Mula Kay Miriam Hanggang Kay Robin: Ang Trahedya ng Constitutional Decline

Isang dekada ang nakalipas mula nang pamunuan ni Miriam Defensor Santiago—isang huwarang constitutionalist, international judge-elect sa International Criminal Court, at may PhD sa juridical science mula sa University of Michigan—ang Senate Committee on Constitutional Amendments and Revision of Codes. Ang komiteng ito ang siyang pangunahing tagapagrepaso ng mismong pundasyon ng ating batas: ang Konstitusyon ng Republika ng Pilipinas at mga koda ng pambansang batas. Sa madaling salita, ito ang gatekeeper ng mga pagbabago sa ating Saligang Batas, ang pinakabanal na dokumento ng ating soberanya.

Ngayong 2025, ang parehong komite ay pinamumunuan na ni Robin Padilla, isang dating action star na walang track record sa jurisprudence, walang karanasan sa legislative drafting, at ni wala mang law degree. Kung si Miriam ay tinaguriang "walking constitution," si Robin ay tila naging simbolo ng wandering confusion.

Dati, ang mga pagdinig ay parang constitutional colloquium. Ngayon, parang improv workshop. Kung noon ang mga deliberasyon ay nakasandig sa constitutional law, legal theory, at comparative jurisprudence, ngayon ay nababahiran ng personal na paniniwala, emosyon, at folk nationalism na walang matibay na batayang legal.

Ang tungkulin ng komiteng ito ay hindi lamang suriin ang panukalang pag-amyenda sa Konstitusyon kundi tiyakin na ang anumang pagbabago ay sumusunod sa proseso sa ilalim ng Article XVII ng 1987 Constitution. Saklaw din nito ang pagsusuri sa mga koda o codified laws tulad ng Civil Code, Revised Penal Code, Family Code, at iba pa na pundasyon ng ating legal system. Sa ilalim ni Miriam, bawat mungkahi ay dumadaan sa rigorous scrutiny. Sa ilalim ni Robin, dumadaan ito sa TikTok-level rhetoric.

Ang tinatawag na “revision of codes” ngayon ay hindi na tungkol sa batas kundi sa pagbaba ng pamantayan. Mula Rule of Law patungo sa Rule of Personality.

At malinaw: ito ay hindi lamang personal na pagkabigo. Ito ay collective regression. Dahil sa ating pagboto base sa paboritong artista at hindi sa kwalipikasyon, pinili nating ang tagapangalaga ng Konstitusyon ay maging tagapaghatid ng tsap-tsap na panukala sa ngalan ng "pagbabago."

Si Miriam ay hinubog ng siyensiya ng batas at pinanday ng pandaigdigang pagkilala. Si Robin ay produkto ng popularidad, ng celebrity politics, at ng sistemang mas pinahahalagahan ang kasikatan kaysa katalinuhan.

Kung hindi ito ehemplo ng constitutional capture at erosion of institutional integrity, hindi na natin alam ang kahulugan ng krisis.

Hindi ito basta isyu ng tao. Ito ay isyu ng institusyon. At higit pa riyan, ito ay salamin ng ating mga piniling lider. Dahil sa ating pagboto ng mababa ang pamantayan, binaba rin nila ang pamantayan ng paglikha at rebisyon ng ating mga batas.

Ang tanong: kaya pa ba nating iahon ang diskurso? O mas pipiliin pa rin natin ang slambook kaysa sa Saligang Batas?

Naghain ng resolution ang Senate Minority Bloc para isapubliko ang Bicameral budget deliberations.

Kabilang sa minority bloc sina Sen. Tito Sotto, Sen. Risa Hontiveros, Sen. Loren Legarda, Sen. Migz Zubiri at Sen. Ping Lacson.

Kahit nasa majority bloc, pumirma rin sa resolution ng minority sina Sen. Bam Aquino at Sen. Kiko Pangilinan.

Naga sets stage for community-led housing projects under CMP

In line with Mayor Leni Robredo’s directive to strengthen Naga City’s housing program as part of her 2028 Finish Line roadmap, the Housing and Settlements Development Office (HSDO) has initiated steps to implement the Community Mortgage Program (CMP), a government-backed, people-led housing finance initiative.

HSDO Department Head Engr. Rolando Campillos has begun a series of preparatory meetings and coordination activities with Mr. Will Peran of the Social Housing Finance Corporation (SHFC), the national agency tasked to implement the CMP.

The Community Mortgage Program is designed to assist legally organized homeowners associations composed of low-income groups in acquiring and developing land under the concept of community ownership.

