IMPORTANT LAW REFORMS IN PAPUA NEW GUINEA

*ICAC is off the ground, passed in 2014 but struggling to get an organic law up
*ICAC targets lawyers as well. Not just public servants. If a lawyer signs a contract that is tainted. The lawyer can be held unaccountable. ICAC extends beyond the public sector
*The Whistle blowers Act was set up before ICAC. But what is the difference between the Whistle Blowers Act and the Cyber Crime Act. Note the Whistle Blowers Act is only for Public Servants
*The Electronic Transaction Act. When you are purchasing stuff online from overseas and the cargoes do not arrive, this law protects you and it links with the Evidence Act
*Claims by and against the state. The National and Supreme Court judgments are not consistent with the Section5 notice form. Watch and listen to the details on the amendments
*The Wrongs Act amended. This act was amended to hold public servants accountable for the damage done. They pay for the liabilities for damage up to 50%
*Lawyers Act amended after 30 years. Lawyers who are major clients of the state to review their URP after every five years. There will be conditions to meet eg contributions to community. Lawyers who committed crimes to be removed from the practicing law. There are new conditions for admission to the bar after graduating from LTI. There is a fit and proper persons test
* The Paul Paraka Saga. It's a sad story and an indictment on the law profession. How can the country avoid such incidents in future
*There have amended the Attorney Generals Act. Include a committee to look at state brief outs. It cannot be made by the Attorney General alone.
*Lawyers cannot get judgments from the courts against the state and run straight to the Finance and Treasury Departments.
