The Supreme Court (SC) has ruled that in drug cases, prosecutors must raise all their objections when an accused offers to plead guilty to a lesser crime. Any objections not raised are considered waived.

In a Decision written by Associate Justice Japar B. Dimaampao, the SC 𝘌𝘯 𝘉𝘢𝘯𝘤 reinstated the Regional Trial Court’s (RTC) ruling that found Rodulfo Ferraren Aquino (Aquino) guilty of illegal possession of drug paraphernalia under Section 12 of R.A. No. 9165, or the 𝘊𝘰𝘮𝘱𝘳𝘦𝘩𝘦𝘯𝘴𝘪𝘷𝘦 𝘋𝘢𝘯𝘨𝘦𝘳𝘰𝘶𝘴 𝘋𝘳𝘶𝘨𝘴 𝘈𝘤𝘵 𝘰𝘧 2002.

The SC also updated its 𝘊𝘭𝘢𝘳𝘪𝘧𝘪𝘤𝘢𝘵𝘰𝘳𝘺 𝘎𝘶𝘪𝘥𝘦𝘭𝘪𝘯𝘦𝘴 𝘰𝘯 𝘗𝘭𝘦𝘢-𝘉𝘢𝘳𝘨𝘢𝘪𝘯𝘪𝘯𝘨 𝘪𝘯 𝘋𝘳𝘶𝘨𝘴 𝘊𝘢𝘴𝘦𝘴 as set forth in the 2022 case of 𝘗𝘦𝘰𝘱𝘭𝘦 𝘷. 𝘔𝘰𝘯𝘵𝘪𝘦𝘳𝘳𝘰, by adding the following guidelines:

1. If the prosecution objects to a plea bargaining motion but cites only some possible grounds, any other ground not raised is considered waived.

2. If the prosecution raises several objections, but the trial court addresses only one, the appellate court or the SC shall direct the trial court to resolve the remaining issues based on the Montierro guidelines and this case.

3. If the records before the appellate court or the SC are incomplete and it is unclear whether either of the above scenarios applies, the trial court shall be directed to rule again on the matter, applying the principles in 𝘔𝘰𝘯𝘵𝘪𝘦𝘳𝘳𝘰 and this case.

Aquino was charged with selling and possessing shabu. He asked the RTC to allow him to plead guilty to a lesser crime, illegal possession of drug paraphernalia, for both charges. The prosecution agreed to the plea bargain for the possession charge but objected to the plea for the drug sale charge, saying it violated Department of Justice (DOJ) rules. The RTC, however, granted Aquino’s plea.

The SC, agreeing with the RTC, reiterated the 𝘔𝘰𝘯𝘵𝘪𝘦𝘳𝘳𝘰 ruling that courts may reject the prosecution’s objection to a plea bargain in drug cases if the only reason for the objection is that the plea violates rules, provided the plea follows the SC’s official plea bargaining framework.

However, the SC also clarified that courts do not have unlimited authority and cannot reject the prosecution’s objection if it is based on valid grounds, such as if the accused is not qualified for plea bargaining, or if the plea does not follow the SC’s approved guidelines.

READ || Reclusion perpetua ang hatol ng korte kay Ronces Paragoso, alyas "Ka Aiza" sa kasong rebellion

Hinatulang guilty beyond reasonable doubt ng korte si Ronces Paragoso, alyas “Ka Aiza,” bilang co-principal sa kasong rebellion sa ilalim ng Article 135 ng Revised Penal Code na naamyendahan ng Republic Act No. 6968. Ang hatol sa kanya ay reclusion perpetua at lahat ng accessory penalties nito.

Ayon sa desisyon ng korte, hindi lamang siya nagpropaganda ng komunismo sa Palawan kundi naging pangunahing tagapagtaguyod ng mga aktibidad ng Communist Party of the Philippines-New People's Army (CPP-NPA) at Kabataang Makabayan. Malinaw umanong nailahad sa pagdinig ng kaso na si Paragoso ay nagre-recruit ng mga bagong miyembro para sa armadong kilusan at nagdirekta ng mga pag-atake laban sa mga "duly constituted authorities."

Samantala, tatlo pa ang hinatulang guilty noong December 12 na sina Joemelito Tanilon na kilala bilang "Ka Tangkad", Bener Rimbunan o "Ka Bata," at Awing Lumpat na tinatawag ding "Ka Gitna" ang hinatulan ng reclusion perpetua o 40 taong pagkakabilanggo kaugnay ng dalawang kasong kriminal sa ilalim ng Republic Act 9516.

Ang mga kaso ay kaugnay ng paglabag sa Section 1 (Unlawful Manufacture, Sales, Acquisition, Disposition, Importation or Possession of an Explosive or Incendiary Device) at Section 2 (Unlawful Manufacture, Sales, Acquisition, Disposition, Importation or Possession of a Part, Ingredient, Machinery, Tool or Instrument Used or Intended to be Used for the Manufacture, Construction, Assembly, Delivery or Detonation) ng RA 9516.

Matatandaan na kasama sila sa pitong miyembro ng NPA na naaresto noong October 4, 2019, sa National Road sa Barangay San Jose, Puerto Princesa City. Ang ilan pa ay sina Glendyl Malabanan (alyas Ka Meldy, Marjo, Michelle, at Roxanne," Antonio Molina (alyas Domingo Ritas, at Ka Tino) na nasawi dahil sa cancer, at si Jenny Ann Bautista, (alyas Ka Maron, Helen, at Nada).

Patungo sana sila sa southern Palawan mula sa San Vicente ng ma-checkpoint sa San Jose bandang 11 p.m. ng mga pinagsanib na puwersa ng pulisya at militar.

Why did it take our government more than a century to finally make a real and possibly decisive impact on the CPP-NPA-NDF insurgency?

For decades, the Armed Forces of the Philippines (AFP) focused almost exclusively on the armed component of the movement.

In 2019 alone, the AFP reported neutralizing 3,007 insurgents after a two-year campaign. Yet, upon review, it was found that the NPA's overall strength had decreased by only six members compared to its 2017 baseline. This indicates that while thousands were neutralized, just as many were recruited to take their place.

This cycle of replenishment is largely sustained by foreign funding and domestic extortion. Organizations like BAYAN-Europe raise millions—funds that are funneled into propaganda efforts and recruitment drives, particularly targeting students and youth in schools.

These aren’t small amounts—we’re talking about hundreds of millions of euros, equivalent to billions of pesos.

In Germany, at least 14 church-based organizations—knowingly or unknowingly—contribute donations to NGOs and groups affiliated with the CPP’s Christians for National Liberation (CNL). These include organizations such as Diakonie, Evangelische Kirche, Brot für die Welt, EED, and others.

That’s why Secretary Año is right—these funding sources must be cut off through appropriate legislation.

Such a law is also necessary to ensure that legitimate NGOs, which genuinely help our marginalized communities, can continue their vital work.

So, Leila, before you start drafting your usual Red-tagging narrative, maybe you should understand this first.

We know the NTF-ELCAC's counter-propaganda and anti-terrorist financing strategies are working—because even Joma Sison was driven to tears before he finally passed.
