🚨 THURSDAY LAW COMPARISON:
DOES EVERY NOTARY NEED A STAMP?
Do not buy, replace or use a notary stamp based only on what another notary carries.
Notary tools are governed by the commissioning jurisdiction. The required wording, format, ink, size, custody and replacement process can differ.
📍 CALIFORNIA EXAMPLE:
California requires an official notary seal. The Secretary of State provides commissioned notaries with a list of authorized seal manufacturers, and the current handbook explains the seal requirements.
📍 NEW YORK EXAMPLE:
New York Executive Law §137 requires specified information beneath the notary’s signature in black ink.
The statute says that information may be printed, typewritten, stamped or—when performing an electronic act—affixed electronically in conformity with the law.
New York therefore does not make a rubber stamp the only permitted way to place the required information. Electronic-notary rules include separate electronic signature and seal requirements.
These are two state-specific examples—not a nationwide rule.
Before your next act, verify:
1️⃣ Is an official seal or stamp required for my type of commission?
2️⃣ What exact information, dimensions, border, ink or reproduction standard applies?
3️⃣ Who may manufacture or possess it?
4️⃣ What must I do if it is lost, stolen, damaged or replaced?
5️⃣ Are electronic acts governed by additional rules?
A product listing that says “notary stamp” is not proof that it complies with your commission.
