Court Allows Termination of TPS for Nepal, Honduras, and Nicaragua
On Aug. 20, 2025, the Ninth Circuit Court of Appeals granted the government's emergency request for a stay of the district court's preliminary injunction, which had blocked the government from ending Temporary Protected Status (TPS) for nationals of Nepal, Honduras, and Nicaragua in NTPSA II v. Noem.
By issuing the stay, the Ninth Circuit paused the lower court's order and allowed the administration to move forward, at least temporarily, with its plan to terminate TPS for more than 60,000 long-term residents from those countries while the underlying appeal proceeds.
This ruling means that Nepali TPS holders will lose their legal status and work authorization immediately, and that, without an intervening court order, Honduran and Nicaraguan TPS holders will lose their legal status on Sept. 8.
