Verily, Tan-Andal is a welcome development to help both men and women trapped in a loveless marriage where the marital duties are no longer fulfilled because of deep-rooted psychological incapacities. Where there is no longer love and respect, but violence, disdain, pain, and infidelity, the protection that the law provides on the sanctity of marriage serves no longer as a bond of harmonious union, but a bo***ge of suffering. Preserving such marriage is antithetical to the kind of partnership and celebration of love we have in our laws, traditions, and beliefs as a society. To be sure, there is no marriage here to protect and save in the first place, as the same is void from the very beginning.

(REMEDIAL LAW) 𝐉𝐔𝐒𝐓𝐈𝐂𝐄 𝐀𝐌𝐘 𝐂. 𝐋𝐀𝐙𝐀𝐑𝐎-𝐉𝐀𝐕𝐈𝐄𝐑 𝐏𝐄𝐍𝐍𝐄𝐃 𝐂𝐀𝐒𝐄: Colmenar v. Colmenar, G.R. No. 252467, (2021) [Per J. Lazaro-Javier]

A cause of action is defined as an act or omission by which a party violates a right of another. A complaint states a cause of action if it sufficiently avers the existence of the three (3) essential elements of a cause of action, namely: (a) a right in favor of the plaintiff by whatever means and under whatever law it arises or is created; (b) an obligation on the part of the named defendant to respect or not to violate such right; and (c) an act or omission on the part of the named defendant violative of the right of the plaintiff or constituting a breach of the obligation of defendant to the plaintiff for which the latter may maintain an action for recovery of damages. If the allegations of the complaint do not state the concurrence of these elements, the complaint becomes vulnerable to a motion to dismiss on the ground of failure to state a cause of action.

ACQUISITION OF JURISDICTION OVER IMPEACHMENT CASE BY JUDGE MARLO CAMPANILLA
Under the Constitution, once the House of Representatives impeached an impeachable officer by filing an Article of Impeachment or a verified complaint signed by at least one-third of its members, "trial by the Senate shall forthwith proceed." The words "shall" and "forthwith" means that the Senate has the obligation to try a high ranking public officer impeached by the House of Representatives. The imposition of obligation to conduct impeachment trial presupposes the conferment of jurisdiction to try it. To perform its obligation and exercise jurisdiction to try an impeachment case, it is submitted that there is no need for the Senate to convert itself into an impeachment court because the two are not separate entities. In fact, the words "impeachment court" is not mentioned in the Constitution. Hence, to acquire jurisdiction, it is not indispensable that the Article of Impeachment is received by the Senate as an Impeachment Court where the Senators had already took their oath as impeachment judges. The wordings of the Constitution is simple. Once the House impeached an impeachable officer, trial by the Senate shall forthwith proceed. To interpret this provision in such a manner that will prevent the Senate from doing its obligation to try an impeachment case will defeat the constitutional objective on public accountability.
