Kogi Election Tribunal Verdict: How Muritala Ajaka of SDP Lost Case

● Judge Says Section 137 of Electoral Act not a Magic Wand

● Contradictory Statements of Witnesses Mar Claims

● SDP BVAS Star Witness Not a Confirmed Staff of INEC

● Forensic Expert Dismissed for Unoriginal Certificates

● Claims of Certificate Forgery, Pre-election Matter

The Kogi Electoral Tribunal sitting in Abuja gave its Verdict on 27th of May, 2024, declaring the incumbent Governor, Alhaji Usman Ododo as the duly elected winner of the November 11, 2023 Kogi Elections.

The petitioner, Alhaji Muritala Ajaka of the Social Democratic Party, according to the tribunal Judge, failed to establish his case which relies on the non-compliance of the election to the 2022 Electoral Act.

Several allegations were levied against the Respondent, Alhaji Usman Ododo by the petitioners which includes allegations of over-voting and Certificate forgery, praying the court to upturn the election in favour of the petitioners.

In the court ruling, the Judge ruled inter alia

1. The allegations of over-voting were thrown out by the court for failure to establish their case beyond reasonable doubt. In the ruling, the judge opined that the petitioners could not establish that the Respondent authorized over voting. It was also cited that the witnesses promised in deposition numbered up to 606, with only fraction (25) provided as physical witnesses. The witnesses according to the judges gave contradictory testimonies against their written depositions. The judges also opined that the failure of the petitioners to provide witnesses from all the Polling units failed to help their prayers as most of the witnesses provided appeared procured.

2. The inability of the petitioners to provide material witnesses, video evidences to demonstrate their documents hemorrhaged their case as Section 137 of the Electoral Act, which they relied upon could not be passed as a magic wand.
3. The Star witness of the SDP, who was alleged to be a staff of the Independent Electoral Commission, INEC, was not verified to be a staff of the electoral umpire. His disposition during cross examination also shows he was not part and parcel of the election as he was out of station in Imo State on the day of Election in Kogi State.

The court also ruled that individuals who are not part of the manufacturing of the Bimordal Verification System, BVAS, lose the locus standi to demonstrate such evidence in exhibit.

4. The Forensic Expert provided by the petitioners to prove their claims of over-voting after inspection of the electoral materials failed to meet set requirements of the electoral act according to the judges. The acclaimed expert submitted only a photocopy of his credentials which according to the Tribunal does not validate his professional claims.

5. On the Certificate Forgery claims, the court ruled that the issue was at best a wind gone before the rains, which could only be argued under pre-election matter as it is statues barred.

The following grounds constituted the grounds for the dismissal of the prayers of the SDP candidates for lacking in merit and failure to prove beyond reasonable doubt that he won the election, therefore, the Tribunal certified Alhaji Usman Ododo as the duly elected winner of the Kogi November 11th, 2023 elections.

PRESS RELEASE BY KOGI EAST YOUTHS APC MOVEMENT, 21ST MAY, 2024

Protocols

We are the Kogi East APC Youths Movement, drawn from the 9 Local Government Areas of the Eastern Senatorial District, majorly of the Igala and Bassa Ethnic extraction.

Today, we address a political menace which have been left as a legacy for the youths in the region by politicians who only left ethnic tribalism and bigotry as succession plan for the youths instead of development and progressive leadership, ensconced in unity.

First, as APC Youths with the fundamental rights of Association and Political participation, we would like to reaffirm our support for the All Progressives Congress, APC, as our political party. We would also like to reconfirm our unalloyed loyalty to the Governor of the State, His Excellency, Alhaji Usman Ododo, who rode on the party as a political vehicle to ascend the position of constituted authority to lead the state.

Our reasons for aligning with the incumbent stems from a careful analysis of how he has carried the baton left by his predecessor, His Excellency, Alhaji Yahaya Bello, who constituted his cabinet with over 55% of the Youth demography in the state. His successor, Alhaji Usman Ododo, has also consolidated on that foundation by appointing Youths in his government. A relevant mention is the Commissioner for Youths and Sports Development, Hon. Monday Anyebe and Hon Oladele Niyi, Special Adviser on Youths and Student Affairs, who are relatively younger than their predecessors in office, a signpost of consolidated growth.

