Yoruba freedom fighter, Sunday Adeyemo, popularly known as Sunday Igboho, has been arrested in Cotonou, Benin Republic by security operatives in the West African country.

He was arrested yesterday at Cotonou Airport on his way to Germany about three weeks after the Department of State Services declared him wanted for allegedly stockpiling arms, an allegation he has since denied.

Plans are underway to repatriate him to Nigeria today.

Senator Albert Akpan: A Centripetal Protagonist of PIB

Senator Bassey Albert Akpan is undeniably a foremost protagonist of reforms in the oil and gas sector of our national economy, the latest being the Petroleum Industry Bill (PIB). Obong Bassey Albert Akpan, popularly known as OBA, has generally made indelible marks in Nigeria's economic life.

His well-coordinated roles in attaining these milestones cannot be dismissed. Of course, one would be right to describe OBA as an eagle eye, keeping watch over Nigeria's economic fortunes, to ensure a timely intervention where necessary. This piece is dedicated to showcasing his undaunted determination in fighting hard to put the nation's economic sustainability on a proper footing.

To proceed on this interesting conversation, however, there is need to unmask the Petroleum Industry Bill (PIB). The PIB is a consolidated Bill which started as an omnibus bill since 2008. It was later divided into four (4) separate bills. Previous attempts to pass the bill in 2009, 2012 and 2018 failed for numerous factors like "lack of ownership", "misalignment of interests between the National Assembly and the Executive", "perceived erosion of ministerial powers", "stiff opposition by the petroleum host communities" and "push back by investors on the perceived uncompetitive provisions" in those versions of the bill.

PIB, 2020 is a law in the making, and seeks to introduce far-reaching reforms in the Nigerian oil and gas industry. The purpose of the bill is to establish good governance, best practices, and ease of doing business in the industry, by clarifying roles and responsibilities of officials and institutions. It seeks to enable frontier exploration, mandate improved environmental compliance, and transform the Nigeria National Petroleum Corporation (NNPC), into a commercially viable enterprise. It was aimed at replacing obsolete laws to bring them in alignment with current trends and realities.

The bill proposes the Upstream Regulatory Commission for upstream operations, including the granting of petroleum exploration licenses. The PIB provides for the establishment of the Midstream and Downstream Regulatory Authority for midstream and downstream operations.

Again, the PIB provides for the creation of a Host Communities Development Trust. The oil operators, described as settlors, are obliged to incorporate a trust for the benefit of the host communities and make an annual contribution, based on a certain percentage of their yearly operating expenditure. The regulator will apply the Fund towards the rehabilitation, remediation or management of negative environmental impact only when the licensed operator lacks the capacity, or is unable to effectively undertake the rehabilitation or management of any negative impact on the environment.

Notably, the previous administrations failed to pass the PIB into law because of many factors, including politics, sectional interests, and lack of political will. But a combination of factors, including the commitment of the President Muhammadu Buhari-led administration, host communities and oil and gas operators, enhanced the passage of the Bill. Unlike the past, when community issues were widely condemned, the conversation about Host Community Trust Fund shifted to community representation, the structure of the fund, and equity stakes, making it possible to establish trust and confidence among relevant actors.

Meanwhile, the Senate on Thursday, July 1, 2021 passed the PIB, approving three (3) per cent for host communities. The upper chamber passed the PIB, 2021, after the clause-by-clause consideration of the report of its joint committee on Petroleum (Upstream, Downstream and Gas) on PIB co-chaired by Senator Bassey Albert Akpan.

Before the passage, the Senate was said to have held a closed session with the Minister of State for Petroleum, Timipre Sylva and the Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), Mele Kyari. In his remarks, the president of the Senate, Ahmad Lawan congratulated the lawmakers and said the Ninth National Assembly has achieved one of its fundamental legislative agendum. He said, “The demons (of PIB) have been defeated in this Chamber. We have passed the bill.”

