A United States of America, USA, District Court, has on Friday, ordered the Federal Bureau of Investigation, FBI, the Drug Enforcement Administration, DEA, the Department of Justice, DOJ, and President Bola Tinubu, to file objections, “no later” than August 28, 2026, against the release of documents linking the All Progressives Congress, APC, 2027 Presidential Candidate to alleged drug-trafficking criminal investigation.
The order was issued by Judge Beryl Howell, of the USA District Court for the District of Columbia.
The update on the ongoing case was disclosed by a Senior Government Advisor and Consultant, in Washington DC, Dr. Karl Von Batten, on X.
He tweeted exactly: “Update: We have now been informed that Judge Howell this morning granted the permission to provide the Court with the documents in private, and has given the , , , and Nigerian President Bola Tinubu () until August 28, 2026 (“and no later”), to file their opposition to the release of Tinubu's alleged drug-trafficking records.
“I stress the Judge’s “no later” comment, because the Court has reached its limit and is making it clear that the FBI must now convince the Court why the documents are too sensitive to be released.”
Dr. Batten stated further, that the FBI has now admitted that it holds highly sensitive information on President Tinubu; a departure from the position under former President Joe Biden's administration.
His words: “Unlike the (DOJ), where the DOJ and FBI blocked, stonewalled and refused to admit they had any sensitive drug-trafficking-related documents on President , the DOJ and FBI under President are moving fast and being transparent, as they move through the process.
“The has now admitted that it has highly sensitive drug-trafficking-related information about President . By admitting this, we now know Tinubu's claim that the case was simply about civil forfeiture is untrue. The FBI does not deem civil cases highly sensitive, and seeks to present the evidence to the Judge in private.”
He added that the request for a private review, is typical in cases involving Criminal Informants, saying: “This is usually done in high-level drug cases, where the goal is to protect the Agency's dealings with the Criminal informant. This ties into the allegation that President ratted out his alleged co-drug traffickers, in exchange for immunity from prosecution.”
Dr. Batten linked the development to the current USA administration of President Donald J. Trump.
“The admitting in Court that it has sensitive information on President , and requiring the Court to review the documents privately before any Court order ordering their release is given, aligns with what our friend in the Trump Administration has told us: We will follow the Law, but we do not protect drug traffickers.
“The FBI is following standard procedures for protecting Informants, but is also openly communicating that President 's claim of innocence is far from the truth. We thank President Trump and the White House Senior Staff, for moving this case forward after three years of stalling, and for being fully transparent, unlike the Biden DOJ, which did not acknowledge it had sensitive information on Tinubu”, he stated.
The Court gave all parties until August 28, 2026, to file any opposition. Judge Howell is expected to review the documents privately thereafter, and rule on the public release request.
