ميلشيا #قسد ارتكبت اليوم بشكل صارخ جريمة حرب بحق المدنيين ، حيث ان إجبار المدنيين على الذهاب إلى جبهات القتال يُعتبر جريمة حرب بموجب القانون الدولي الإنساني. وفقاً لاتفاقيات جنيف، وخاصة المادة (51) من البروتوكول الإضافي الأول لعام 1977، الذي يُحظر استخدام المدنيين كدروع بشرية أو تعريضهم للخطر بشكل مباشر في العمليات العسكرية. كما تنص المادة (8) من نظام روما الأساسي للمحكمة الجنائية الدولية على أن إجبار المدنيين على المشاركة في الأعمال العدائية يُعد جريمة حرب يُحاسب عليها مرتكبوها.
1. المادة 51 (البروتوكول الإضافي الأول لاتفاقيات جنيف - 1977):
• الفقرة 7: “لا يجوز استخدام وجود السكان المدنيين أو الأفراد المدنيين في محاولة لتحصين نقاط معينة أو مناطق ضد العمليات العسكرية، وخصوصاً في محاولة حماية الأهداف العسكرية أو إبعادها عن الهجوم”
2. نظام روما الأساسي (المادة 8 - جرائم الحرب):
• المادة 8(2)(ب)(xxiii): “إجبار أي شخص على المشاركة في العمليات العدائية التابعة لقوات معادية، سواء بشكل مباشر أو غير مباشر”.

The militia (Syrian Democratic Forces) today blatantly committed a war crime against civilians, as forcing civilians to go to the fighting fronts is considered a war crime under international humanitarian law. According to the Geneva Conventions, especially Article (51) of the First Additional Protocol of 1977, which prohibits the use of civilians as human shields or directly exposing them to danger in military operations. Article (8) of the Rome Statute of the International Criminal Court also states that forcing civilians to participate in hostilities is a war crime for which its perpetrators will be held accountable.
1. Article 51 (Additional Protocol I to the Geneva Conventions - 1977):
• Paragraph 7: “The presence of the civilian population or individual civilians may not be used to render certain points or areas immune from military operations, in particular to shield military objectives or exclude them from attack.”
2. Rome Statute (Article 8 - War Crimes):
• Article 8(2)(b)(xxiii): “Forcing any person to participate, directly or indirectly, in the hostilities of the hostile forces.”