Similarly, the House of Representatives, on same Thursday, passed the PIB, approving five (5) per cent for host communities. This followed the consideration and adoption of the report by the Majority Whip and Chairman of the Ad Hoc Committee on PIB, Mohammed Monguno laid on Wednesday. Monguno, in the said report, prayed the House to consider the report on the ‘Bill for an Act to Provide Legal, Governance, Regulatory and Fiscal Framework for the Nigerian Petroleum Industry, the Development of Host Communities; and for Related Matters, 2021 (HB. 1061) and Approve the Recommendations Therein.’

Speaker of the House, Femi Gbajabiamila, hailed the lawmakers and described the passage of PIB as significant in the history of the parliament. Gbajabiamila said, “Let me use this opportunity to underscore the points made by Hon. Monguno. What this House has just done; if I can score how big what we have just done today, it has been 20 years in the making. This is a product of 360 wise men. I want to commend them for their commitment, their industry and their scholars in producing these 318 sections.”

Question is, how does Senator Albert Akpan been of value to this success? This becomes the main meat of this piece. It was on May 25, 2016, that Senator OBA moved a motion on the floor of the Senate on the need to address Nigeria's economic state. The motion was entitled, “An urgent need to address the present economic state of the nation”. It was the motion that raised the first alarm of Nigeria, irredeemably sinking into economic recession in 2016. The motion informed the decision of the Senate to summon the Minister of Finance, then Mrs Kemi Adeosun and the Central Bank Governor, Mr Godwin Emefiele. They duo had both admitted that the country was helplessly swinging into recession. At that time, in the 8th Senate, Albert Akpan was serving as the Chairman, Senate Committee on Gas.

Time stretched into 2019, when like some of his colleagues, OBA gained re-election. He became the Chairman, Senate Committee on Petroleum Resources Upstream. He was inaugurated on Wednesday, October 9, 2019. While delivering his address in that gathering, OBA regretted the endless tail of the Petroleum Industry Bill (PIB). Piercing the PIB with his 'eyes of possibilities', Senator Bassey Albert submerged himself in the realm of prophecy and pragmatism. He assured stakeholders in the industry that the 9th Senate will surely untie the twisted robes woven around the PIB. He began engagement processes with the Executive and later with Host Communities. He got their inputs for infusion on the final touches of the bill, while yet to be brought to the National Assembly for passage into law. His subsequent appointment as co-chairman, Senate Joint Committee on Petroleum (Downstream) and Petroleum Resources (Upstream), made way for him to blossom and push for the PIB.

It is noteworthy that Senator OBA's intervention brought about the resolution of the long disputed NNPC/Chevron Escravos Gas to Liquid deal in favour of Nigeria. The gains of this deal cannot be quantified as several billions of dollars found their ways into the Nigerian economy.

Albert would remain a referenced point in the Nigeria's red Chambers many years after he may have left. The reason would not be unconnected to his role in getting the Senate to pass its fastest Bill. It was on Thursday, October 3, 2019, when the Senate, through Senator Bassey Albert Akpan, read for the first time, "The Bill to Amend the Deep Offshore and Inland Basin Production Sharing Contracts Act D3 LFN 2004". The Bill was subsequently referred to the Joint Senate Committees on Petroleum Upstream, Gas, Finance, Judiciary and Human Rights, chaired by Senator Bassey Albert Akpan. The bill was passed less than two weeks after its introduction. Upon its passage on Tuesday, October 15, 2019, it was eventually signed into law by President Muhammadu Buhari. The development brought about $1.5billion into the coffers of the Federal Government of Nigeria. The amendment of the Act was to maintain a competitive environment for the oil and gas sector to thrive and to serve as a precursor to passing the Petroleum Industry Bill.