This Press Conference is to address those who have continually used ethnic politics as a veil to mask their true intentions of seeking their own political interests under the guise of fighting for our people. For avoidance of doubt, we have thoroughly researched their backgrounds, with the following observations:

1. Politicians are usually united in interests, divided only in ambition. When they align in interests, they conspire against the common man, however, when they differ in interests, they use the common man to conspire against themselves.
2. Those who use ethnic cards for political profits are weak in vision, creative solutions and strong leadership.
3. The same politicians who have been friends, fall out after the stalemate of a negotiated interests, then, resort to misleading our people that they are fighting for them.
4. None of the politicians who claim to fight for their ethnic nationalities have their investments in their domains, most, especially, those from the Igala/Bassa ethnic extraction. Their business concerns are usually domesticated abroad and their wealth used to empower only their family members and cronies.
It is on this foundation, we have decided to speak against the cancer of ethnic politics, regardless of who it favours, be it The Ebiras, The Igalas, The Okuns and other minority ethnic groups in Kogi State.

We denounce in totally the continous quest by professional politicians who deceive the youths by using the veil of ethnic politics to set us against our brothers from the other divides. It is in the letter of contemporary political development that political power is negotiated based on issues, deviod of ethnic sentiments.

Today, we would like to be put on record as Youths who spoke to the issues when it matters that the Igala/Bassa nation are not ethnic bigots as being peddled by some hired political hustlers who are hiding under the guise of activism to pay their rents and maintain their paraphernalia of expensive wives and unsustainable lifestyles. The Igala/Bassa Nation is a progressive nation that accommodates other ethnic groups without the flare of wanting everything to only herself.

Again, We reject political tribalism in all its insidious forms and declare, unequivocally, that Kogi belongs to all its people, irrespective of tribe or creed.

Make no mistake, we are drawing an immutable line in the sand - tribalism has no place in our state. This malignant scourge seeks to tear the very fabric of our society apart with its corrosive, divisive agenda. We denounce its vile forces utterly and call for their complete and utter excision from the body politic of Kogi East.

We stand firm, unshakable in our belief that the progress and prosperity of Kogi East and Kogi state by extension, can only be achieved when we extinguish the flames of tribalism and instead embrace our diversity as a source of strength. United, we shall move mountains. Divided by tribal affiliations, we are doomed to wallow in the abyss of backwardness and strife.

It is with profound conviction that we throw our unwavering support behind the transformative leadership of Governor Usman Ahmed Ododo. His resolute commitment to inclusive governance and rejection of tribal politics resonates powerfully with our core values. We celebrate his bold vision for a Kogi united under the immutable banner of human fraternity, not fractured by tribal fault lines.

In just a few months, Governor Ododo has already demonstrated an indomitable dedication to the wellbeing of all Kogites, irrespective of tribal affiliations. With surgical precision, his policies have transcended these outmoded, regressive tribal boundaries to focus squarely on the greater good of our state and its people as a cohesive whole.

Governor Ododo has furnished each of the 21 local government areas with a fleet of 5 operational vehicles and conscripted 1000 local hunters into service to fortify the state security apparatus.

Under his resolute leadership, the prompt and complete payment of salaries has become an entrenched practice, effectively eradicating the practice of percentage payments. Both state and local government employees can now breathe a sigh of relief, as they receive their full remuneration.

The peace and tranquility that prevail under his administration are unparalleled, with the state now widely regarded as a safe haven where citizens can carry out their daily activities without fear or threat.

Within his brief tenure thus far, Governor Usman Ododo has authorized contracts valued at N29.9 billion with two construction firms. These agreements encompass civil engineering projects aimed at mitigating erosion at sites in Etahi in Okene local government area, Omigbo in Kabba Bunu LGA, and Olubo-Ojo in Ankpa LGA, spanning the state's three senatorial districts. What better exemplifies leadership devoid of ethnic bias?

One of the main reasons we strongly support Governor Ododo is because during his campaign, he promised to stop percentage salaries - an issue that existed before he became governor. Now, it is very clear to all citizens that the governor has kept this important promise he made. This action has changed the views of many people, especially from the eastern part of the state, showing that if a governor truly cares about their well-being, regardless of tribe, he has their full support.

In just three months as governor, there is no community facing insecurity that he has not personally visited. The recent unrest in Omala clearly showed the governor's deep commitment to the Igala people. He was physically present there, seeing things firsthand. After that, he briefly informed the Presidency, leading to approval for a forward military base in that local government area.

For development projects, the governor has been completely fair in how he decides where they go. Look at Ankpa LGA, where a contract for the Olubo-Ojo Gully site, including road construction, has been approved. Remarkably, this local government gave the governor the least votes in the last election. Yet, it is getting the most state-funded projects, clearly showing that Governor Ododo's administration does not punish, discriminate against, or persecute the Igala Nation.

