APPEAL COURT RULES: FRSC HAS NO POWER TO SEIZE LICENCES, VEHICLES
The Court of Appeal in Owerri, Imo State, has declared that the Federal Road Safety Corps (FRSC) has no legal authority to seize drivers’ licences, vehicles, or related documents without due process.
This ruling came in Appeal No: CA/OW/199/2022, filed by the FRSC, the Corps Marshal, and an officer identified as COSS 35 (the 1st to 3rd appellants), challenging a decision in favour of Dr. Emmanuel Ugochukwu Shebbs (respondent).
The appellate court affirmed the earlier judgment of the Abia State High Court, which held that such actions by FRSC officials amounted to a violation of fundamental human rights.
In a unanimous decision by Justices Amina Audi Wambai, M. Lawal Abubakar, and Ntong F. Ntong, the court upheld FRSC’s liability but reduced the N30 million compensation initially awarded to Shebbs to N10 million, covering both general and exemplary damages.
The case arose from a 2020 incident during the COVID-19 lockdown when FRSC officials stopped Shebbs along Bende Road in Umuahia. Despite finding no fault during the initial inspection, the officers allegedly demanded a bribe. After he refused, they cited a worn tyre as justification for retaining his licence and issued a N3,000 fine.
Rather than pay, Shebbs filed a lawsuit, challenging the seizure as an infringement on his rights.
