بيان: توثيق الجرائم ودعم البعثة الدولية المستقلة حول السودان واجب إنساني وحقوقي عاجل

كمبالا، جنيف، بورتسودان، نيروبي.

بأصوات يحدوها الأمل والكرامة الإنسانية والعدالة، يعرب المركز النوبي للسلام والديمقراطية، ومنظمات المجتمع المدني المتعاونة والمنسقة معه، عن ترحيبه العميق وتقديره الصادق للكلمة التي ألقاها المفوض السامي لحقوق الإنسان، السيد فولكر تورك، في بيانه الافتتاحي لأعمال الدورة التاسعة والخمسين العادية لمجلس حقوق الإنسان المنعقدة فى جنيف، والتي انطلقت في 16 يونيو، وتستمر حتى 9 يوليو 2025.

كما يثمن المركز النوبي عالياً الإفادات القوية والصادقة التي أدلت بها البعثة الدولية المستقلة لتقصي الحقائق في السودان، ممثلة في رئيسها القاضي محمد عثمان شاندي، والبروفيسور جوي أيزيلو، والأستاذة القانونية منى رشماوي، وفريقهم المخلص، الذين نقلوا للعالم بجرأة وشفافية الحقيقة المرة لما يجري في السودان من انتهاكات فادحة لحقوق الإنسان، وسط تعتيم وتضليل وتواطؤ وتناسى.

وإيماناً منا بضرورة الوصول العاجل وغير المشروط إلى العدالة وإنصاف الضحايا وإيقاف الكارثة الانسانية والحرب العبثية فإننا نؤكد دعمنا الكامل وغير المشروط للبعثة الدولية، ونطالب بتعزيز وتوسيع التفويض الممنوح لها، وتمديد فترة عملها، بما يشمل كل التفويضات والآليات الدولية الأخرى المكملة والمنسقة معها، لفترة لا تقل عن ثلاث سنوات، نظراً لاستمرار الحرب، وتفاقم الانتهاكات الجسيمة لحقوق الإنسان، وامتناع أطراف النزاع عن التعاون مع البعثة ومنعها من الوصول إلى الضحايا داخل السودان، بالإضافة إلى رفض بعض الدول السماح بدخولها لأراضيها لمقابلة المزيد من الضحايا والشهود الفارين من الحرب في السودان.

كما نرحب ترحيباً كبيراً بالبيان الهام الصادر اليوم 19 يونيو عن السيد رضوان نويصر، خبير الأمم المتحدة المعني بحالة حقوق الإنسان في السودان والمفوض بالاهتمام بتحسين حالة حقوق الإنسان بعد الانقلاب على التحول المدني الديمقراطي وخاصة ما اشار اليه من فظائع العنف الجنسي والعنف القائم على النوع والاستعباد الجنسي واستخدام الغذاء مقابل الجنس كإحدى أدوات الحرب والقمع والاضطهاد، وما كشفه في البيان عن تمكنهم من توثيق 368 حادثة عنف جنسي مرتبطة بالنزاع منذ اندلاع الحرب في 15 أبريل 2023، شملت أكثر من 521 ضحية، غالبيتهن من النساء والفتيات، وتعرض عدد كبير منهن لجرائم اغ**اب جماعي مروعة، كثير منها ذو طابع عنصري بغيض.

إننا، في المركز النوبي للسلام والديمقراطية، ندين بشدة هذه الجرائم، ونحمل سلطات الأمر الواقع في مناطق سيطرتها او تواجدها المسؤولية الأخلاقية والقانونية، وندعوها لتقديم إفادات موثقة وشهادات رسمية حول الانتهاكات التي تتحدث عنها في بياناتها، ضد الأطراف الأخرى، بشكل رسمي للبعثة الدولية، وأن تتوقف عن استغلال مأساة الشعب السوداني في دعايات سياسية جوفاء، والسماح للبعثة الدولية بدخول الأراضي السودانية التى تتواجد فيها والوصول الى الضحايا والشهود والمتضررين.