In a press interview shortly after the passage of the Bill, Senator Bassey Albert said, "the Bill is phenomenal, extraordinary and exciting". He added that "it is a new Dawn for Nigeria's oil and gas industry." Albert gave kudos to the Senate and the National Assembly led by the President of the Senate and the Speaker of the House and their entire members. He noted that Nigeria couldn't benefit from the billions of dollars crossing the Sub Sahara Africa because of its obsolete laws. He explained that only clarity of laws, competitive fiscal incentives attract investors.

Senator Albert noted that the passage of PIB by both chambers of the national assembly underscores and sends desired signals that Nigeria was ready for global investment. Assuring the Niger Delta people that the passage of PIB was a clear depiction of democracy, Albert maintained that the development would attract investment, promote peaceful coexistence into the region. He added that through adequate consultations, the Bill has made provision to percentage accruals to be paid directly to the Host Communities.

His words, "Nigeria has been one of the most desirable destinations for the oil and gas industry. This passage of PIB shows that the country is ready to lead the oil and gas investment in Africa. I believe very strongly that whatever we have achieved from the passage of PIB, under the gas flaring penalty is subsumed into ameliorating the sufferings of the host communities, as regards remediation. With the host Community Trust Fund, the communities will now have adequate capacities to develop good fortunes for themselves.

"The fund, together with the 13 per cent derivation from revenue allocation and the efforts of the NDDC will go a long way to cushion the sufferings of the host communities, create peaceful coexistence to ensure smooth activities in the Niger Delta. The Bill has excitingly been received by the oil and gas industries across the country.

"Also, both chambers of the national assembly are expected to harmonize their positions before it is forwarded to the President for assent. The president has assured us that he will send the document into law once it is sent to him. This is victory to every Nigerian, every Niger Delta person and the oil and gas industry. We are now ready to receive the much expected inflow of investment into the Niger Delta region and Nigeria in general", he concluded.

Perhaps, this is why the lawmaker representing Ohaji/Egbema/Oguta/Oru-West Federal Constituency in Imo State at the House of Representatives, Kingsley Chima, has said the passage of the Petroleum Industry Bill is the greatest achievement of the 9th National Assembly. Also, the Managing Director of Vhelbherg, an indigenous oil firm, Mr Bank-Anthony Okoroafor, said the passage of the PIB and the expected assent by the President, would help to bring the country’s oil and gas industry back on track. Okoroafor, who is a former chairman of Petroleum Technology Association of Nigeria, said the passage of the Bill would improve investor's confidence as there would be clarity on the fiscal terms of the industry.

The National Operations Controller, Independent Petroleum Marketers Association of Nigeria, Mr Mike Osatuyi, said the passage of the PIB into law would mark the beginning of the repositioning of the oil and gas industry. “If the President assents to it, then that is the beginning of the reform that we have been expecting in the oil and gas industry. It is the beginning of deregulation in the downstream sector,” he said. He noted that the passage of the PIB would allow market forces to determine petrol prices and curb smuggling of the product.

The outgoing Director-General, Lagos Chamber of Commerce and Industry, Dr Muda Yusuf; National President, Petroleum Products Retail Outlets Owners Association of Nigeria, Billy Gillis-Harry, among others, observed that through the bill, a deregulated downstream oil sector would be achieved, adding that this would boost the fortunes of the country and improve the Nigerian economy.

Meanwhile, further findings reveal that only four (4) per cent of the $70billion investments made in Africa’s oil and gas industry between 2015 and 2019 was in respect of Nigeria, even though it is the biggest producer and has the largest reserves on the continent. A recent report by the National Bureau of Statistics, states that only $53.5m or 0.55 per cent of total investment of $9.680billion in Nigeria in 2020 was made in the industry. If Nigeria must achieve the tall ambition of 40 billion barrels of oil in reserves and four (4) million barrels of oil per day, the need to attract new investments into the sector becomes crucial.

An exhaustive assimilation of the facts here presented, shows Senator Albert as one who had long set targets for himself. While many lawmakers may have failed to record meaningful contributions to the great leap, Albert proves himself as a tested and trusted servant. His involvement in the whole activities places him on an irrefutable podium of fame. To even get to understand that he sponsored the Petroleum Industry Administration Bill, and most importantly, the Gas Flaring Prohibition and Punishment Bill, makes it even clearer that this man had a focus in writing his own history.

