buy them. You think I’m a fool? You’ll use your money to acquire your own properties and live on mine because you’re my wife? I hear. We’ll see.”
Trust was lost. Love was broken. We had to find a new way of living our lives going forward. Her father called me every morning and evening apologizing for everything and sometimes taking up the blame so I didn’t have to blame his daughter.
I told him, “The emotional state I’m in right now, it would be hard to think straight or think forgiveness. Just give me space.”
Three days later, they were in our house. The father, the mother, and the senior brother. They came to apologize.
“Don’t let this break up the beautiful marriage you both have. If nothing at all, consider the kids and be lenient in your judgment.”
I listened to them. My position was still the same. “I need time to clear my mind. Just leave me alone to think.”
From last month to this moment that I’m writing this, my wife had changed totally. She doesn’t ask for money but the house is being run smoothly. She has started paying for things she never paid for but that doesn’t move me. She has taught me a very great lesson and I’m taking it seriously. That in everything, I have to look out for myself and my family first.
Last she told me, “If you want us to change the names on those properties, we can do so.”
Guess whose name is on the property…her father’s name.”
I told her, “You don’t need to change anything. They are yours. You suffered for them so you can decide what you want to do with them.”
The land I bought has our names. I’m selling it and take my money back. The car she’s driving has her name. I put a for-sale sticker on it some weeks ago. She agreed she’ll pay for the car. I’ve given her two months to pay up or I sell it and take my money. She’s getting the message and I’m glad. Each one for himself, God for us all. She keeps asking if I’m going to leave her. I keep telling her I won’t but if she wants a divorce, I will gladly give her. I’m not going to leave the marriage. I would give us some time to heal and see what may happen but when it comes to money, I’ve taken the lesson she taught me through her actions...

GOV FUBARA EMPOWERS 3,066 MSMEs WITH N4BN SOFT LOAN

Rivers State Governor, Sir Siminalayi Fubara, has formally launched the N4billion matching fund loan scheme that will stimulate business activities in the State while also creating wealth.

The launching, which took place at the Dr Obi Wali International Conference Centre in Port Harcourt on Friday, signalled the commencement of the disbursement of Rivers State Government/Bank of Industry (BOI) Limited N4billion marching fund loan scheme for nano, small and medium-scale businesses in the State.

Governor Fubara said the lack of access to credit had continued to aggravate financial exclusion and choked the prospects for individuals to realise their economic aspirations for a better life.

But with the scheme, which is a partnership between Rivers State Government and BOI, now launched, Governor Fubara emphasised that a surest path has been secured to achieve entrepreneurial success while serving as an enabler of economic prosperity in the State.

"Today, we are all here to witness the formal launch and distribution of cheques to 3,066 micro, small, and medium-scale enterprises and 100 companies in the State from all 23 local government areas, including businesses owned by non-indigenes valued at over N3.6billion only.

"We are satisfied with today's outing and professionalism, believing even more strongly that the potential outcome will be greater to both BOI and the Government and good people of Rivers State."

Governor Fubara explained that as a campaign blueprint, he promised, during his electioneering campaigns, to support entrepreneurial development and the growth of businesses through access to credit in the form of soft loans.

The Governor said, upon assumption of office, he noticed more closely how most businesses, especially those of small scale, struggled and either died or gasped in accessing credit that were only offered by banks at neck-breaking interest without success.

Governor Fubara pointed out that: "As a State, we cannot talk about economic growth without stimulating business activities to create wealth and jobs through policies and programmes that will engender greater public access to credit and financial inclusion.

"MSMEs are well-known as critical drivers of inclusive economic growth and development. By empowering our people to cultivate available economic opportunities, access to credit is a powerful tool for achieving financial security.

"We can only keep imaging the economic value that the over 3,000 MSMEs would add to the positive economic dynamics of Rivers State and the local government areas in terms of gross domestic product, increased tax returns, employment creation, income distribution and production of good and services."

Governor Fubara made it clear that even if the loan appeared very liberal, it is not given as charity, and insisted that beneficiaries must pay back so that others can access it to fund their businesses.

The Governor, therefore, instructed the management of the Rivers State Microfinance Agency (RIMA) to monitor the progress of the beneficiaries in their businesses and ensure a 100 percent recovery of the loans to guarantee the sustainability of the programme.