وإذ نؤكد وقوفنا الثابت والداعم للبعثة الدولية المستقلة لتقصي الحقائق حول السودان، فإننا نناشد كافة الضحايا والناجيات والناجيين والشهود، وكل المنظمات الحقوقية ومنظات المجتمع المدني بطيفها العريض، بضرورة تقديم إفاداتهم المكتوبة والموثقة، حول الانتهاكات الفظيعة التي شهدها السودان منذ اندلاع النزاع في 15 أبريل 2023 وما زالت مستمرة، وذلك عبر القنوات الرسمية المخصصة لذلك:

إن تقديم الإفادات من قبل الضحايا أو الشهود لا يقتصر على كونه فعلًا شجاعاً في وجه الظلم، بل هو خطوة أساسية لضمان الحقوق عند المحاسبة، ولتفعيل آليات عدم الإفلات من العقاب، والتعويض، وجبر الضرر، وتحقيق العدالة، سواء كانت عدالة تقليدية أو انتقالية أو تحويلية، فالإفادات الموثقة، تبقى شاهداً لا يسقط بالتقادم، مهما طال الزمن، ومن هنا، فإننا نناشد منظمات المجتمع المدني، وعلى وجه الخصوص المنظمات المحلية، أن تضطلع بمسؤولية التوثيق الجاد والنزيه، والاحتفاظ بالأدلة بطريقة آمنة واحترافية، خاصة في ظل غياب منظومة عدلية موثوقة في السودان. كما نُذكّر المدافعين عن حقوق الإنسان، والمدافعين عنهم، بأهمية توفير الحماية والدعم النفسي والحقوقي للضحايا والشهود، حتى لا يُتركوا وحدهم في مواجهة العنف والخوف والتهميش.

وفي هذا السياق، نؤكد أن البيان الذي أدلى به النائب العام لسلطة الأمر الواقع في بورتسودان امام مجلس حقوقالإنسان بجنيف، لا يعفي سلطاتهم من مسؤوليتهم المباشرة في حماية المدنيين، وتقديم الأدلة لمنظومات العدالة الدولية والإقليمية، لا سيما في ما يتعلق بالأرقام المروعة للمقابر الجماعية، والآلاف من ضحايا الاغ**اب، وعليهم أن يمكنوا المواطنين من الوصول إلى العدالة، لا أن يضعوا الحواجز في وجوههم، وذلك بالسماح الفوري وغير المشروط للبعثة الدولية المستقلة لتقصي الحقائق بدخول السودان، ووقف كل أشكال الضغط أو التهديد للدول التي تستضيف اللاجئين السودانيين لمنع البعثة من مقابلتهم، إن العالم كله بات يعلم أن ما ارتكب في السودان من قبل وخلال هذا النزاع يمثل جرائم إبادة جماعية، وتطهيراً عرقياً، وجرائم حرب وجرائم ضد الإنسانية، ولا نجاة لأحد من المسؤولين عن هذه الجرائم إلا عبر سبيل الحقيقة والمساءلة والمصالحة والتعويض وجبر الضرر.

يناشد المركز النوبي للسلام والديمقراطية المفوضية السامية لحقوق الإنسان أن تراعي الظروف الاستثنائية التي يعيشها الشعب السوداني فى النزوح واللجؤ والشتات، من استمرار النزاع المسلح، وتصاعد الانتهاكات، وغياب العدالة، وانهيار النظام العدلي والصحي والأنظمة المساندة لها في السودان، وتزايد العراقيل أمام الشهود والمبلغين، وندعوها إلى تمديد فترة تقديم الإفادات إلى أجل مناسب، إحقاقًا للحق، وإتاحةً لفرصة أوسع أمام الضحايا لكسر الصمت.

لا سلام دون عدالة، ولا عدالة دون صوت الضحايا .. ليكن صوتنا جميعاً جسر نجاة للضحايا، وعدسة توثق الحقيقة، وأداة للعدالة التي طال انتظارها.

