CLARIFICATION:
THE PEOPLE OF LADU PAYAM SECURED A HIGH COURT ORDER
The High Court of South Sudan (Kator Branch) has issued an INTERIM RESTRAINING ORDER protecting the ancestral Nyamini land of Ladu Payam!
WHO WON?
The people of Ladu Payam, represented by Chief Olimpio Lokudu Pitia and the Bari traditional leadership.
WHAT DID THE COURT ORDER?
STOP all unauthorized demarcation activities on Nyamini ancestral land
PROTECT Ladu Payam's territorial rights
FREEZE the status quo pending final court determination
WHO WAS RESTRAINED?
The High Court has restrained:
• Sultan Emmanuel Juma Khalifa (Nyangwara)
• Sultan Roman Lodu Denis (Tijor Mundari)
These defendants initiated ILLEGAL and UNAUTHORIZED demarcation without the consent of Ladu Payam people.
WHY DID LADU PAYAM GO TO COURT?
Nyangwara and Tijor Mundari communities attempted to unilaterally demarcate their land WITHOUT:
a)Legal authorization
b)Consent of Ladu Payam
c)Community approval
THE COURT FOUND:
✅ The demarcation was UNLAWFUL
✅ It must be IMMEDIATELY STOPPED
✅ Land ownership will be determined through the courts
The restraining order is BINDING and legally enforceable. Any violation is contempt of court.
