معمولی غلطی نہیں — Material Irregularity

ہائی کورٹ نے قرار دیا کہ اگر عدالت کسی اہم شہادت کو نظر انداز کر دے (Non-Reading) یا موجود شہادت کو غلط طور پر پڑھ کر/سمجھ کر فیصلہ کرے (Misreading) تو یہ محض ایک معمولی غلطی نہیں بلکہ Material Irregularity تصور ہوتی ہے، جو عدالتی فیصلے کی قانونی حیثیت کو متاثر کر سکتی ہے۔
⚖️ Non-Reading & Misreading of Evidence
یہ اصول اپیل/نظرثانی میں ایک اہم قانونی بنیاد بن سکتا ہے، خصوصاً جہاں فیصلہ ریکارڈ پر موجود اہم شہادت کو نظر انداز کرنے یا اس کی غلط تعبیر پر مبنی ہو۔

"20 سال ملازمت مکمل کرنے والا سرکاری ملازم استعفیٰ کے بعد بھی پنشن کا حق دار ہے۔ تاخیر سے درخواست دینے سے حق ساقط نہیں ہوتا۔"
