Ukitumia Mtu Pesa Na Ana Fuliza Safaricom Hawapaswi Kuikata,Kwani Sio Kazi yako kuwakusanyia Madeni

A Nairobi lady has sued Safaricom PLC after her KSh 2,700, mistakenly sent via M-Pesa, was used to offset the recipient’s Fuliza debt.

Her reversal request was declined. She has now moved to the High Court challenging that policy as unconstitutional.

When I send money to someone, my intention is clear that I am transferring funds to THAT person. I am not entering into a contract with Safaricom to help them recover loans. I am not agreeing to become a guarantor. I am not volunteering to settle another adult’s overdraft.

How then does my money automatically clear someone else’s debt without my consent?

We must be very careful as a country not to normalise silent policies that shift financial burdens to third parties. Digital convenience should not override basic principles of fairness and property rights.

Yes, the recipient may have agreed to Fuliza terms. But I did not.And this is the core issue.

If money is mistakenly sent and reversal is denied because it has already been swallowed by a debt recovery system, then we are creating a dangerous precedent one where corporations quietly prioritise loan recovery over consumer protection.

At the very least, there should be a clear warning before completing a transaction:“The recipient has an outstanding Fuliza balance. Funds may be used to offset debt. Proceed?”

This case is bigger than 2,700 shillings. It is about how far automated financial systems can go without violating basic rights.

If a child is aband0ned at birth and raised by strangers can that child still sue the real parents later?

Now this is where the story gets even more real

A baby is d0mped.
No name, no identity, no trace of who brought them into the world.

Someone else steps in
Raises the child, trains the child, becomes the only “parent” that child knows.
Years later, the question comes:
“Can I hold my biological parents accountable?”

Here is the hard truth
👉 You cannot sue who you cannot identify.
The law works with facts and persons not assumptions.

So if the biological parents are unknown, there is no one to bring before the court but that is not the end of the story. If one day the identity of the biological parents is discovered through:

🥢 confession
🥢 witnesses
🥢 documents
🥢 or even modern tools like DNA

Then yes…
👉 That child (now an adult) can still take legal action.

Because abandonment does not magically disappear with time. It leaves legal consequences behind.

Let’s make it simple and correct.

In any official document (agreement, affidavit, court papers, bank forms, property documents), your name should be written clearly like this:

SURNAME FIRST, then OTHER NAMES
Example:
OKAFOR CHINEDU JOHN

Not:
Mr. Chinedu Okafor
John Okafor (without full names)
Chinedu “The Boss” Okafor
Mrs Okafor only

Because titles like Mr, Mrs, Chief, Alhaji, etc. are not part of your legal name. They are just social titles.

Also:
Your names must be consistent in all documents
Avoid shortening your names randomly
Use the same spelling everywhere (no “Chinedu” today and “Chydee” tomorrow)

Why this matters:

If a person comes to you on the ground that their phone is down and they need to make urgent calls, don't hand in your phone.

If you need to get someone's phone number for whatever reason, don't hand in your phone.

For all it's worth, let them call out the number while you dial it on your phone, yourself.

Giving someone your phone seems harmless, but it creates significant risks to your privacy, security, and the physical safety of your device.

When you dial it yourself, you maintain control. The device never leaves your hand. You can lock the screen immediately after.

These are some reasons you should not give your phone to someone:

👉They can assess sensitive data as notifications can pop up while they hold it.

👉Private messages or emails may be visible.

👉Recent apps can be swiped through quickly. Scàmmérs can quickly switch to payment apps and send themselves money in seconds.

👉They can quickly instal spyware on your phone as fast fingers can download tracking software.They might change your "Find My" settings.

👉Handing over a phone makes it easy to stéàl. A thíéf can run while you are distracted or while he moves aside to make a call.

This also applies to other delicate devices such as your laptop.

If someone needs to make use of your laptop for typing, logging in their emails, or research work, make sure you are seated beside the person and watch what they do.

There are certain offences where the Police will NOT grant you bail at the station, regardless of who you call or how confident you are.

And this is where many individuals get it completely wrong.

They assume "bail is my right" means bail must occur immediately at the police station. That is not how the law operates.

Let’s break it down in real terms:

If a person is accused of unlawfully taking another person’s life, the police do not have the authority to release that suspect on station bail. That kind of case must go before a High Court.

If the allegation involves robbery with weapons, especially guns or anything dangerous, the police will not take that decision themselves. The court must intervene.

In cases of kidnapping, because of how serious and sensitive it is, the police will usually move the suspect straight to court instead of granting bail.

When it comes to offences against the State like treason or treasonable felony, that is far beyond what station bail can handle.

For r**e and other serious sexual offences, the police are extremely cautious. Bail at the station is rarely granted; the court decides.

Anything connected to terrorism or national security? That one is completely outside the discussion of police bail.

Now, here is the part many people don’t understand:

Once an offence carries death penalty or life imprisonment, the police generally do not have the authority to grant bail.

But don’t get it twisted:
"Not bailable at the police station" does NOT mean "you cannot get bail at all."

It simply means:
the court, not the police, has the power to decide.

And that difference?

It can save you from making very costly assumptions. Because shouting "I know my rights" without understanding them can land you in deeper trouble.

This morning, I met a woman seated quietly, holding a brown envelope like her whole life was inside it.

And in a way… it was.

Inside were copies of a title deed, an agreement, and receipts.
She had bought land three years ago.

Everything looked perfect.

She told me,
“Nilionyeshwa shamba na kijana wa mzee. Akaniambia hii ni yao. Nikalipa pole pole hadi nik**aliza.”

No drama.
No pressure.
Just trust.

She even built a small house. Planted trees.
Started calling it home.

Then one day… strangers showed up.

Not one. Not two.
A whole family.

Brothers. Sisters. Uncles.

And the sentence that changed everything was said calmly:

“Hiyo shamba haikuwa yake kuuza. Ni ya familia.”

In Kenya, “being shown land” means nothing legally.

A husband’s property, Does the wife automatically own half?

Many people believe:
“As soon as you marry, everything becomes 50/50.”

But that is not always true.

In law, it depends on:
Who actually owns the property
Who paid for it and contribution.
And how it was acquired during the marriage

Marriage does not automatically change ownership of property.

But here is the important part,
