Bayan Muna urges more consultation on the Magna Carta of Filipino Seafarers

Bayan Muna Chairman and former Congressman Neri Colmenares today urged Pres. Ferdinand Marcos and the Department of Migrant Workers (DMW) to conduct more consultations with stakeholders, especially seafarers, on the IRR of the Magna Carta for Seafarers.

“The Magna Carta for Seafarers suffers from various procedural and substantive infirmities which resulted in the continued disagreements between the seafarers and the Marcos administration. The disagreements were so serious that the previous consultations have been tumultuous, and the Department of Migrant Workers represented by Asec. Jerome Pampolina failed to steer the consultations to a successful and amicable conclusion," he said

"We call on the DMW to conduct more consultations with stakeholders, especially with seafarers who express their opposition to the law and the current IRR draft, even if they are supposed to be the alleged beneficiary. Refusal of the DMW to conduct effective consultations will only generate more animosity and challenges against the Magna Carta from the very beneficiaries themselves” said Bayan Muna former Congressman Neri Colmenares.

“The IRR included a provision requiring workers who won their cases for compensation against manning agencies and shipowners, to pay a bond before they can get their compensation. Ang mga seafarers na wala nang trabaho dahil sa injuries, ay pagbabayarin pa ng bond kahit sila ay panalo na? Hindi ba kayo naawa sa mahihirap na seafarers na pati ang napanalunan na nila sa kaso ay hindi pa nila matatamasa? This is not a magna carta for seafarers but a magna carta for the rich and powerful manning agencies and ship owners.” he added.

“We were informed that the opposition not only came from the seafarers, but also other stakeholders like maritime institutions and schools, as well as government agencies like DOLE. We ask DOLE, and other stakeholders, not to give in to pressures and maintain its opposition to the law and the IRR," he said

"We ask DMW not to railroad the consultation and continue to pursue consultations as termination of the consultation will practically negate the supposed intention of the magna carta. Ang laban ng dehadong mamamayan ay nasa korte, kongreso at kalsada. We ask DMW not to force the stakeholders to pursue judicial challenges against the law, tumultuous congressional debates to amend the law and rallies against the law that was originally intended for the good of seafarers” ended Colmenares.

Seafarers' Group Demands DMW Asec Pampolina to Inhibit from Magna Carta Drafting Over Conflict of Interest

The Concerned Seafarers of the Philippines (CSP) is calling on Atty. Jerome T. Pampolina, Assistant Secretary for Sea-based OFW Concerns at the Department of Migrant Workers (DMW), to voluntarily inhibit himself from the drafting of the Implementing Rules and Regulations (IRR) for the Magna Carta for Filipino Seafarers due to a significant conflict of interest.

In a letter addressed to DMW Secretary Hon. Hans Leo J. Cacdac, CSP highlighted Pampolina’s past association with the Del Rosario Law Office, a leading firm that represents manning agencies and foreign principals. The organization raised concerns that this affiliation could compromise the fairness of the IRR process, stating, "We humbly submit that it is our perception that Atty. Pampolina suffers from a conflict of interest as the IRR that he is drafting appears to us to be too favorable to the local manning agencies and their foreign principals."

"We firmly believe that Atty. Pampolina's involvement poses a serious conflict of interest that must be addressed to ensure that the rights and welfare of Filipino seafarers are not compromised," stated Engr. Jose Xavier Bayoneta, Chairperson of CSP. "We urge him to step back from this role and allow for a transparent and equitable drafting process."

CSP is also advocating for an additional round of consultations to ensure the concerns and needs of seafarers are fully represented. The letter detailing this request will be furnished to President Ferdinand R. Marcos Jr., the Office of the Ombudsman, and other relevant government agencies.

As the maritime industry faces ongoing challenges, the Concerned Seafarers of the Philippines remains committed to protecting the rights of Filipino seafarers and ensuring their voices are heard in all regulatory matters.

A FORMER lawmaker has asked President Ferdinand Marcos Jr. and the Department of Migrant Workers (DMW) to conduct more consultations with stakeholders, especially boatmen, on the implementing rules and regulation (IRR) of the Magna Carta for Seafarers (MCFS).

Seafarers to DMW exec: Inhibit from Magna Carta IRR

MANILA, Philippines — Due to an alleged conflict of interest, a group of seafarers has asked Department of Migrant Workers (DMW) Assistant Secretary Jerome Pampolina to inhibit from drafting the implementing rules and regulations (IRR) of the Magna Carta for Filipino Seafarers.

The Concerned Seafarers of the Philippines (CSP) cited Pampolina’s past association with a law firm representing manning agencies and foreign principals.

“We believe that Pampolina’s involvement poses conflict of interest that must be addressed to ensure that the rights and welfare of Filipino seafarers are not compromised,” CSP chairman Jose Xavier Bayoneta said in a letter to DMW Secretary Hans Cacdac.

“We urge him to step back from this role and allow for a transparent IRR drafting process,” Bayoneta added.

According to CSP, the drafting of the IRR appears to favor local manning agencies and their foreign principals.

The group asked for another round of consultations to ensure that the concerns of seafarers are fully represented.

The CSP intends to furnish President Marcos, the Office of the Ombudsman and other relevant government agencies a copy of the letter.

Bayan Muna chairman and former representative Neri Colmenares also urged Marcos and the DMW to conduct more consultations with stakeholders on the IRR of the Magna Carta for Filipino Seafarers.

Colmenares noted that various procedural infirmities resulted in continued disagreements between the seafarers and the Marcos administration.

“The DMW, represented by Assistant Secretary Pampolina, failed to steer the consultations to a successful and amicable conclusion,” he said.