Sadly, those who avoided ethnic agendas in 2019 now lead such divisive narratives in 2023, only caring about their personal interests and ambitions. This behavior shows the lowest levels of greed and selfishness. Unfortunately, many have fallen for their greedy, self-serving ambitions.

Kogi state is made up of more than six ethnic groups, and history shows the Igalas have widely intermarried with other tribes in the state. However, when it comes to politics, the greedy few always play the ethnic card, violating the old bonds that have united us as a people.

The Confluence University of Science and Technology in Osara recently faced a distressing incident when 24 students were abducted from the campus. Fortunately, the governor's prompt response facilitated the speedy and adroit rescue operation that secured the release of most of the captive students. Efforts are currently underway to secure the safe return of the remaining three students still being held. This occurrence clearly highlights the governor's unwavering commitment to eradicating the presence of kidnappers and bandits within the state of Kogi, ensuring it remains an inhospitable environment for such criminal activities.

We applaud the governor's herculean efforts to finally bridge the deep, tribal chasms that have insidiously divided us during the last election. The path towards true unity shall be arduous, but his open-door policy and willingness to amplify all stakeholder voices is fostering an environment where the cancerous forces of ethnic Agenda cannot survive.

Moreover, we remain optimistic that Governor Ododo's credible mandate will be reaffirmed by the judgement of the esteemed tribunal in no distant time. The governor attained his office through a free, fair and credible process, earning the faith of the people. We trust in the impartiality of our legal institutions and eagerly await the day his victory is legally certified.

This affirmation will be a triumph over the regressive forces seeking to sow division and disenfranchise the will of the Kogi people through desperate, tribal-tinted legal maneuverings. When the truth emerges unscathed, it shall extinguish any remaining flickers of hope for the purveyors of one ill-fated agenda.

To our fellow Kogites, we issue a rallying cry - reject the demons of ethnic agenda that seek to divide and conquer us! Let us set aside these imaginary, tribal boundaries and join hands as one people with a common destiny. Only through an inviolable commitment to unity can we uplift our communities and build a better future for our children, unburdened by the yoke of tribalism.

To Governor Ododo, we extend our eternal gratitude and unflinching support. Your leadership in the battle against tribalism has inspired and emboldened us. We pledge to march beside you, an impenetrable vanguard against the tribal forces of regression, as we navigate the challenges ahead on the road to a united Kogi.

Let there be no doubt - the path to a truly united, progressive Kogi will be a grueling campaign against the intransigent forces of tribalism. But through sheer determination and an unbreakable shared vision, we shall emerge victorious over this existential foe, forging an indestructible unity.

Together, we are a unbreakable bulwark against tribal divisions. Together, we can build a Kogi where tribe holds no dominion - a land where every voice reverberates with perfect equality, every dream finds fertile soil in which to germinate, and true harmony reigns supreme.

Kogi belongs to all its people, unshackled from the scourge of tribalism. And we, soldiers in the noble vanguard, the Kogi East APC Youth Movement, stand unyielding in our solemn vow to defend this ideal. With every fiber of our being, we shall fight to excise the demons of tribalism until our sacred mission is complete and Kogi emerges as a beacon of unity to light the path for the entire nation.

United we stand, forever indivisible. Divided by tribalism, we would crumble and fall. Victory shall be ours when the deafening battle cries of tribal allegiances finally fade into silence, drowned out by the thunderous chorus of One Kogi, One People!

KOGI STATE GOVERNMENT IS WINNING THE WAR AGAINST INSECURITY

1. The Kogi State Government under the leadership of Governor Ahmed Usman Ododo is rising to the challenge of defeating the torrent of criminality waged against our dear state in the last one month.
2. It is believed that the torrent of attacks on insurgents, bandits and kidnappers in the North East has dislodged them and many of them are now trying to find their feet in the North Central but the Kogi State Government is deploying an iron-cast approach to safeguarding the state from the fangs of criminals.
3. With the rescue of 21 out of the 24 Custech students kidnapped last week so far, the State Government made a clear statement that Kogi will be ruthless against criminals in the State. This morning, we also received the heart-warming report of the rescue of the Yagba West woman that was kidnapped and another woman from Yagba East Local Government Area. We are still searching frantically for the 3 remaining students yet to be rescued as every Kogite's life is important to the government. We have also secured the release of scores of kidnapped victims who are not even Kogites but who were kidnapped in their various states and taken to the forests.
4. The Governor also has approved the immediate employment of thousands of local hunters across the 21 Local Government Areas, with the immediate task of going after the criminals and taking the fight to their camps and hideouts, which is already yielding positive results.
5. Also, the Joint Forces of the Army, Police, DSS, NSCDC, Metropolitan Response Squad and Hunters Group are currently carrying our simultaneous operations in Lokoja as well as across the three Senatorial Districts, including our border communities.
6. Governor Ahmed Usman Ododo has silently declared war on criminals in the state and deploying resources and forces to ensure the enemies of our people are defeated. The Governor also expresses profound gratitude to the President and Commander in Chief of the Armed Forces, President Bola Ahmed Tinubu, GCFR for his support and encouragement to make Kogi a crime free state.
7. We want to assure our people that the Government is working hard to protect everyone and that the criminals are learning in a hard way that Kogi won't be a ground for their criminal trade. The criminals are rattled and they won't escape justice.
8. As the Government puts everything into winning this war against criminality, we urge the citizens to also play their part by volunteering intelligence to security agencies for the effective security of our dear State.

