Introduction to Juvenile Justice
1.Legal framework: *Republic Act 9344* (Juvenile Justice and Welfare Act of 2006, as amended by R.A. 10630).
โ๏ธ Purpose: To protect the rights of children in conflict with the law (CICL) and children at risk (CAR).
โ๏ธFocus: Rehabilitation and reintegration, not punishment.
2. Children in Conflict with the Law (CICL)
โ๏ธ Defined as individuals below 18 years old who allegedly committed an offense.
โ๏ธ Exemptions from criminal liability:
Children below 15 years old are exempt but subject to intervention programs.
โ๏ธDiversion programs: For children above 15 but below 18, depending on discernment and type of offense.
3. Children at Risk (CAR)
โ๏ธ Those exposed to circumstances that make them vulnerable to committing offenses (e.g., abuse, neglect, out-of-school, substance abuse, street situations).
Early intervention and community support are essential.
4. Intervention Programs
Community-based Counseling, skills training, formal/informal education, livelihood, sports, arts, and cultural activities.
Family-based: Parenting sessions, family therapy, strengthening parent-child relationships.
Institutional programs (only if necessary): Rehabilitation centers, foster care, and other accredited facilities.
5. Diversion Programs
Implemented for minor offenses to avoid formal court proceedings.
Examples: Apology, restitution, community service, participation in educational and development programs.
Conducted at the barangay, police, prosecutor, or court level depending on gravity of the case.
6.Roles of Stakeholders
Barangay Establish BCPC (Barangay Council for the Protection of Children) and ensure immediate intervention.
Local Government Units (LGUs) Provide support services, facilities, and funding for programs.
Parents/Guardians.Active participation in rehabilitation.
Schools, NGOs, Faith-based group. Provide supplementary programs and monitoring
7. Rights of the Child
* Right to dignity and humane treatment.
* Right to education, health, and social services.
* Right to privacy and confidentiality.
* Prohibition of torture, cruel or degrading treatment, and detention with adults.
8. Reintegration and Aftercare
โ๏ธEnsuring CICL and CAR return to school, family, and community.
โ๏ธSkills and livelihood programs for sustainable reintegration.
โ๏ธContinuous monitoring and mentoring.
