The Supreme Court's ruling in Mangudadatu vs. COMELEC clarified that when a winning candidate's certificate of candidacy is cancelled after the election, the second placer cannot be proclaimed. Instead, the vacancy must be addressed through the succession mechanism under the Local Government Code. This doctrine, however, was crafted specifically in the context of local elective positions, such as governor or mayor, where succession is governed by Section 44 of the Local Government Code.

That framework does not apply to the case of Congressman Benny Abante. A seat in the House of Representatives is a national position and is not governed by the Local Government Code. Rather, it falls under the exclusive jurisdiction of the House of Representatives Electoral Tribunal, as provided in Article VI, Section 17 of the 1987 Constitution.

The rules on succession that justified the Court's abandonment of the second placer rule in Mangudadatu are not available in cases involving congressional positions, simply because there is no "vice congressman." The calling of a special election in case of vacancy under Section 7 of the Omnibus Election Code shall be subject to the determination of the HRET.

To apply the Mangudadatu ruling to Congressman Abante would be a misreading of its scope. The legal basis for the decision rests entirely on the structure of local governance. Congressional contests must continue to be resolved within the framework of constitutional law and national electoral jurisprudence.

BREAKING NEWS: The Commission on Elections (Comelec) Second Division voids the congressional candidacy of Joey Uy and declares incumbent Rep. Benny Abante as the “duly elected” congressman of the sixth district of Manila City.

"Respondent (Uy) is considered a non-candidate and his COC (certificate of candidacy) is void ab initio. Proclamation of respondent is annulled," the Comelec said in a statement, citing the decision of the Comelec Second Division.

Hindi sapat na nanalo ka sa boto — kung hindi ka naman kwalipikado sa ilalim ng batas.

📂 Ayon sa mga dokumento, si Joey Uy ay ipinanganak noong 1962.
👉 Ang tatay niya ay Chinese citizen.
👉 Ang nanay niya — dating Filipino — ay nawalan ng citizenship at naging Chinese citizen din nang ikasal sa ama niya.

✋ Dahil dito, hindi siya natural-born Filipino.
Ang citizenship ng isang bata ay base sa citizenship ng magulang sa panahon ng kapanganakan.