KOGI EAST STAKEHOLDERS PASS VOTE OF CONFIDENCE IN EX-GOVERNOR BELLO, DECLARE FULL SUPPORT FOR ODODO.

Critical stakeholders from Kogi East senatorial district have passed a vote of confidence in the stewardship of the former governor of Kogi State, Alhaji Yahaya Bello for the “transparency of his administration” and his efforts at uniting the people of the state.

The Stakeholders comprise many eminent personalities from Kogi East.

They also passed a vote of confidence in the incumbent Governor of the state, Alh. Usman Ododo, for his outstanding performance in his 100 days in office.

Among those who took turns to speak with one voice at a media chat in Abuja on Thursday were a former Minister of State for Labour and Productivity, Prof Steven Ocheni; Director-General, Tinubu Support Group, Kogi State Chapter, Prof. Daniel Isah; former Senator of the Federal Republic of Nigeria representing Kogi East, Senator Dangana Ocheja; and General Patrick Akpa (retd), retired Army Chief, among many others.

Highlighting various achievements of Governor Ododo, the stakeholders commended him for being the first governor of the state to visit the embattled Bagana and other Omala communities following an attack by unknown gunmen, which marked his first official visit to any local government since he assumed office as Governor of Kogi State.

According to them, in Omala, Governor Ododo vowed to facilitate the establishment of an Army Forward Operational Base in the communities previously overtaken by criminal elements.

The move, the Governor said, was to forestall future communal crises in the area.

“The visit came after no fewer than 19 persons were killed in February by hoodlums in Agojeju-odo and Bagana Communities in Omala Local Government Area of the state,” the Kogi East indigenes said.

They also praised Ododo for 100 per cent salary payments for Local Government pensioners, improvement in Local Government salaries and his consolidatory efforts at uniting Kogites across ethnic and Party lines.

Gen. Akpa specifically commended the Governor for taking after his predecessor, Alhaji Yahaya Bello, in the areas of security, transparency and building unity amongst the people.

Of particular reference was the Governor’s approach to Security issues, which led to the rescue of CUSTECH students within 72 hours of their abduction.

The stakeholders, urged President Bola Ahmed Tinubu, to call the Economic and Financial Crimes Commission (EFCC) to order over what they described as the harassment of former governor Bello.

Highlighting the recent incident where the EFCC conducted a raid on the residence of Bello, despite a substantive Court order restraining the EFCC from harassing, intimidating and arresting the former Governor pending the determination of a matter on notice.

They pointed out that while they support efforts to combat corruption, such actions must be carried out within the confines of the law, without trampling on the rights of individuals or abusing legal procedures.

The group described President Tinubu as “a staunch advocate for democracy,” to intervene and ensure that the EFCC operates in accordance with constitutional provisions and respects the rule of law.

In conclusion, the Kogi East APC critical Stakeholders urged President Tinubu to address the concerns.

They expressed gratitude for President Tinubu’s commitment to good governance and leadership, emphasizing the need for his timely intervention to safeguard democracy and protect the rights of all citizens.

The Buildup To Yahaya Bello’s Battle With EFCC

By Seun Adeuyi
Wed, 8 May 2024.

The strongman of Kogi politics and former Governor, Yahaya Adoza Bello has been entangled in a messy battle with Nigeria’s anti-graft agency, the Economic and Financial Crimes Commission (EFCC) over allegations of graft and counter accusation of political witch-hunt.

In this piece, Daily Trust uncovers some persons and factors behind the face-off that is threatening the political foundation of the State and the nation at large.

THE ISSUES

Shortly after handing over power on the 27th January, 2024, former Governor, Yahaya Bello was alleged by the EFCC to have “stolen” over 80 billion naira in September 2015, four months before he officially took over power as Governor of the State.