Statement: Documenting Crimes and Supporting the Independent International Fact-Finding Mission on Sudan Is an Urgent Humanitarian and Human Rights Duty

Kampala, Geneva, Port Sudan, Nairobi.

With voices driven by hope, human dignity, and justice, the Nubian Center for Peace and Democracy, along with its collaborating and coordinating civil society organizations, expresses its deep appreciation and sincere support for the opening statement delivered by the United Nations High Commissioner for Human Rights, Mr. Volker Türk, during the 59th Regular Session of the Human Rights Council, which convened in Geneva on 16 June and will continue until 11 July 2025.

The Nubian Center also highly values the powerful and honest testimonies delivered in the oral update by the Independent International Fact-Finding Mission on Sudan (FFM Suda), represented by its Chairperson Judge Mohamed Othman Chande, Professor Joy Ezeilo, and legal expert Ms. Mona Rishmawi, along with their dedicated team, who courageously and transparently conveyed to the world the bitter truth of the grave human rights violations taking place in Sudan amidst media blackout, misinformation, complicity, and neglect.

Believing in the urgent and unconditional need for justice, redress for victims, and an end to the humanitarian catastrophe and senseless war, we reaffirm our full and unconditional support for the Fact-Finding Mission. We call for the strengthening and expansion of its mandate and the extension of its work, including all complementary and coordinated international mechanisms, for no less than three years. This is due to the ongoing war, the worsening of gross human rights violations, and the refusal of the warring parties to cooperate with the Mission or allow it access to victims within Sudan. Additionally, some countries have denied the Mission entry to interview more victims and witnesses who fled the war.

We also warmly welcome the important statement issued today, 19 June, by Mr. Radhouane Nouicer, the UN Expert on the human rights situation in Sudan, appointed to monitor and improve the situation following the coup against the democratic civilian transition. His statement exposed the horrors of s*xual violence, gender-based violence, s*xual slavery, and the use of food for s*x as tools of war, oppression, and persecution. He revealed that the UN documented 368 conflict-related incidents of s*xual violence since the outbreak of war on 15 April 2023, involving more than 521 victims-most of them women and girls-many of whom endured horrific gang r**es, often with a vile ethnic-based nature.

We at the Nubian Center for Peace and Democracy strongly condemn these crimes and hold the de facto authorities accountable-ethically and legally-in areas under their control or presence. We call on them to submit official, documented testimonies regarding the violations they reference in their statements against other parties, and to refrain from exploiting the suffering of the Sudanese people for empty political propaganda. They must allow the Fact-Finding Mission entry into their controlled areas to reach victims, witnesses, and affected communities.

We reiterate our unwavering support for the Independent International Fact-Finding Mission on Sudan and call on all victims, survivors, witnesses, and the wide spectrum of human rights organizations and civil society to submit their written and documented testimonies about the atrocities witnessed in Sudan since the outbreak of the conflict on 15 April 2023-violations which continue to this day-through the official channels:

Submitting testimonies by victims or witnesses is not only a courageous act in the face of injustice, but a crucial step toward ensuring rights during accountability processes, activating mechanisms to combat impunity, and enabling reparations, redress, and justice-be it retributive, transitional, or transformative. Properly documented testimonies remain lasting evidence that does not expire with time. Therefore, we urge civil society organizations, especially local ones, to take up the responsibility of rigorous, impartial documentation and safe, professional preservation of evidence, especially in the absence of a reliable justice system in Sudan. We also remind human rights defenders-and those who protect them-of the importance of ensuring physical, psychological, and legal protection for victims and witnesses so they are not left alone in the face of violence, fear, and marginalization.

In this context, we stress that the statement made by the Attorney General of the de facto authorities in Port Sudan before the Human Rights Council in Geneva does not absolve them of their direct responsibility to protect civilians and provide evidence to international and regional justice mechanisms-particularly regarding the horrifying figures on mass graves and the thousands of victims of r**e. They must enable people to access justice, not block their path. This includes allowing the Independent Fact-Finding Mission immediate and unconditional access to Sudan and ceasing all forms of pressure or threats against countries hosting Sudanese refugees to prevent the Mission from interviewing them. The entire world now knows that what has been committed in Sudan before and during this conflict constitutes genocide, ethnic cleansing, war crimes, and crimes against humanity. There is no escape for those responsible except through truth, accountability, reconciliation, compensation, and redress.

