Berrien County to provide school supplies for students in need BERRIEN COUNTY, Mich. -- The Berrien Community Foundation is helping students get ready to learn this fall by providing 1,100 backpacks filled with school supplies for students.

Backpacks for Good is a school readiness event hosted at Dwight P. Mitchell City Center Park on Aug. 5 from 5:30 p.m. to 7:30 p.m.

The event is open to students living in the 49022 ZIP code, regardless of what school the student attends.

“Backpacks For Good isn’t just about school supplies – it’s about lifting a weight off of parents’ shoulders and making sure every child starts the school year ready to succeed,” said Lisa Cripps-Downey, president of Berrien Community Foundation.

“By providing essential supplies, food for families and community resources, we’re helping families focus less on cost and more on what truly matters – their child’s education and confidence.”

Backpacks will be filled with grade-appropriate school supplies for students in kindergarten through twelfth grade.

Whirlpool Corporation is sponsoring part of the event and gathered a large number of employees to help with packing backpacks.

“By helping young people in this community prepare for school and fostering their excitement for learning, we are investing in their educational future. This project supports Whirlpool Corporation’s vision of ‘Improving Life at Home’,” stated Traci Robinson, senior manager, community relations, and managing director of the Whirlpool Foundation.

Farm-fresh vegetables and other food items will be available along with the backpacks and school supplies.

Families living in the 49022 ZIP code are encourages to bring their students and no registration is required.

There will be three Backpacks for Good events throughout Benton Harbor:

1. Students who live in the 49022 ZIP Code

Tuesday, August 5, 2025, from 5:30-7:30 p.m. at Dwight P. Mitchell City Center Park. This event is in partnership with National Night Out and is open to students who live in the 49022 ZIP Code, regardless of the school they attend.

2. Students attending Brandywine or Niles Schools

Thursday, August 7, 2025, from 4 – 6 p.m. in the Niles High School parking lot. This event is open to students attending Brandywine Community Schools or Niles Community Schools, regardless of the ZIP Code in which they live.

3. Students attending Coloma, Watervliet or Hagar #6 Schools

Thursday, August 14, 2025, from 4 – 6 p.m. in the Coloma Junior High School parking lot. This event is open to students attending Watervliet Public Schools, Coloma Community Schools or Riverside Hagar #6 School, regardless of the ZIP Code in which they live.

The Michigan Court of Appeals has ordered a new trial for a defendant convicted of criminal sexual conduct because the jury seated to hear the case was never sworn in by the judge.

The error was not caught by the judge, the prosecution, the defense, or trial court staff. The two-to-one decision by a three-judge panel held that failing to administer the oath was a “structural error” that requires the verdict to be vacated.

In a dissenting opinion, Judge Christopher Murray noted, even without the oath, the jury instructions include a reminder that they have a sworn duty.

“Even though the oath had not been provided, making this statement gave notice to the jury that its task was to provide a true and just verdict based on the evidence and law,” he wrote.

The defense attorney, Jonathan Simon, said having the jury take an oath is more than a formality.

“It impresses upon them that it is a solemn task that they have to take seriously and without the oath I think you’re taking away some of the formality and the impression of the importance of their function,” he told Michigan Public Radio. “And I think that the court got it right.”

The jury oath is also required by a state law. But there is no specific remedy required in the statute when the oath is not administered.

Special Assistant Wayne County Prosecutor Timothy Baughman, who argued the appeal for the prosecution, said the error should not vacate the conviction in an otherwise fair trial. He also noted, the mistake should have been raised during the trial. He said the ruling opens the door to abuse in future cases.

“So what it comes down to is the Court of Appeals saying this is automatically reversible even if there’s not an objection and that’s our problem because the defense could just say, ok, fine. I knew it happened. I won’t speak out and I’m going to win,” he said.

Baughman said the prosecution will ask the appeals court for reconsideration on a number of issues. The case could eventually go to the Michigan Supreme Court.

During his first start after that incident Henry drove to victory during the NAPA All Star Circuit of Champions presented by Valvoline event Friday at Hartford Motor Speedway

Henry, from Sacramento, California, traded the lead with Devon Borden throughout the 35-lap main event with Henry holding off a late race surge by Borden on the final circuits for the victory. Zeth Sabo, Brandon Spithaler, and Keith Sheffer Jr. rounded out the top five.
