Railroad workers are among the most rigorously drug and alcohol tested employees in America. Federal law mandates random testing, post-accident testing, reasonable suspicion testing, and return-to-duty testing — all under strict FRA oversight. The program exists because of a single catastrophic event. The 1987 Chase Maryland collision — where 16 people died because of crew impairment — directly produced the federal railroad drug and alcohol testing mandate that has governed every engineer and conductor in America for nearly 40 years.

The FRA classified virtually every Brightline death as trespassing — people walking on tracks, lying on rails, running toward trains, driving around lowered gates. In 2023 approximately 40,901 people died in US motor vehicle crashes. 771 pedestrians were killed by cars in Florida alone that same year. More pedestrians die every single month in Florida from vehicle strikes than Brightline has killed in its entire existence.
