Justice K***a said the Legal Year is for stock taking of the activities of the previous year of the Plateau State High Court, to offer thanksgiving to the Lord Almighty for the legal year ended and prepare for the legal year ahead.

K***a said this year's legal year activities started with Muslim prayers at the Jos Central Mosque on Friday 8th September, 2023,Christian prayers at the COCIN Church Abattoir on Sunday 10th September, 2023, the valedictory court session for late Justice Oyetunde on Thursday 14th September, 2023 and the legal year ceremony proper on Friday 15th September, 2023.

The hardworking Chairman and members of the committee (Justice I I K***a-Chairman, Justice G D Fwomyom-Member, Justice Shaseet-Member,Justice Elizabeth Angai-Member,Justice S B Samchi-Member and Barr Andrawus Maikai-Secretary) said the legal year activities is properly captured in the statute of the State High Court,hence,the judges rested for 42 working days and will resume work after the legal year ceremony.

OUTRAGE AS NATIONAL AND STATE ASSEMBLIES ELECTION PETITIONS TRIBUNAL IN PLATEAU STATE HAND OUT CONFLICTING DECISIONS.

The National and State Assemblies Election Petition Tribunal in Plateau State, presided over by Justice B.M Tukur has upheld the Petition of Simon Bako Lalong of the APC thereby nullifying the election of Senator Napoleon Binkap Bali of the PDP on the basis that AVM Napoleon Bali (Rtd) was at the time of the election not qualified to contest the Senate seat.

The Tribunal agreed with the submission of the Petitioners that the PDP is in disobedience of a Court Order to organize Congress to elect its State Exco.

The holding of the Tribunal has generated outrage as the PDP pleaded before the Tribunal that, it has already complied with the order of Court mandating it to conduct its State Exco election, which was conducted on 25th September 2021 and the Evidence put before the Tribunal, and INEC repeated monitoring report as evidence of PDP's compliance with the court order before the Tribunal.

The Decision of the Tribunal is more worrisome going by the numerous decisions already handed out by Courts recently that, a Political Party has no business meddling with how another Political Party handles its domestic affairs, no matter how disgruntled the complaining political party might feel at any such perceived wrongdoing within the other party. Example is the RESPECTED JUDGEMENT OF THE PRESIDENTIAL ELECTION PETITION TRIBUNAL OF APM verses VP SHETTIMA, where APM’s Petition was thrown out,
because, no Political Party has locus to challenge issues bordering on nomination and sponsorship of another political party. The courts have also clearly held that the issue of membership and leadership of a political party are a no-go area for courts. How then did the Tribunal assume jurisdiction to entertain the issue of leadership of the PDP in Plateau State?

JUSTICE WILLIAM ROTIMI AND HIS OTHER 2 JUSTICES PANEL-2 MEMBERS upheld these Points of Law but
JUSTICE BM TUKUR AND 2 OTHER JUSTICES OF PANEL-1 MEMBERS turned the same Petition and Prayers upside down “maybe to satisfy someone”.

THE SAME TWO PANELS ON HEARING THE SAME PETITIONS BUT GIVING COMPLETELY DIFFERENT JUDGEMENTS? PLEASE LET THE JUDICIARY LEADERSHIP INVESTIGATE THESE ALLEGATIONS AND I AM AVAILABLE TO TESTIFY.

Furthermore, one wonders whether the alleged failure of the State Chapter of the PDP in Plateau State can rob it of the capacity to sponsor candidates in an election since it is the NWC of the party that organizes primary elections of the party and it is the same organ through the National Chairman and Secretary that can forward the name of a candidate for an election to INEC. Does that mean that PDP has been de-registered by INEC as a political party that it cannot sponsor candidates in Plateau State because the state chapter in that state is in alleged disobedience of court order to organize election of its State Exco?

Worthy of Worry is the conflicting judgements already handed down by different panels of the National and State Assemblies Election Petition Tribunals in Plateau State. All the Petitions against the victory of the PDP in Plateau State have the issue of non qualification of the PDP candidates to contest election embedded as Ground 1. I repeat, while the Justice William Rotimi-led panel had in the preceding week held that PDP can sponsor candidates for election in Plateau State and dismissed the Petitions filed by the APC , in a surprising turn of events, the Justice BM Tukur-led panel held just on 11 September 2023 that PDP cannot sponsor candidates for election. The question is, where do we go with this conflicting decisions, the Nigerian Judiciary??

Recall that following the Senatorial election of the 25th February, 2023 for Plateau South, AVM Napoleon was declared the winner by INEC as he defeated the then incumbent Governor, Simon Bako Lalong with a wide margin of 57, 170 votes.

With this kind of a winning margin, are our courts eroding the essence of electoral democracy with some of these decisions?