The Nubian Center for Peace and Democracy calls on the Office of the High Commissioner for Human Rights to take into account the exceptional circumstances that the Sudanese people are enduring-in displacement, exile, and diaspora-due to ongoing armed conflict, escalating violations, absence of justice, and the collapse of legal, health, and support systems in Sudan. The obstacles faced by witnesses and whistleblowers are growing, and we urge the OHCHR to extend the submission period to a more appropriate time frame in order to do justice and provide a greater opportunity for victims to break their silence.

No peace without justice, and no justice without the voices of the victims.
Let our voices be the bridge of salvation for the victims, the lens that documents the truth, and the tool for long-awaited justice.

Statement by the Nubian Center for Peace and Democracy .. On the African Union’s Official Adoption of the Convention on Ending Violence Against Women and Girls

The Nubian Center for Peace and Democracy warmly welcomes the historic adoption of the African Union Convention on Ending Violence Against Women and Girls. a long-overdue and bold step toward building an Africa where women and girls live free from fear, violence, and oppression. It reaffirms the commitment to defending the rights, dignity, and safety of women and girls across the continent.

This Convention is not merely a document-it represents a turning point in the struggle for gender justice in Africa. It affirms, unequivocally, that the rights, dignity, and safety of women and girls are non-negotiable. They are fundamental rights and must be fiercely protected.

This Convention is a call for justice, a promise of protection, and a framework for real and lasting change. It sets a strong legal and political precedent for confronting all forms of gender-based violence and serves as a tool to dismantle the structures that enable such violence and support survivors in reclaiming their rights and futures.

For us in Sudan, this Convention is not only symbolic but deeply personal. Sudanese women have endured decades of systemic violence, from armed conflict and displacement to institutional discrimination and s*xual violence used as a weapon of war, including the suppression of their voices in public life and discrimination deeply rooted in law and culture. From the streets of Khartoum to the camps of Darfur, from displaced mothers to young girls denied education, their pain tells a story that must no longer be ignored.

We urge all AU Member States to swiftly ratify and implement this Convention and to ensure that its promises are translated into tangible protection on the ground.

However, decisions without implementation remain empty. The credibility of this Convention. and of the African Union itself. depends on its ability to ensure that this historic agreement does not gather dust in government offices, but becomes a driving force that transforms laws, shifts cultures, and protects lives on the ground. For this Convention to create real change in people’s lives, we call on the African Union to match its words with action and accountability and to move beyond adoption toward bold implementation.

Therefore, the African Union must:
1. Adopt clear policies and establish strong, independent, and well-resourced mechanisms to monitor progress and compliance.
2. Develop binding accountability systems that hold governments responsible when they fail to protect women and girls or refuse to implement the provisions of the Convention.

The Nubian Center for Peace and Democracy affirms its readiness to support the full implementation of this Convention. We call on civil society across the continent to use this Convention as a unifying platform for advocacy, education, and legislative reform. Together, we must ensure that this historic agreement becomes a driving force for justice. not just a symbol of hope, but a catalyst for change.

Let this be the dawn of a new era .. one in which no woman or girl lives in silence or fear, and where justice, equality, and peace are not distant dreams, but daily realities.

بيان صادر عن المركز النوبي للسلام والديمقراطية .. بشأن اعتماد الاتحاد الأفريقي رسمياً لاتفاقية إنهاء العنف ضد النساء والفتيات

يرحب المركز النوبي للسلام والديمقراطية ترحيبا حارا باعتماد الاتحاد الأفريقي التاريخي لاتفاقية إنهاء العنف ضد النساء والفتيات، وهي خطوة جريئة طال انتظارها، من اجل بناء أفريقيا تعيش فيها النساء والفتيات حياة خالية من الخوف والعنف والقمع، وتؤكد الالتزام بالدفاع عن حقوق النساء والفتيات وكرامتهن وسلامتهن في جميع أنحاء أفريقيا.

