Someone you love asks you to guarantee their loan.

SOMEONE OWES YOU MONEY? DON'T PUT YOURSELF IN TROUBLE TRYING TO RECOVER IT.

We understand the frustration of lending someone money and then having to chase them for repayment.

But please don't resort to threats, harassment, stalking, public humiliation or other unlawful methods of recovering your money.

There are proper steps you can take:

1️⃣ Send a formal demand letter.
2️⃣ Preserve your evidence.
3️⃣ Give the debtor an opportunity to respond.
4️⃣ Send a final demand or involve a lawyer where appropriate.
5️⃣ Consider negotiation or mediation.
6️⃣ If necessary, pursue the appropriate legal process.

The goal is to recover your money—not to create another legal problem for yourself.

🚨 “MADAM, YOU’RE UNDER ARREST.”

“FOR WHAT?”

“NOISE COMPLAINT.”

But the real story was different.

Behind the so-called noise complaint was a private dispute.

A disagreement between individuals had somehow turned into a police encounter.

Now the woman was being arrested.

She wasn't running.

She wasn't fighting.

She wasn't resisting.

She simply said:

“I will walk to the police station. You can drive behind me.”

But the officers wanted her inside the van.

Here's the uncomfortable question:

🚨 WHEN DOES A CIVIL DISPUTE BECOME A POLICE MATTER?

Section 8(2) of the ACJA provides that a suspect shall not be arrested merely on a civil wrong or breach of contract.

Section 32(2) of the Police Act 2020 similarly provides that a person shall not be arrested merely on a civil wrong or breach of contract.

That does not mean every noise complaint is civil. A genuine offence involving public disturbance or other criminal conduct may be investigated.

But if the “noise complaint” is merely a cover for a private civil disagreement...

SHOULD THE POLICE BE USED TO ARREST THE PERSON?

And if the person is cooperating, is dragging her into a police van really necessary?

🚨 “PUT YOUR PHONE DOWN!”

A police officer stops you during an encounter.

You bring out your phone to record.

The officer says:

“Stop recording me!”

But here's something every citizen should understand:

YOUR PHONE MAY BE YOUR WITNESS.

The Police Act 2020 does not contain a general provision making it an offence for a citizen to record a police officer simply because the officer is performing official duties in public.

But that does NOT mean you should obstruct the officer, interfere with an investigation, resist arrest or become confrontational.

Record responsibly.

Remain calm.

Keep a reasonable distance.

And if an officer objects, don't fight.

Ask respectfully:

“Officer, am I committing an offence by recording this interaction?”

Because your phone can preserve what your memory may later struggle to prove:

What was said.

What was done.

Who was present.

Where it happened.

And when it happened.

Your phone may not speak...

BUT IT CAN TELL THE STORY.
