The Federal High Court resumed proceedings today in the trial of Mazi Nnamdi Kanu (MNK), the detained leader of IPOB. The courtroom was filled with senior legal practitioners and intense exchanges between the prosecution, defense, and the presiding judge.

Judge’s Position:

The Judge expressed strong dissatisfaction with the pace of the trial. He stated:

"This case is under accelerated hearing. The defendant has been in detention for too long, and I want this matter concluded quickly. The court will soon go on vacation, and we cannot allow the accused to remain in custody indefinitely."

The Judge then gave the prosecution six days to present all their witnesses, warning:

“Whether they are 500 or more, call them within the 6-day window. If you fail, I will close your case and proceed to the defense.”

The defense presented several video clips, which were admitted and played in court:

Clip 1: A man saying:

“If you are depending on the police for protection, you will all die.”

A: No.

Clip 2: A man calls on communities to arm themselves and fight Boko Haram.

Witness: Identified him as Oluwatosin Ajayi, his DG.

Q: Did he encourage self-defense?
A: Yes.

Q: Do you agree with his message?
A: Yes.

Clip 3: A man (later identified as Imo State Governor Hope Uzodinma) says:

“If anyone says it’s IPOB killing people in Orlu, they are wrong. The killings are politically motivated.”

Q: But yesterday, you said the Governor blamed IPOB.
A: The Governor didn’t mention names.

Clip 4: General TY Danjuma seen saying:

“If you are waiting for the police to protect you, you will all die. Everyone should carry arms.”

Q: Was he arrested for saying this?
A: I’m not aware.

A: Amotekun is legally recognized; ESN is not.

Prosecution’s Delay:

The prosecution admitted their next witness was not ready and requested more time.

Judge’s Final Remarks:

Witness: Am not aware my lord. Agabi: Are you aware that those charges were later struck out by competent court jurisdiction?

Witness: No, I am not aware.

Agabi: Are you aware that the defendant in furtherance of terrorism charge he was accused of, to have directed the public to destroy government properties in Lagos?

Witness: Yes, I am aware

Agabi: Are you aware the trial judge struck out the charges?

Witness: That, I am not aware.

Prosecution Party Calls In Second Witness To Cross Examination Holding.

Prosecution: Do you know Mazi Nnamdi Kanu?

2nd Witness: Yes, I met Mazi Nnamdi Kanu in Abuja at our DSS office where I was asked to question him. Mazi Nnamdi Kanu the leader of the proscribed group, IPOB
and he also established ESN an armed group.

Prosecution: You told the court about a meeting held with the defendant. Go on tell the court the setting and details of the meeting?

2nd Witness: I have a letter from the federation's attorney general and it should be distributed in court for appropriate reading.

Note: That Mazi Nnamdi Kanu Stated That he Doesn't Know Witness Number 2

The Defense lead counsel, Kanu Agabi issues an objection plea granted by the presiding judge. According to the defense lead counsel the letter being circulated in court was not included in the previous evidences brought before the court.

Agabi also stated that the prosecution party has since withdrawn the said subsequent letter from the former Attorney General office following a motion filed by defense of his client.

Defense lead counsel, objects that they have not received the documents being distributed in court by the prosecution.

Prosecution party assures that they are prepared to serve them to the defense party.

The Defense team asserts that they did not receive nearly all of the documents that the prosecution presented

In addition, the trial judge, Justice Omotosho stated that he did not receive any such document either.

Witness has been asked to narrate what happened during his interrogation with MNK in 2015

Witness says MNk incited people to bvrn down houses and others. The prosecution is requesting the case be postponed till tomorrow as the defense team maintains no letter or documents from the former attorney general of the federation was served them.

Judge: all documents must be served to the defendant by the prosecution so they can be examined.

Judge to the prosecution: any documents you want to use must be duly served to the defense team.

Agabi; is it necessary to submit the application to release my clients belongings?

Court adjourned till 7th (tomorrow) specifically to examine the prosecution witness.
