Maaari na ba akong sumali sa homeowner’s association ng aming lugar kahit na lupa pa lang pagmamay-ari ko sa nasabing subdivision? – Helen
Dear Helen,
Ang batas na nakasasaklaw sa iyong katanungan ay ang Republic Act No. 9904 o mas kilala sa tawag na “The Magna Carta for Homeowners and Homeowners Associations.” Ayon sa Section 3 (j) ng nasabing batas:
“(j) “Homeowner” refers to any of the following:
An owner or purchase of a lot in a subdivision/village;
Dagdag pa ng Section 5 (a) Rule II, The 2021 Revised Implementing Rules and Regulations ng parehong batas:
“Section 5. Commencement of Homeownership. Homeownership begins:
By owning a lot in a subdivision/village and other real estate development for residential purposes;
b. By purchasing a lot and/or unit in a subdivision/village and other similar real estate development project for residential purposes;
c. By being an awardee, usufructuary, or legal occupant of a unit, house and/or lot in a private, non government or government socialized or economic housing or relocation and/or resettlement project and other urban estates;
and
d. By being a prospective beneficiary or awardee of ownership rights under the CMP, LTAP, and other similar programs.”
Samakatuwid, ayon sa batas, ang homeownership ay magsisimula kung ang isang tao ay magiging may-ari ng isang lupa sa isang subdivision o village. Kaya naman, mula sa oras ng pagbili ay maituturing na siyang homeowner. Ibig sabihin, ikaw ay itinuturing na isang homeowner dahil nakabili ka ng lupa sa isang subdivision. Bilang isang homeowner, maaari ka nang maging miyembro ng inyong homeowner’s association, kahit na hindi mo pa napatatayuan ng bahay ang iyong lupa.