Governor Fubara noted the gains of the symbiotic economic partnership between the State Government and BOI, and the transformed commitment to further strengthen and cultivate it for the benefit of the people of Rivers State.

In his address, the Managing Director/Chief Executive Officer of Bank of Industry (BOI) Limited, Dr Olasupo Olusi, represented by the Executive Director of Corporate Services and Commerical, Mr Usen Effiong, said they were particularly interested in ensuring that the collaboration is realised in steering socio-economic growth, creating jobs, checkmating social vices and growing the IGR of Rivers State.

"BOI remains committed and a strong pillar of development financing in Nigeria for over 60 years. Our remarkable record and total assets exceed N4trillion, which makes BOI the largest and most successful development finance institution in the nation.

"It will interest us to know that our total investment in Rivers State as at today stands at N55.65billion, which accounts for 55 percent of the total investment in the entire South-South. So, Rivers State alone is taking the chunk of our investment.

"We, as the Bank of Industry Limited, play a major role in supporting Nigerian enterprises by providing financial services, advisory services, and watch businesses grow from Nano to Micro to Small, Medium and getting to large enterprises.

"Our mandate is to create development impact which is in line with the economic blueprint of His Excellency, the Governor of Rivers State, and this cuts across various sectors ranging from agriculture, oil and gas, power and aviation, hospitality. This, we believe will crystalize industrialization and economic sustainability in Rivers State."

Delivering his welcome address, the Managing Director and Chief Executive Officer of Rivers State Microfinance Agency (RIMA), Pastor Jonathan Tobin, said it was exciting that they were given the opportunity to contribute to achieving the dream project of Governor Fubara christened, "Touching Lives, Creating Wealth."

Pastor Tobin stated that the timing of the launching of the scheme is auspicious because it was coming when the operating capital of most businesses have been eroded.

He explained that there are grave inflation rate and fluctuation of the foreign exchange regime, which have posed unbearable challenges to most micro businesses.

Pastor Tobin said the interest rate for loan collected under the scheme is single digit, which is 7.5 percent per annum, and reckons as the lowest in the country.

"Today, Your Excellency, we have four categories of borrowers. Those who are borrowing from N1,000 to N1,000.000. Those who are borrowing from above N1,000.000 to N50,000,000 are treated by our partners, Bank of Industry.

"If you are borrowing from N100,000 to N450,000, all you need to provide is just your passport photograph, the passport photograph of your guarantor, your NIN, and local government identification.

"For those who are borrowing from N500,000 to N1,000,000, all they need to provide is two passport photographs, their NIN, their means of identification, BVN, a guarantor with a cheque leaf. These categories of borrowers are treated in RIMA," he added.

Pastor Tobin said further: "Those who are borrowing from above N1,000,000 to N10,000,000 will be treated in Bank of Industry. All they need is just a proof of registration of their businesses, two guarantors, a valid identification card, and a simple business plan.

"For those who are borrowing N10,000,000 to N50,000,000, all they need is a Corporate Affairs Commission Registration, two years' audited financial record, a Certificate of Occupancy, BVN, tax clearance of the company and or the directors.

"Your Excellency, as at today, we have brought on board 3,066 beneficiaries, and they all are requesting for N1.632billion. Interestingly, women borrowers account for 58 percent while the men borrowers account for 42 percent."

He urged Rivers people interested in forging a good and sustainable business path to approach the agency for support yo enable them contribute to the economic revival and growth of the State.

Highlight of the event was the official launch of the loan scheme and presentation of cheques to some successful beneficiaries from across the 23 LGAs and some small business owners by the State Governor, Sir Siminalayi Fubara.

JUST IN: There's A Report Of An Attempt To Arrest Peter Obi By Tinubu's Govt — Charly Boy

He wrote: “There’s a report of an attempt of arrest on Peter Obi, by Tinubu’s Government over Peter Obi’s consistent refusal to back down on calling Tinubu out towards good governance and accountability. Any arrest or charges against Obi must be met with a resistance as never seen in the history of Nigeria before, and the Obidients are ready for it.

Tinubu’s government must trend(sic) with caution not to set this nation on f!re with an illegal arrest of HE Peter Obi.

We call on Tinubu’s government to desist from her evil plans against Peter Obi because Nigeria will not remain the same.”