Colmenares said the refusal of the DMW to conduct consultations would only “generate animosity and challenges against the Magna Carta from the beneficiaries themselves.”

He criticized a provision of the IRR that he said does not help seafarers but rather the manning agencies and ship owners, resulting in opposition by seafarers, maritime schools as well as the Department of Labor and Employment (DOLE).

Colmenares urged DOLE and other stakeholders not to give in to pressure and to maintain their opposition to the law and the IRR.

A SEAFARER'S group urged on Saturday an official of the Department of Migrant Workers (DMW) to inhibit himself from drafting the implementing rules and regulations (IRR) of the Magna Carta of Filipino Seafarers (MCFS).

In a letter addressed to DMW Secretary Hans Leo Cacdac, the Concerned Seafarers of the Philippines (CSP) called on Atty. Jerome Pampolina, assistant secretary for Sea-based OFW Concerns at the DMW, to inhibit himself from drafting the IRR of the MCFS for conflict of interest.

Citing Pampolina's past association with the Del Rosario Law Office, a leading firm that represents manning agencies and foreign principals, the CSP raised concerns that this affiliation could compromise the fairness of the IRR process.

AMOR SEAMAN THANKS LAWMAKERS FOR REMOVING "EX*****ON BOND" AND "ESCROW PROVISION", PLEADS PRESIDENT MARCOS JR. TO SIGN THE MAGNA CARTA FOR FILIPINO SEAFARERS ASAP

Association of Marine Officers and Ratings, Inc. (AMOR Seaman), a group of Filipino seafarers thanked Senate President Chiz Escudero, Sen. Raffy Tulfo, Sen. Koko Pimentel, and Sen. Risa Hontiveros, as well as lawmakers in the bi-cameral committee for the deletion of the controversial provision in the Magna Carta for Filipino Seafarers that would have mandated the payment of the "ex*****on bond" as a victory for seafarers.

AMOR Seaman also expressed elation about the removal of the the ex*****on bond because they believe it’s prejudicial to and discriminatory against all Filipino seafarers especially to disabled and sick seafarers.

Oiler seaman Jacinto Rivera, spokesperson for AMOR Seaman said, "We are now pleading for President Ferdinand Marcos Jr. to sign the latest version of the Magna Carta for Filipino Seafarers without the ex*****on bond and the escrow provision. We believe our good president will help us and sign the Magna Carta for Filipino Seafarers to ensure our rights, protection and welfare."

In the previous version of the Magna Carta for Filipino Seafarers, the controversial escrow provision was removed but an ex*****on bond was included, which said the seafarer may move for the ex*****on of the monetary award pending appeal upon posting of a bond.

Rivera explained that a seafarer seeks payment of monetary benefits because of his medical condition. Many Filipino seafarers are sick, disabled, and are in big debts because they have to sustain their medication. Sadly, others die before the Supreme Court releases its final judgment on their case.

The aggrieved seafarer, Rivera said, will be forced to redirect his money to the unjust ex*****on bond. Common sense tells us the poor and sick seafarer’s money should be used for his medication and for immediate needs of his family. The ex*****on bond therefore further puts in danger the economic well-being of the seafarer.

Rivera explained that the ex*****on bond provision is truly violative of the equal protection clause, anti-labor and anti-OFW, making it very difficult for the seafarers to receive the winning award.

"That’s why AMOR Seaman expressed both joy and relief upon hearing the good news that the bi-cameral committee removed the escrow and ex*****on bond in the Magna Carta for Seafarers Bill, "Rivera added.

AMOR Seaman also praised DOLE Secretary Bienvenido Laguesma and DOJ Secretary Crispin Remulla for their stance against the said provision in the Magna Carta for Seafarers Bill.

Labor groups hail removal of ‘escrow’ in Magna Carta for Filipino Seafarers Bill; urge PBBM to sign law

Labor groups Federation of Free Workers (FFW) and the Association of Marine Officers and Ratings, Inc. (AMOR Seaman), hailed the bicameral committee of the two Houses of Congress for deleting the controversial provision in the proposed Magna Carta for Filipino Seafarers Law that would have mandated the payment by seafarers of an "ex*****on bond" to receive money claims they have already won in court.

“This is a victory for seafarers,” said Jacinto Rivera, spokesperson of AMOR Seaman. "We are now pleading for President Ferdinand Marcos Jr. to sign the latest version of the Magna Carta for Filipino Seafarers without the ex*****on bond and the escrow provision,” added Rivera, who is an oiler seaman.

Both Houses of Congress need to approve the bi-cameral conference report before it submits it to the President for enactment into law.

Congress has been in hot water for inserting an “escrow” provision in the bill that would have prevented seafarers from receiving their money claims despite winning their cases in the lower courts, if such cases are pending appeal in higher courts. Congress later on replaced the provision with an “ex*****on bond” that would have required seafarers to post a bond to receive what is due them after wining a case, if employers appeal the decision.

“Both the ‘escrow’ and ‘executive bond’ provisions are discriminatory, a violation of the equal protection clause of the Bill of Rights, since no such requirements are mandated on land-based OFWs and workers based in the Philippines. Thus, it has no basis in law, jurisprudence or practice. It will set a bad precedent and deprive seafarers of equal protection from the law,” said Atty Sonny Matula, president of the FFW.

AMOR Seaman also elation over the bi-cameral conference’s decision.

“We believe the ‘escrow’ and ‘executive bond’ provisions are prejudicial to and discriminatory against all Filipino seafarers especially to disabled and sick seafarers,” said Rivera.