Obviously, OBA came as a man from afar, deeply foresighted and scaled through setbacks. And today, through his vision, strong mission statement and determination, he gradually drew himself to the central position. He became a curious servant-leader, willing to make sacrifices to gain access to the state. At last, he found himself not only on the table of decisions but as the chairman of the committee that did all recommendations to the Senate.

Indeed, Senator Bassey Albert Akpan is that centripetal protagonist that has championed the success story of the earth-shaking Petroleum Industry Bill.

TYRANNY: EFCC DISREGARDS COURT ORDER, ASSAULTS LAWYER

The Uyo Zonal office of the Economic and Financial Crimes Commission, EFCC on Friday July 2, 2021 allegedly assaulted a Legal Practitioner and Human Rights Advocate, Barr. Ewa Okpo aka street lawyer at their head office located along Edet Akpan Avenue, Uyo.

According to the street lawyer, a Bailiff from the State High Court, Itu division, Usen Ntem, was at the EFCC office to serve an Ex Parte Motion of the Court granting bail to his client on grounds of Fundamental Human Rights.

At the EFCC office, the Court Bailiff was allegedly prevented from exercising his official duties therefore the legal practitioner as an interested party in the case had to go there personally to prevail upon them to honour the order of court and allow the rule of law prevail.

“I have been to that EFCC office over 10 times on this matter and have shown them professional courtesy so far even when my client has been detained for about 10 days as against the statutory 48 hours that the law permits. Nwandu Kalu, Esq,
of the EFCC Legal Department was the one who ordered that I be thrown out of the premises. Messers Taiwo and Gaius witnessed it,” Barr. Ewa said.

“I had to approach the court as a last resort of ensuring that my client gets fair treatment under the law and thankfully Hon. Justice Ntong F. Ntong of the High Court of Akwa Ibom State, Itu Judicial Division granted our plea”, he further stated.

“The bailiff who went to serve them the order of court was prevented from doing so; I had to intervene by going there to prevail on them to honour the court order; I was physically assaulted, harassed, pushed out of the office alongside the Bailiff and terribly embarrassed”, the lawyer lamented.

The Uyo based legal practitioner cm human rights advocate expressed worry over the fate that befalls ordinary citizens in the hands of the EFCC nowadays if a legal practitioner of his standing could be so disdainfully treated by the anti-corruption firm stating that the presupposition of the law that an accused person is deemed innocent until proven guilty by a court of law still holds water in Nigeria and law enforcement agencies are under obligation to abide by it.

He called on them to exhibit professional courtesy to legal practitioners and members of other professions in the discharge of their duties and explained that he had notified the Akwa Ibom State Chapter of the Nigerian Bar Association of his ordeal and intends to seek redress in court.

BREAKING: Nnamdi Kanu Rearrested, Brought Back To Nigeria



Leader of the Indigenous People of Biafra, Nnamdi Kanu has been rearrested and brought back to Nigeria.

He was intercepted on June 27.

Kanu is expected to be re-arraigned before the Federal High Court for the continuation of his trial.

This was made known at a briefing in Abuja on Tuesday by the Attorney-General of the Federation, Abubakar Malami.

Buhari approves University of Technology for A'Ibom

President Muhammadu Buhari has approved the establishment of two new University of Technology for Jigawa and Akwa Ibom States.

The President also approved a take-off grant of N4 billion each for the Universities of Technology from the funding resources of TETFund to ensure early take-off of the institutions.

The Permanent Secretary at the Federal Ministry of Education, Sonny Echono who disclosed this on Monday in Abuja said the president approved that four existing Universities of Technology loca,ted in Yola, Akure, Owerri and Minna be upgraded and equipped.