Through the program, beneficiaries are given access to affordable financing to purchase and improve their housing sites, eventually leading to secure land tenure and upgraded living conditions.

As part of the city’s efforts to roll out the CMP, two homeowners associations—Sitio Sto. Niño Homeowners Association in Sabang and Mabolo Homes Subdivision Homeowners Association in Barangay Mabolo—underwent initial orientation sessions on July 17 and 18, respectively.

These sessions introduced the core principles, processes, and benefits of the program to prospective beneficiaries.

The city government is hopeful that the CMP will accelerate its goal of inclusive and community-driven shelter development for Nagueños, especially those belonging to vulnerable and informal settler sectors. | via Jason B. Neola

"SC’S DECISION GOES AGAINST THE CONSTITUTION'S DESIGN" - Former Solicitor General Florin Hilbay on the SC's decision on Sara's impeachment ✊🇵🇭

Impeachment is a game among elected representatives of the people, not unelected magistrates. This idea informs the fundamental design of the Constitution. Impeachment is a political tool for enforcing public accountability among the highest of the high-ranking public officials, similar to a vote of “no confidence”. The text, history, and structure of the Constitution’s Impeachment Clauses assign no role for the Supreme Court as an institution. As a political tool, impeachment is designed to be free from judicial interference. (This is partly because impeachment is itself a weapon for politically removing justices of the Supreme Court).

With due respect, the SC’s recent decision goes against the heart of the Constitution’s design. The real issue is not whether the SC’s interpretation of words and phrases in the Impeachment Clauses is correct; it is that the attitude of parsing constitutional language with little regard for the evident design of the Constitution is itself deeply problematic. The point of the design is to prevent the SC from getting sucked into the narrow task of doctrinal line-drawing or defining words and phrases. Unlike, say, Article III or the Bill of Rights, which is designed to be judicially enforced, the Impeachment Clauses of Article XI are designed against judicial interference. Not every word in the Constitution is meant to be judicially interpreted.

When the SC wades into political waters such as nullifying the action of the House (a lengthy process that took a lot of pain and effort) on overtly technical grounds, it inevitably and unnecessarily politicizes the judiciary itself. Adding a layer of legalese rarely creates legal certainty on a matter that is fundamentally political. We can invent qualifications and conditions, but this is exactly what the Impeachment Clauses seek to prevent—the type of legalese that now apparently tells members of Congress they can’t count from 1 through 4. Legal complexity rarely breeds clarity.

Without assigning motives (and again, with due respect), the alacrity with which the decision was handed down also does not seem commensurate to the significance of the matter, the regard due to co-equal branches, or even the gravity of the allegations against the respondent. And the language: “effectively dismissed”, “barred”, “void ab initio”, “did not acquire jurisdiction”, “immediately executory”—these are heavy words to throw against the people’s basic desire to know the truth in a public trial before the Senate. Isn’t the House (or even the Senate) even entitled to be heard on oral arguments for a case of this magnitude?

Finally, the cost of nipping this impeachment complaint in the bud is remarkably high such that the House might be constrained to altogether forego the inquiry into the alleged corruption that is the subject of this impeachment process. This simply isn’t a matter of re-filing before some committee of the House and casually getting the signature of legislators. The political consequence of this judicial decision, however well-intentioned, might just be too high.

In the end, truth suffers and Filipinos, still none the wiser.

Naga, civic radio groups to formalize partnership for disaster response, big events

The City Government of Naga is set to formalize its partnership with various civic radio groups in the Bicol Region through a memorandum of agreement (MOA) aimed at strengthening collaboration, particularly during major events like the Peñafrancia Festival and in times of disasters and emergencies.

Mayor Leni Robredo said the initiative seeks to institutionalize the role of volunteer radio organizations in boosting the city’s capability for emergency communication and public safety.

“Our engagement with civic radio groups will not only cover the Peñafrancia festivities, which is considered one of the biggest Marian festivals in Southeast Asia, but also during calamities as part of our disaster communication teams,” Robredo stated.

She emphasized that the city government is keen on forging a long-term relationship with the radio patrol groups, enabling them to serve as strong and active partners of the City Disaster Risk Reduction and Management Council (CDRRMC).

“Even during emergencies caused by accidents, I am hopeful that our partnership with these radio organizations will truly be worthwhile,” the mayor added.

The memorandum of agreement will outline the delineation of duties and responsibilities to ensure that all parties operate in a systematic, efficient, and effective manner. In addition, a workshop will be conducted to orient DRRM personnel and members of the radio communications groups on their specific roles and the protocols to be observed during joint operations.
