Total Vindication for the City of Cape Coral.
After he was fired from his job as Cape Coral City Manager over a year ago Roberto Hernandez filed a discrimination lawsuit against the city. Hernandez has decided to drop the lawsuit completely in an agreement with the city you can read below
Settlement Agreement
ROBERTO HERNANDEZ and the CITY OF Cape Coral hereby enter into this Settlement Agreement to formalize the agreement reached by the Parties in the matter styled Roberto Hernandez v. City of Cape Coral, Case No. 24-cv-00252-SPC-NPM, filed in the United States District Court for the Middle District of Florida (“Lawsuit”) as follows:
1. The Parties have agreed to settle the above-referenced matter on the
following terms:
(a) Hernandez will dismiss the Lawsuit against the City with prejudice. Hernandez irrevocably remises, releases, acquits, satisfies, and forever discharges the City, its agents, servants, police officers, councilmembers. staff, employees, and insurers, of and from all, and all manner of action and actions, cause or causes of action, suits, attorneys’ fees and costs, specialties
covenants, contracts, controversies, agreements, promises, variances.
trespasses, damages, judgments, executions, claims and demands whatsoever, in law or in equity, which Hernandez ever had, now has, or which any personal representative, successor, heir or assign of Hernandez, hereafter can, shall or may have, against the City, for, upon or by reason of any matter, cause or thing whatsoever, arising from Hernandez’s former employment as City Manager, and to any cause of action raised in, or that could have been raised in, or arising out of the filing and prosecution of the litigation described as Roberto Hernandez v. City of Cape Coral, Case No. 24-cv-00252-SPC-NPM.
(b) The City agrees to waive any claim for costs against Hernandez.
(C) The Parties shall pay their own attorneys’ fees.