He said, “The two new Universities of Technology will be established in 2021 while the upgrade of the existing four Universities of Technology and the National Institute of Technology will come on stream next year.”

The Permanent Secretary said the specialized Universities would lay a solid foundation for building national preparedness and resilience in anticipation of future challenges in the health sector while reducing medical tourism to countries like India, UAE, Egypt, Europe and the USA.

While noting that the presidents had promised to establish an apex National Institute of Technology (NIT) in Abuja with six Satellite Universities of Technology, one in each geo-political zone of the country, he said the objective is to stimulate rapid technological transformation of the country.

“The Institute shall be patterned after similar institutions in Singapore and Malaysia to serve essentially as a postgraduate centre devoted to research and innovation, drawing the best graduates from the six Universities of Technology, as well as other exceptional graduates from reputable universities within and outside Nigeria,” he said.

He however noted that the Federal Ministry of Education will collaborate with the Federal Ministries of Health, Science and Technology, Communications and Digital Economy, the FCT Administration as well as other relevant agencies and Institutions to facilitate speedy actualization of these Projects.

Meanwhile, the Permanent Secretary also hinted to journalists that the president has also approved new chancellors for all universities in the country and that the details will be made available in due course.

Taking A Stand On A Successor

As it is the tradition, the government and the people of Akwa Ibom State marked the May 29 anniversary which was also the 6th anniversary of the current Governor Udom Emmanuel led administration. While delivering his anniversary speech, Governor Emmanuel gave an insight into the kind of successor he does not wish to have. A part of his anniversary speech reads; “Do you want a successor who will cancel out all the great strides in industrialization we have started? The peace we currently enjoy and return us to the years when violence and kidnapping reigned and sowed fear in the hearts and minds of the people? Do you want a successor who will come with anger towards all we have done, as opposed to continuing with the great works we have started?

“Do you want a leader whose approach to testing his popularity would be to drive in a long convoy to “Ibom Plaza” and throw money at the hapless people, watching them scramble for the money and the people would say that’s “Ano owo Mkpo”! Is that the kind of a successor you want? Is that the kind of empowerment our people deserve? Someone who will bring out the worst in our youths rather than challenge them to seize the future and unleash their potentials? Do you want a successor who will relegate God to the background and assume an all-knowing power? Or do you desire a successor with a known e-mail address that the International business community recognises? Do you want a leader who will fritter away our commonwealth in search of cheap popularity or one who would utilize the resources and continue investing in projects with enduring value?

“Do you want a successor who would see Government as a cabal where our commonwealth would be shared among a privileged few or do you desire a leader who would continue to unleash the entrepreneurial spirit of our people, a successor who understands the economic dynamics that shape our globalized space and would utilize those skills to advance our well-being? These are questions you have to provide answers, and the answers you provide would determine the type of a successor you deserve”.

In his wisdom and apparently, in the best interest of the state, the governor appears to be searching for a successor without blemish; one who has never conceived any evil, never done any wrong, and never spoken any bad. A successor who will be a saviour of the people like Jesus, build an ark to protect the people like Noah, and part the red sea for the people like Moses. As a firm believer of the Bible, the governor seems to believe that only a Joshua who can command the sun to stand still or an Ezekiel who can speak live into dry bones, deserves to be handed the mantle of leadership of Akwa Ibom come 2023. As a religious people, we cannot agree any less. But the governor’s intentions would make absolute sense if religion was the fulcrum, the crux and the only essence of governance.

Only weeks ago, the governor had caused a buzz when he insinuated that at the appointed time, God will reveal his successor to him. Ordinarily, every passing day would mean that the state was edging closer to the said appointed time. So the expectation of the people has been to wake up one morning to a clear and concise pronouncement by the governor. Apparently, while the state is wallowing in anticipation as we wait for the revelation, the governor has chosen to give some jaw-dropping clues on those he considers unworthy to be his successor. From the ones whose hands are too filthy to touch the mantle of leadership to those whose minds are too deceitful to bear the thoughts of becoming his successor, the governor seems to have sealed their fate in absolute finality.