هذه الاتفاقية ليست مجرد وثيقة، بل تمثل نقطة تحول في النضال من أجل العدالة بين الجنسين في القارة، وتؤكد بشكل قاطع، أن حقوق النساء والفتيات وكرامتهن وسلامتهن غير قابلة للتفاوض، بل هي حقوق أساسية، ويجب حمايتها بشدة، هذه الاتفاقية تمثل دعوة إلى العدالة ووعد بالحماية، وإطار عمل لتغيير حقيقي ودائم. إنها ترسي سابقة قانونية وسياسية قوية لمواجهة العنف القائم على النوع الاجتماعي بجميع أشكاله، وأداة تساعد في تفكيك الهياكل التي تمكن العنف القائم على النوع الاجتماعي، وتدعم الناجيات في استعادة حقوقهن ومستقبلهن.

بالنسبة لنا في السودان، هذه الاتفاقية ليست رمزية فحسب، بل هي شخصية للغاية، لقد عانت النساء السودانيات عقودا من العنف الممنهج، ومن النزاع المسلح والنزوح إلى التمييز المؤسسي والعنف الجنسي المستخدم كسلاح في الحرب، بما في ذلك قمع أصواتهن في الحياة العامة، والتمييز المتأصل في القانون والثقافة .. من شوارع الخرطوم إلى مخيمات دارفور، ومن الأمهات النازحات إلى الفتيات الصغيرات المحرومات من التعليم، تروي آلامهن قصة لا يجب تجاهلها بعد الآن.

نناشد جميع الدول الأعضاء في الاتحاد الأفريقي، إلى التصديق على هذه الاتفاقية وتنفيذها على وجه السرعة، وضمان ترجمة وعودها إلى حماية ملموسة على أرض الواقع.
مع ذلك، فإن القرارات دون تطبيق تبقى فارغة، وتعتمد مصداقية هذه الاتفاقية ومصداقية الاتحاد الأفريقي نفسه على قدرته على ضمان ألا تصبح هذه الاتفاقية التاريخية مجرد غبار في المكاتب الحكومية، بل أن تُصبح قوة فاعلة تغير القوانين وتغير الثقافات وتحمي الأرواح على أرض الواقع، ولكي تحدث هذه الاتفاقية تغييرا حقيقيا في حياة الناس، ندعو الاتحاد الأفريقي إلى ضمان اقتران أقواله بالأفعال والمساءلة، وتجاوز مرحلة التبني واتخاذ خطوات جريئة لضمان التنفيذ، وعليه يجب على الاتحاد الأفريقي الاتي:
1. اعتماد سياسات واضحة وإنشاء آليات قوية ومستقلة ومجهزة بموارد كافية لرصد التقدم والامتثال.
2. وضع أنظمة ملزمة للمساءلة تحمل الحكومات المسؤولية عندما تخفق في حماية النساء والفتيات أو ترفض تنفيذ أحكام الاتفاقية.
يؤكد المركز النوبي للسلام والديمقراطية على أهبة الاستعداد لدعم التنفيذ الكامل لهذه الاتفاقية، ندعو المجتمع المدني في جميع أنحاء القارة إلى استخدامه كنقطة التقاء للمناصرة والتثقيف والإصلاح التشريعي.

معا، يجب أن نضمن أن يصبح هذا الاتفاق التاريخي قوة دافعة للعدالة .. وليس مجرد رمز للأمل، بل حافزًا للتغيير.

فليكن هذا فجر حقبة جديدة .. حقبة لا تعيش فيها امرأة أو فتاة في صمت أو خوف، وحيث لا تكون العدالة والمساواة والسلام أحلامًا بعيدة المنال، بل حقائق يومية.
