TCI BAR ASSOCIATION MOURNS THE PASSING OF MR. ARTHUR HAMILTON, SR.
The President, Council and members of the Turks and Caicos Islands Bar Association mourn the passing of Mr. Arthur Hamilton, Sr., Attorney-at-Law, a longstanding and respected member of the legal profession in the Turks and Caicos Islands.
Mr. Hamilton devoted many years to the practice of law and to the administration of justice in these Islands. His work took him before the Magistrate’s Court, Supreme Court and Court of Appeal, where he represented clients in both criminal and civil matters, including some of the most serious and challenging proceedings to come before our courts.
His contribution can also be seen in the development of TCI jurisprudence. His advocacy contributed to an important appellate precedent concerning effective legal representation and fairness in criminal proceedings, in which the Court of Appeal ultimately set aside a conviction and sentence. It stands as one example of the significant work he undertook during his years at the Bar.
Mr. Hamilton also served the justice system beyond his work as an advocate, including service as a member of an Employment Tribunal panel.
He belonged to a generation of practitioners who helped establish and preserve the traditions of professionalism upon which the modern Turks and Caicos Islands Bar continues to stand. He was known for his courtesy, humility and respect for judges, magistrates, fellow counsel, clients and court staff. He demonstrated throughout his career that determined advocacy and professional courtesy were not competing values.
Reflecting on his passing, President of the Bar Association, Mark A. Fulford, said:
“I knew Mr. Hamilton personally and also had the opportunity to conduct a criminal trial alongside him. It is one thing to know a lawyer socially or to observe him across a courtroom; it is another to work beside him in the preparation and conduct of a serious criminal case.
I saw firsthand his patience, experience and respect for the Court, but equally important was the seriousness with which he approached his responsibility to the person whose liberty had been entrusted to our representation.
Arthur came from a generation of lawyers who understood that you could be a determined advocate without being discourteous, and that respect for the Court never required you to surrender an inch of your client’s case. That is an example worth preserving for the younger Bar.
As President, I believe it is important that we recognise and remember those who helped build and sustain our profession. Arthur Hamilton gave many years of service to the law and to the administration of justice in the Turks and Caicos Islands, and I will remember him warmly.”
Beyond the courtroom, Mr. Hamilton was also a man of deep Anglican faith, devoted to his Church and his family.
With his passing, the Bar has lost not merely a senior member, but part of its institutional memory. His name now joins those practitioners upon whose service the modern Turks and Caicos Islands Bar has been built.
The Bar Council and the entire membership of the Turks and Caicos Islands Bar Association extend sincere condolences to his children, grandchildren, extended family, colleagues and all those in the Turks and Caicos Islands and The Bahamas who mourn his passing.
May his soul rest in eternal peace.