In his exact words; “So my dear Akawa Ibomites, if what you are desiring is a successor who will not have the capacity and the discipline to build a State where you and your children will live in peace and strive to excel, if you are desiring a successor who will turn back the clock of our developmental strides, if you are desiring a successor who will bring out the worst in our youths as opposed to galvanizing their energies and challenging them to be the best they can be, if you are desiring a leader who would not efficiently utilize the resources of this State on projects that have redeeming value then I am sorry to disappoint you, God will not give us such a successor”.

The governor is our heavenly-ordained leader, so his word is commandment. But before I begin to forge these commandments into my heart, it necessary to ask pertinent questions like, are these ones condemned really guilty? Have they had opportunities to serve the people and they failed? Which is more superior in deciding who becomes what in 2023, is it the constitutional provision or the governor's criteria? To the best of my knowledge, nobody chose to be called “ano owo mkpo”. Rather, this name came as a referendum following the collective decision of the masses. So, will a man now be condemned simply because he found favour with his people? And most importantly, how can we be religious on the one hand, and then support the condemning of cheerful giving on the other hand? We have lived with these people for years and can testify to their genuine love for the masses and benevolence nature.

Truth is, all the attributes of a-not-to-be wanted successor listed in the governor's anniversary speech are subtle biases against select persons, of which every administration of this state is guilty of including the present. A case in point is the governor’s analogy of government as a cabal. The question is, from the days of Obong Victor Attah through the Chief Godswill Akpabio years to the present Deacon Udom Emmanuel led administration, which government has not been controlled by a cabal? Despite the state-sponsored religiosity we are witnessing today, cult-related crisis and other vices perpetrated by misguided youths are still spreading across the state, so the claim that any particular person will bring out the worst in our youths should he become the governor, is sheer bias. Even the genuine efforts that people dedicated to defending the state in the face of a ruthless opposition are now counted against them.

Again, how is a leader stopping by Ibom Plaza to interact with Akwa Ibom people a wrong approach to testing popularity but another leader stopping by Itreto Junction to buy corn from women, the right approach? How is one leader throwing money at people and watching them scramble for the money more demeaning to the people than another leader inciting the protesters against themselves with money and watching the entire state being shamed all over the country? How convenient is it for the same source that preaches peace, unity and love, to spread animosity, bias and grudge? It is my opinion that too much unnecessary energy has been expended to sever the bond between Akwa Ibom people and some select persons because of 2023, yet nothing tangible is done to woo the masses to the side of the yet to be known preferred successor.

The governor has given his own criteria for a successor, and thankfully, he has given Akwa Ibom people the liberty to decide what they want. Not too long ago, Akwa Ibom was in her darkest times in the name of election. Hopefully, in making their decision ahead of 2023, the people will not forget in a hurry those who stuck their neck for this state in 2019. The people will not forget those who inspired young people across the state to brace themselves and confront terror with their bare hands. They will not forget those in whose names they went to war in 2019, and who they have known long and well enough to inspire them again in 2023. The people cannot be certain that the governor’s criteria of his successor would not change few years after he has left office should the relationship sour just like it happened between him and his predecessor. So the people must have and stand by their own criteria of a successor - only then will the election truly be about who they want and not who is imposed on them.

Ahead of the 2015 governorship election in the state, we witnessed how the then governor demolished those who were going to be serious contenders in the election just to pave way for his preferred successor. We had hoped that never again would the state unleash such brute aggression against her own people. Sadly, ahead of 2023, it is becoming increasingly clear that we might be going back to where we left eight years ago. It usually begins with bad-mouthing like we saw during the anniversary speech, then a little force is applied and little more is added. So, to the governor’s question on what kind of successor I want as an Akwa Ibomite. My answer is, I want a successor who would come from a fair process and not one who would need others to be demolished for him to stand.
