BREAKING: Appeal Court Orders Forfeiture of Yahaya Bello’s Properties

The Court of Appeal sitting in Lagos has reinstated an interim order of forfeiture on 14 high-value properties linked to former Kogi State Governor, Yahaya Bello, overturning an earlier ruling by the Federal High Court that had set the order aside.

In a judgment delivered via virtual proceedings on Wednesday, a three-member panel led by Justice Yargata Nimpar—with Justices Danlami Senchi and Paul Bassi concurring—ruled that the Federal High Court erred in law when it dismissed the case on the basis of Section 308 of the 1999 Constitution, which provides immunity for sitting governors.

The appellate court held that while immunity may shield individuals from legal action, it does not extend to assets suspected to have been acquired through unlawful means. It therefore reinstated the EFCC’s interim preservation order and instructed the anti-corruption agency to proceed with a substantive hearing to determine whether the assets should be permanently forfeited to the Federal Government.

The ruling followed an appeal filed by the Economic and Financial Crimes Commission (EFCC) challenging the decision of Justice Nicholas Oweibo of the Federal High Court, who had earlier dismissed the commission’s case.

The properties in question, located in Lagos, Abuja, and Dubai, had initially been seized under an interim order secured by the EFCC via an ex parte application. The commission claimed the assets were acquired through proceeds of corruption and included, among others, a luxury residence in the iconic Burj Khalifa, Dubai.

Justice Oweibo, however, set aside the order after Governor Bello contested the seizure. Bello argued that the properties were acquired before his tenure as governor and were therefore unrelated to state funds.

His legal team cited Section 308 as grounds for immunity and further argued that the Federal High Court lacked territorial jurisdiction over properties outside Lagos. They also challenged the applicability of the Proceeds of Crime Act, 2022, stating that the law should not be applied retroactively.

In counterarguments, EFCC counsel Rotimi Oyedepo (SAN) maintained that the anti-graft agency acted within its statutory powers and that the properties were subject to investigation regardless of the governor’s immunity status. He insisted that the EFCC had not been barred by any valid court order from investigating or preserving such assets.

The appeal court, siding with the EFCC, ruled that the trial court’s reliance on the immunity clause was misplaced. “The immunity granted to a sitting governor does not preclude the court from determining the status of property reasonably suspected to be the proceeds of crime,” Justice Nimpar stated.

The appellate court dismissed all preliminary objections raised by Bello’s counsel and ruled that the case should not have been struck out but rather heard to its logical conclusion.

RB Leipzig striker Benjamin Sesko is wanted by Newcastle United and Manchester United

Manchester United have tabled an official bid to sign Benjamin Sesko and who he’ll choose between the Red Devils and Newcastle – whose latest offer is actually higher – has been indicated.

Sesko, 22, is the subject of a tug of war between Man Utd and Newcastle. The Magpies have tabled two bids for the Slovenian striker so far, with their latest worth €90m (€80m plus €10m in add-ons).

According to Ben Jacobs, Newcastle hoped the stature of their bid would scare Man Utd off.

Taking to X on Tuesday afternoon, the reporter wrote: “Newcastle attempting to agree a deal first with Leipzig, and had hoped Manchester United would back off last night.

“Now both clubs engaged in talks with Leipzig and neither far off their expectations.”

Newcastle’s bid is the higher of the two and while getting Sesko’s green light is important, the clubs must also agree terms with RB Leipzig.

As as result, it’s been revealed that Ruben Amorim’s side are proposing an offer worth €85m (£74m, $98.3m), €75m guaranteed and a further €10m in add-ons.

To compensate for their overall package being smaller, Man Utd have ensured the first €5m of the €10m in add-ons they’re proposing is ‘easily achievable’.

As such, Man Utd’s hope is Leipzig will accept their offer even though it’s lower than Newcastle’s, and especially if Sesko signals to Leipzig that he wants Old Trafford and not St. James’ Park.

On that front, both Fabrizio Romano and Ben Jacobs offered insight into which way Sesko is leaning. Both reporters pointed towards Old Trafford.

Davido unfollows Iyabo Ojo after VeryDarkMan leaked group chats

Popular Nigerian musician, Davido has unfollowed actress Iyabo Ojo on Instagram.

The development came after social media critic, VeryDarkMan leaked a WhatsApp conversation where the actress accused Davido of chasing clout with late singer Mohbad’s case.

In the chat shared on Instagram by VeryDarkMan, Iyabo Ojo who reportedly criticised Davido for not unfollowing Naira Marley on social media, further described the singer’s support for Mohbad as insincere.

Expressing disappointment in Davido, she said, “My problem is not even the black whatever, it is Davido who flew down like he claimed to fight for justice, but he still dey follow Naira Marley.

“That means he was chasing clout. I’m so disappointed with and to think he has been saying he is the only superstar artist who stood by Mohbad. Jess fake love 001.”

In apparent reaction to the allegation by the actress, Davido has unfollowed Iyabo Ojo.

A check by DAILY POST showed that Iyabo is still following Davido.

DAILY POST reports that Mohbad died in 2023 in controversial circumstances, prompting many Nigerians, including celebrities, to protest nationwide to demand justice.

Many celebrities including Davido, Falz and Zlatan attended a candlelight procession organised to honour him.

Iyabo Ojo who was the one leading the ‘Justice for Mohbad’ campaign, reportedly opened a WhatsApp group for the movement.

Speaking in an interview a few months ago, the actress expressed regret for advocating the singer’s exhumation.
