Supreme Court dismisses PDP suit to disqualify Tinubu over double nomination of Shettima

Bola Tinubu and Kashim Shettima rubbed mind together on the way forward for the nation.

The Supreme Court on Friday dismissed a suit seeking disqualification of Bola Tinubu and Kashim Shettima as presidential and vice-presidential candidates of the All Progressives Congress (APC).

A five-member panel of the Supreme Court held that the Peoples Democratic Party (PDP) lacked the locus standi to institute the suit.

The PDP had claimed that Shettima’s nomination as Tinubu’s running mate was in breach of the provisions of sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act, 2022.

PDP argued that Shettima’s nomination to contest the position of vice-president and Borno central senatorial seat at the same time contravened the law.

But the Supreme Court said the PDP is not a member of the APC and should not interfere in matters outside its domain.

n a bid to secure the seat of the Nigerian Senate President, one of the top contenders, Senator Elect, Godswill Akpabio (APC) has taken his consultation across parties, to one of the opposition parties elected into the senate, the Social Democratic Party (SDP). The Stability Group, fronting for Akpabio as Senate President and Barau Jubrin (APC) as Deputy Senate President, visited the national party office today in Abuja, to seek the endorsement of SDP.

Public records reveal the Stability Group has the backing and support of most leaders of the All Progressives Congress (APC). There are also other party leaders opposed to the choice of Akpabio/Barau.

- Counsel for Atiku Abubakar and the PDP, Chris Uche, says all the parties have met, considered, and agreed on the number of witnesses, duration, and examination of witnesses.
The PDP intends to call at most 100 witnesses.

- The counsel for Atiku Abubakar and the PDP adds that though the new time given to them to call these witnesses, is 7 weeks, they will need 3 weeks since the issues are getting narrower.

- All the parties agreed to streamline the number of witnesses as well as the duration of each party's right to call witnesses.

- For the evidence in chief, they categorised it into 30 minutes for the lead witness because they will tender and identify documents.

- They also proposed 15 minutes for each respondent for cross-examination and 5 Minutes for re-examination (For the lead witness of the petitioners)

10 minutes was proposed for other witnesses for the petitioners.

10 minutes for cross-examination of these witnesses by the respondents.

- For the star witnesses of the respondents (INEC, Tinubu, and the APC), 30 minutes was proposed.

INEC says it has two witnesses that will testify, while the Counsel to the President-Elect says it has 39 witnesses ready.

- For the President-Elect, the report of any star witness should be made available 48 hours before the hearing.

- The schedule of documents to be filed must be given to other parties before the hearing and calling of witnesses.

APC zones Senate President to South South, adopts Akpabio for Senate President.

The All Progressives Congress National Working Committee has nominated Godswill Akpabio and Abass Tajudeen as the next Senate President and House of Representatives speaker in the upcoming 10th National Assembly, respectively.

According to a statement by the National Publicity Secretary of the APC, Felix Morka, on Monday, the zoning arrangement reported to the NWC is as follows: Senate President – South-South Senator Godswill Akpabio (Akwa Ibom), Deputy Senate President – North West-Senator Barau Jubrin (Kano).

Others are the Speaker of the House of Representatives (North-West) – Hon. Abass Tajudeen (Kaduna), Deputy Speaker South East-Hon. Ben Kalu (Abia).

Osun Guber: Supreme court delivers judgement Tuesday

The Supreme Court, on Monday, reserved judgment in an appeal filed by Mr. Adegboyega Oyetola of the All Progressives Congress, APC, against a judgment of the Appeal court, which upheld the election of Senator Ademola Adeleke as governor of Osun.

The five-member panel led by Justice John Iyang Okoro, after listening to counsel to Oyetola, Lateef Fagbemi, SAN, Adeleke, Oyeachi Ikpeazu, SAN and Alex Iziyon, SAN, who appeared for the PDP, said judgment would be delivered on Tuesday, by 2pm.

Other members of the panel are: Justices M. Lawal Garba, Tijjani Abubakar, Adamu Ojauro and Akomaye Agim.

However, the Independent National Electoral Commission, INEC, represented by Prof. Paul Ananaba, SAN, did not file any process in the appeal being decided following the decision of the court and that of the counsel to consolidate all the appeal into one.

Attempt by Prof. Ananaba to offer explanation equally met a brick wall as the learned Justices requested him to take his seat to allow Ikpeazu make his submissions.

Ikpeazu contend that a voters register was a requirement to prove over-voting in the present circumstance.

In his adumbration, Fagbemi, SAN submitted that the Appeal court relied heavily on the old Electoral Act, specifically that of 2010 to draw its conclusion that a voter register was needed to prove over-voting.

Making reference to section 51 of the 2022 electoral Act, which was used to conduct the Osun July 16 governorship election, Fagbemi, SAN noted that one does need a voter register to establish over-voting.

Section 51 (2) of the Act stipulates that “Where the number of votes cast at an election in any polling unit exceeds the number of accredited voters in that polling unit, the presiding officer shall cancel the result of the election in that polling unit.”

He equally made reference to Section 47 (2) of the Electoral Act 2022.