Nigerians were shocked at the figures and timing bandied and Bello’s lawyers, sensing political witch-hunt, approached a State High Court to protect him from being arrested, victimized or harassed by the EFCC. The court granted an interim injunction, pending the determination of the substantive suit.
Miffed by the action of Bello against it, the agency swiftly filed an appeal before an Appeal Court to vacate the interim injunction.

While awaiting the determination of the appeal and given that the State High Court had granted the prayers of Bello in its ruling on the substantive suit, the agency decided to take laws into its hands by moving to arrest the former Governor in his Abuja home. While lawyers have been at loggerheads as to the propriety or otherwise of the action, the agency decided to withdraw its suit before the Appeal Court and went ahead to amend the charges against the former Governor by claiming the 80 billion naira stolen was done in February 2016, less than three weeks into his first term in office.

Many lawyers, including Senior Advocates of Nigeria are bewildered as to how the anti-graft agency will successfully prosecute a case that is standing on one leg ab-initio.

In the midst of the confusion are dotted claims that the incumbent Governor, a protege of Bello was responsible for “sneaking” the former Governor out of his Wuse residence. The agency threatened to deal with persons who obstruct its operations.

It is clear that there are more questions than answers surrounding the EFCC-Bello debacle. So what are the factors behind the travail of the man reputed to be the White Lion?

REFUSAL TO STEP DOWN AT THE APC PRESIDENTIAL PRIMARY OF 2022

In the build up to the APC Presidential Primary in 2022, the then Governor Yahaya Bello was one of the major gladiators. He went into the contest with the face of the Nigerian youth and his campaign gathered undeniable momentum before the political dynamics favoured power rotation to the South.
Despite joining the Asiwaju Bola Ahmed Tinubu (ABAT) train after the primary and even aligning with some governors to repudiate the political machinations of the CBN policies against the possible emergence of the incumbent President, it is believed that some elements around the President felt he didn’t “bow” on time, hence the need to “punish” him, using the EFCC.
The travails of Bello was also supported by a powerful official around the President who is eyeing the Presidency in 2031.
The present brickbats between Bello and the EFCC is believed to be fueled by politics.

SUSPICIONS THAT BELLO IS BEING PREPARED FOR THE POSITION OF APC CHAIRMAN

Shortly before the expiration of his tenure, there were hush voices by some elements within the party to drag the former Governor into the politics of the national chairmanship of the party. It is believed that the slot of the Chairmanship of the party was that of the North Central and given his track records, he will be a strong force to drive the party to victory in 2027.
But before Bello could even be approached with the proposal, the incumbent National Chairman had moved swiftly to join forces with anti-Bello elements to whittle down the latter’s political influence and portray him as a corrupt politician incapable of leading the party. Sources close to Bello told our correspondent that the former Governor was never interested in becoming the national chairmanship of the party and the proposal was never discussed with him. However, he was already a victim of the intention of others.

CABINET RESHUFFLING

With the lackluster performance of some Ministers, there are palpable fears that cabinet reshuffling is imminent. Some of the Ministers who have not done well have decided to stave off possible threats from outside the cabinet by hounding them with EFCC harassment and mudslinging.
An undisclosed Minister is said to have infiltrated security forces to deploy them to stop anyone who is capable of being given his job. He is said to be part of the forces using the EFCC to harass Bello.

FIGHT FOR THE SOUL OF KOGI POLITICS

The emergence of Alh. Ahmed Usman Ododo as Kogi State Governor is a big factor in the move against Bello. Those against Bello are determined not to allow him control Kogi politics in the build up to the 2031 poll.
Those forces, though in the ruling All Progressives Congress are working with some opposition elements in the State to demystify Bello. Part of the plan according to sources, was to manipulate the Election Petition Tribunal to remove Ododo and install their preferred candidate who is said to have assured the forces of support in 2027 and 2031.
The incumbent Kogi Central Senator, is said to be fighting the battle of her life to return to the Senate in 2027 and understands the fact that a free Bello will deliver all the seats to the ruling All Progressives Congress. Political pundits are also beaming their searchlights on how the same lawyers are representing both the EFCC and the Social Democratic Party.

CONCLUSION

While the controversy around the handling of the allegations against Bello by the EFCC persists, more Nigerians have said the rule of law must not be sacrificed on the altar of politics.

Yet some others have backed the anti-graft agency even though they frowned at the issue of media trial.

However the face-off goes, it is definitely a test of the sanctity of the Nigerian judicial system.
