EXTINCIÓN DE DOMINIO DE VEHÍCULO.

 La defensa se asumió luego que se interpusiera la Demanda por la Fiscalía Provincial Transitoria en Extinción de Dominio de
Ayacucho.

 Presupuesto: bien mueble (vehículo) como instrumento de la comisión de actividades ilícitas.

👉 Argumentos principales:

📌 ⁠Ausencia de vinculación del propietario con el uso indebido del vehículo.

📌 Inexistencia de alta probabilidad que el insumo químico no controlado tenía como destino la elaboración de dr**as tóxicas.

💡EL ELEMENTO SUBJETIVO REQUIERE ACREDITAR EL PROPÓSITO DE DEFRAUDAR A LA ADMINISTRACIÓN, DE SUERTE QUE SI ÉSTE NO CONSTA PROBADO LA CONDUCTA NO RESULTARÁ PUNIBLE 💡

NO HAY DOLO SI:

✅SE TRATÓ DE UN PROCESO QUE SIGUIÓ SUS PROPIOS PASOS DESDE LA LEGISLACIÓN SOBRE INVERSIÓN PÚBLICA Y ASOCIACIONES PÚBLICO PRIVADAS, AUNQUE INCUMPLIÉNDOLA, PERO NO SE OCULTÓ NI FUE CLANDESTINO, QUE FUE LO QUE A FINAL DE CUENTAS DETERMINÓ LA INTERVENCIÓN DE LAS AUTORIDADES NACIONALES Y LA ANULACIÓN DEL CONTRATO.

✅ O AFECTÓ LA LIBRE CONCURRENCIA E INTERVINIERON LAS ÁREAS COMPETENTES DEL GOBIERNO REGIONAL DE JUNÍN, MÁS ALLÁ DE QUE LOS ÓRGANOS NACIONALES, DEL GOBIERNO NACIONAL, NO FUERON CONVOCADOS COMO SE DEBÍA.

✅ A LOS FUNCIONARIOS PROCESADOS ADMINISTRATIVAMENTE SE LES ABSOLVIÓ.

✅ NO HUBO SIQUIERA ACCIONES JUDICIALES ANTE LA ANULACIÓN DEL CONTRATO POR PARTE DE ONSORCIO AFECTADO.
