Gunter Mayor Karen Souther has “defended” her illegal actions to KTEN news.

Unfortunately, her words fall short and are simply more excuses and KTEN reported them with no question. Investigative journalism requires more than accepting one statement and moving on! It means questioning the claims, examining the evidence, presenting the findings, and having the courage to call out wrongdoing wherever the facts lead.

That’s what WE, at OurGunter, are doing!

In a response to KTEN, Souther stated that she relied on public health and public safety procurement authority available to municipalities under Texas law and that she believed the ambulance purchase was lawful and served a legitimate municipal purpose.

That explanation, however, does not resolve the central issue.

The ambulances were purchased without prior authorization from the Gunter City Council, and the Council later declined to ratify the purchase. Whether the ambulances were intended for public safety is not the only question. The legal question is whether the mayor had the authority to obligate the City to that purchase without Council approval and whether the required procurement and contracting procedures were followed. Which she did not. And they were not.

Souther has also addressed the release of information from executive session, stating:

“The release of discussions regarding city business is prohibited, illegal behavior is not.”

But the issue goes beyond simply reporting suspected misconduct.

Souther recorded an executive session and later played a portion of that recording during an open City Council meeting.

If a public official believes illegal activity occurred during an executive session, there are established avenues for reporting that allegation, including law enforcement, prosecutors, the Texas Attorney General, or other appropriate investigative authorities. Publicly playing a confidential executive-session recording raises a separate legal question from simply reporting alleged wrongdoing.

In both matters, Souther’s defense appears to center heavily on what she BELIEVED she was legally permitted to do.

But personal belief is NOT the legal standard.

They are questions of law, authority, procedure, and evidence.

And that is precisely why the investigation matters.

OurGunter will continue following the records, the meetings, and the evidence as this develops. And we won’t leave out the details that matter!

This is very atypical for me to post something like this… But the person in this truck is going to kill someone. I already called the Celina Police Department and reported him…but if you know this person, please tag him below so the PD can identify him or if this is your kid, you need to take the keys away…IMMEDIATELY before he kills someone!

This young man tried to RAM me on Preston Road coming from Gunter into Celina trying to pass me on the shoulder and then I thought he was going around me and he pulled into the 7-Eleven right there before the high school in Celina but then he came back out and sped up going about 80 to catch me and wouldn’t let me slow down or speed up.

“Souther declined an on-camera interview but told KXII 12 she denies any wrongdoing and eagerly awaits the results of the investigation.”

Not sure how anyone can deny the underlying conduct when she admitted to it herself, on the record, during a City Council meeting.

Regarding the ambulance purchases made without prior council authorization, she acknowledged, ‘I shouldn’t have done that.’

And regarding the executive-session recordings, she stated, ‘I know I’m not supposed to record them, but I did.’

Those aren’t allegations coming from Facebook or someone’s interpretation of events. Those are her own recorded statements. People can debate the consequences, intent, or legal implications, but denying that the conduct occurred is difficult when the person involved publicly acknowledged doing it.

TEXAS ATTORNEY GENERAL INVESTIGATING CLAIMS INVOLVING GUNTER MAYOR!

OurGunter has confirmed that the Texas Attorney General has accepted the claims submitted by Gunter PD involving Gunter Mayor Karen Souther and an investigator has been assigned. The investigation includes two issues that we have spent countless hours researching through Public Information Requests, emails, meeting records, contracts, financial documents and hundreds of pages of City records.

CLAIM #1
EXECUTIVE SESSION RECORDING

Texas Government Code §551.146 makes the unauthorized, knowing public disclosure of a recording of a lawfully closed executive session a Class B misdemeanor.

Records and public meeting video at issue show that Mayor Souther recorded executive-session conversations without the knowledge of other council members and later played an executive-session recording publicly during an open City Council meeting.

During an open meeting, Souther also acknowledged that she records executive sessions despite knowing she should not.

The Attorney General investigation will determine whether that conduct constitutes a violation of §551.146. A conviction under that section can carry criminal penalties as a Class B misdemeanor and may also create civil liability.

CLAIM #2
THE $155,000 AMBULANCE PURCHASE

The second issue involves approximately $155,000 spent to purchase two ambulances without prior City Council authorization or approval.

OurGunter’s records research found no council vote authorizing the purchase, no prior council approval of the contracts, and no applicable council delegation authorizing the mayor to independently obligate the City to this expenditure.

The ambulances were not purchased through BuyBoard or another identified approved cooperative purchasing process, and records indicate the required competitive procurement process was not conducted.

Perhaps most importantly, emails obtained through Public Information Requests show Souther representing to the Grayson County Judge that she had council approval related to the ambulance matter when council had not approved the purchase. Other emails address her decision not to pursue an RFQ for EMS service.

The ambulances were subsequently titled to the City and exempt government registration was pursued. When the City Council eventually addressed the unauthorized purchases, the Council refused to ratify them.

Texas Local Government Code §252.062 makes an intentional or knowing violation of §252.021’s municipal purchasing requirements a Class B misdemeanor.

And there is an important consequence if a municipal officer is ultimately finally convicted under §252.062(a) or (b):

Texas Local Government Code §252.063 requires immediate removal from office.

The statute also makes that person ineligible for four years to be a candidate for, appointed to, or elected to public office in Texas, among other restrictions.

To be very clear: an investigation is not a conviction, and these allegations have not been adjudicated. It will be up to investigators and ultimately prosecutors and the courts to determine whether the evidence establishes a criminal violation.

Our job is to follow the documents wherever they lead.

This investigation did not begin with rumors or Facebook speculation. It followed hours upon hours of research — filing Public Information Requests, reviewing emails line by line, comparing dates and dollar amounts, watching meeting footage, reviewing contracts, tracing transactions and working through page after page after page of government records.

Why do it?

Transparency. Accountability. And the betterment of the City of Gunter.

Public records belong to the public. When those records raise serious questions about how taxpayer money was spent or how government business was conducted, the citizens of Gunter deserve to know.

I know it’s not “Gunter”, but it’s close enough!

We are were tagged in a post asking for some info on Prosper’s Project Tomahawk….we did a little digging and got some info from agendas and online information so we combined it and let chat make it pretty to save time.

Please note: the project has NOT been approved yet and the Prosper council has removed it from the August 18th agenda as of now.
